  1. Hi All, BOS caved in! Faced with baliffs set to go into Trinity road this week they paid out the remainder of my claim.........despite on several occasions telling me 'we do not pay contractual interest....do what you please' they bottled it. Another £913.30 hit my account today, this is the difference between the judicial interest that Bos paid me on the 29/01/07 and the contractual interest I claimed.....plus the warrant fees of course. Still no letter to explain the payout ........so I phoned, this is the jist of the conversation ( I noted that 'bank charges is now an option on the automated telephone system!!!!!!!) ME: hello, can you please tell me the court reference that the sum you deposited in my account today relates to? BOS: It is a payment regarding your claim for a refund of bank charges. ME: No, I need you to tell me the Court Claim reference that this payment relates to BOS: I can't the system does not tell me that. Why do you need to know, your charges have been refunded? ME: I currently have 3 simultaneous Court claims againts the BOS, I need to know which this payment relates to, this will let me know whether to stop the baliffs entering Trinity Road to recover my money. BOS: Oh!I will find out and call you back. 5 mins later BOS: The payout relates to Court claim no ********* ME: Thank you I will inform the Court that you have paid up in FULL So there it is BOS will payout with full contractual interest! Hi, the £55 Bailif charge is added automatically......I called their 'customer relations' call centre and explained that I had a warrarnt, the BOS had a ccj which could affect their ability to hold a credit licience........and that I was going to send in bailifs...........I was told that to get my money I would have to go ahead!   3. hi, I'm still waiting on my court papers.......... however I have personal claim against BOS.....they paid out £4973 plus 8% judicial interest but my claim was for contractual at 16%..........BOS told the court that the claim was settled....I told the court it wasn't...so I got a default judgement for the balance. I called BOS to tell them and they told me they did not pay contractual interest............well the Judge says different! still they refuse to pay the difference so I applied for and got a Warrant of Execution and the Baliffs are going in to get my money. The Bank of Scotland do not know whether they are coming or going! Roscodog18

Well Black Horse ignored my request to refund the interest that I claimed plus the court fee so the case continued........no defence was submittted and I applied for and got a default judgment:) I'll call them on Monday to again ask for the balance, if that doesn't work then I'll apply for a Warrant of Excecution ( what a great name for it!) and send in the Bailifs. The court recieved it on Friday 09/03/07 the cheque cleared on Wed 14/03/07..........I have had personal claims againt BOS with no problem and have a business claim against Llods TSB which is now at AQ stage......I am in Scotland but for all my claims have used Carlisle County Court with an English mail forwarding address.   6. Hi, I have an ongoing claim against BOS for a now closed business account......the English court has not come back to me with anything like that. They did bank my cheque though! Roscodog18
  7. I asked for a default judgement but at the same time Martineau Johnson have entered a defence.........just the standard pro forma defence.....still it has been lodged 4 weeks earlier than expected! On to the AQ Roscodog18
  8. :-DWell....my claim continued and BOS did not enter a defence.........so I asked for and got a default judgement........called BOS 'customer services' to ask for my £833 extra to cover the contractual interest to be told by an uninterested call centre employee that they do not pay contractual interest.........not according to the Judge....the reply was I would have to enforce it to get my money! And here was I trying to be non confrontational! So I today applied for an Excecution of Warrant........cost me ( well BOS) £55...........I think it will now get really interesting!!!!!!!!! I'd love to be there when the baliffs go in to recover my money:) Well my second claim has been served, charges since the first claim started, and my third claim for a now closed business account going back to 1995 has been served...............as of today I think I might be BOS most hated customer:-D Roscodog18
  9. Hi, i already had my statements....so sar they have settled the charges but not interest or court fee. total still outstandig is just over £110 so I have asked the court for a default judgement because they have not responded to the court. Roscodog18
  10. Hi, I use Britannia Crest costs £45 for 3 months plus the cost of stamps to forward letters. I've had no problems with them. Roscodog18

  12. To get BOS to pay up you will have to file court papers, but after that they seem to pay out quickly. Carlisle is as close as you can get when you live in Scotland.........but far form the head office of the bank! Roscodog18
  13. Hi, I am in Scotland but claimed against BOS using Carlisle Court with an English mailing address. Bos paid up 2 days after acknowledging the claim........my next two claims against them have now been posted to the Court:) Using the Enlish system is easy and for a large amount far quicker.   14. Hi, I reclaimed charges on a finance agreement.........as soon as I filed court papers they paid up but without the court fees or interest....I have now applied for a default judgement for this Roscodog18
  15. Hi, this is the company I use.......£45 for 3 months.....I've had no problems Britannia Crest Strange thing is the Court have only sent 2 letters to the mailing address.......the vast majority are sent direct to hy home address. Roscodog18
  16. Hi, I used Carlisle County Court, quite close to me and far from the head offices of the Banks! Whether you use MCOL or an N1 you MUST have an English address for corespondance.....I set up a mailing address online...£45 for 3 months, another expense I know but for me it was better than splitting claims. Well after some thought I have decided not to fax a copy of the court paperwork......if they are so unorganised that they do not have it well tough!........I have applied for a default judgement and will wait and see if I get it without any problem........time will tell.....no matter what they do I will recover my money in the end......   18. Hi, with me Bos paid up 2 days after they acknowledged the claim. ( 16 days after I posted it ) No letter just a deposit in my account.....I used the English courts as I was claiming almost £5000 and didn't want to break up the claim...........don't be nervous, it is a walk in the park.......I'm have now submitted a claim going back to 1995 for both personal and business accounts.....it's YOUR money......follow the instructions and wait Roscodog18
  19. SC&M just called and asked me to fax a copy of the court paperwork so they can send it to the correct 'people', they have no record of my claim....should I send a copy or just wait for the default judgement then excecute the warrant? Roscodog18
  20. I finally managed to speak to SC&M......who have no knowledge of my claim. The suggested because in is a business claim that Martineau Johnston would be handling it. Has anyone dealt with them? Roscodog18

Hi All, I have been claining against Lloyds for my business account (Limited Company) I have submitted my N1 and the date for acknowledgement was 05/03/07 and Lloyds failed to respond, today I phone Lloyds and was told to speak to SC&M.........on two occasions I was told they would call back....I'm still waiting ( having read about their conduct in numerous threads I'm not in the least surprised). I know I'm in it for the long haul! I sent off the form for a default judgement to the court....was this the right thing to do? Is this normal for Lloyds? Incidentally Lloyds TSB Cardnet handle credit card payments for my business.....I had penalties for d/d's that had bounced and cardnet paid up on my prelim letter so if you have a business account go for them as well. Any advice would be greatly appreciated Roscodog18

Hi, yes I do still have a balance, I have only been told over the telephone that my account has been closed....no warning letter...default letter or even a letter saying it has been closed..........Has anyone else had anything similar? A basic template letter for this would be a great help. I think it may be worth me fighting on? Roscodog18
  23. Hi, I rejected an offer of all charges plus 8% judicial interest. I recieved all charges plus contractual interest and court fees after they failed to acknowlege the court claim, I called them and told them that I was about to ask for a default judgement...........they did however close my account in retaliation!   24. Hi, I attempted to pay an insurance bill with it and it was declined depite being well under the limit. I called to find out why and was asked to pay off my balance because my account had been closed.........I asked to speak to Louise Miller why I had handled my claim at the end, I was told she would call........I'll call her again this morning. I recieved no warning by letter or telephone of this. Roscodog18
  25. Hi all, expect MS to close you account after they pay out............and not even bother to tell you that the have! I didn't get the promised call back that I asked for today..........I'm glad I'm on talktalk and have free calls.......I'm happy to tie up staff as long as I can My offer came with no conditions.....cetrainly not closing my account, so if needed I will report the retalltory action to the OFT and FSA..........I believe they are starting to fine for this now.
