  3. Yes i was talking about the CCA. I do owe the money that is not the issue its the fact that the debt has suddenly been moved to a different company. I also spoke to Equidebt today and they know nothing of the debt being transfered to anyone else as I am still on their books. They told me to get in touch with their clients and see if they have moved it somwhere else. If they have does this happen often. Its hard enough to get a deal with one DCA let alone several over a period of time. Will now print and send the letter to them and see what happens.

  5. I have recieved a letter from Rockwell saying that they now have the debt that I had fought long and hard for Equidebt to accept. The ballances between the 2 Companys are nearly £65 apart. I phoned them as per the letter, forgeting to check with anybody here, and as I have now found out that was a bad mistake. I will be calling Equidebt tomorrow to see if they know any thing about this. Can I still carry out your procedures or have I shot myself in the foot. Any help Appreciated. Thank You. Ian Constable.

  7. Hi Folks, Recieved a N24 Notice of Hearing form from the court. I have looked in all the FAQ's and can't find any reference to this form. Can somebody help me as soon as possible as the hearing is on this Wednesday afternoon. panicing a little, Ian

  9. Hi Folks, Well made the decision, I want the lot. Filed my Allocation Questionaire on the 23/08/06. Lets see what happens next. Can anyone tell me if a bank has sucessfully closed any members accounts yet. The main reason being that because of them I have had a lot of stress and problems. They seem to think that they have the right to take their money even if there is no money left in your account, which just snowballs into bigger problems the follwing month. Well thats got that off my chest, for the moment. Claim total now at £2301.68 Also started a thread under litigation in progress. As always keep you posted. Ian & Maria.
  10. Hi Folks, Soory for the delay, been visiting my parents last 2 weeks. Any way lets get on. Came back to my allocation questionaire and a letter from abbey's lawyers with there defence, basicaly citing the terms and conditions of the account in that if you don't have the money we won't pay and charge you for it. Also in their letter they offered a good will payment of 50% of our claim of £1182.32 (my claim £2244.63) as full and final payment. They also dispute that "The claim is based on an argument that abbey should not charge at all. Even if it is correct (which is not accepted) that the charges are greater than abbey's actual loss, abbey would be entitled to charge something." I'm a bit snookered in deciding what to do next I have till the 25th to file the AQ in the court. I realise that it does cost them somthing but even at £16 - £18 is still a bit excesive. Any sugestions would be a help. Keep you posted of developments. Ian

  12. Hi Folks, Been offline for a few days. Got a letter from Piper, Rudnick, Gray, Cary Abbey's lawers i supose basicaly says "All correspondence through us from now on. We are in the process of preparing a defence. You have also failed to provide evidence for your claim, please provide all evidence." Any Advice, as we handed in our evidence when we filed the claim. Reference the bank account my wife got one in her name not a problem. Defence reply expiry 31/07/06 Will also prepare second claim against Abbey in a Couple of weeks. Ian.

  14. Hi Foloks, Well went ahead and did it, took my N1 form to the court 11/07/06, no problems they just took it and said they would serve it that day. Now it's a waiting game. On Saturday we recievied a letter from the Abbey of 4 pages. Basically it says "Were sorry that you hve had to complain but you made the problem and our charges are fair compared to other banks. We would like to offer you £270 refund as a goodwill gesture and this would be full and final settlement. If this claim reaches the County court we will review each case individually, and if we feel that the relationship with our customer has brken down completely, we may decide to close the account under our terms and conditions" This letter was sent on the same day as I went to court, so they must have crossed in the post. I am going to get my parachute account today, if anyone will take us on with our financial situation, lets see what happens next. £270 for £1981.02 in charges, no chance. Ian.
  15. Hi Folks, My LBA expires tommorrow, I will be filling my N1 claim on Tuesday. Just realised that we had a Yorkshire Bank account prior to the abbey, will start the DPA route as soon as we find the account number. I am still a bit wooried about my second claim to the abbey for the charges that I have no proof of as they still havent sent the statements. Do I just go for a estimated claim against them. Ian
  16. Hi Folks, No further response from Abbey, sending my Letter Before Action today, lets see how that one goes. Also recieved my small claims lawpack today, lots of info and good value, hope I won't need to use it. Ian Claim for 13 months £1981.02
  17. UPDATE I sent my LBA letter special delivery on the 7/6/06, Recieved this reply yesterday. "Thank you for contacting us and I am sorry that you have benn so unhappy that you have felt you must coplain One of my team will be responsible for investigating your complaint and I have enclosed our complaints leaflet, which explains our procedure for doing this. High quality customer service is of great importance to us at Abbey and we will do everything that we can to resolve your complaint in a timely and satisfactory manner. I know that it is important to you that we resolve your complaint quickly, but we want to do a through investigation and sometimes this can take time. If we have not contacted you before then, we will write to you in four weeks to let you know what is happening. Although I do not know what the outcome will be, I do hope that we will be able to find a solution that you are happy with." This was from Marc Winder, Head of Complaints, address Abbey PO Box 5129 Milto Keynes MK9 2YN I guess that this is a standard reply, only 7 days to deadline.
  18. Quick question, no I could'nt find the answer in the FAQ's, The schedule of charges mentioned in the preliminary letter is that a copy of the excel table from the templates thread.
  19. OK will go ahead with the small claim and then hit them with the second. At least if I do it this way and I over estimate and they challenge they will have to provide my information, that was all on micro-fiche, to prove there case. Here goes.
  20. I have filled in the N1 form and the ICO complaints form but I am still unsure as to the best route to take. Should I just use one or both at the same time. I asume that once I have made a claim for the smaller amount that i cannot then make a claim for the rest at a later date. I have ordered the Lawpack from your site to get everything right. Evidence - £1868 Estimated another £3000 And I need the money.

  22. Update. Hi, Sent template 2 of the DPA Non-Compliance letters recorded on Monday. Recieved 1 more month of statements today. Better start getting my N1 form ready for the county court. Should I have contacted the IC before I sent this letter. Please help. So far the claim is £1868 for 13 months
  23. Hi, I am just about to take them to court for non-compliance as the 40 days ran out last Monday, is this right or have I missed somthing out.
  24. Hi Folks, The story continues. Tried to phone customer services got nowhere, then sent an e-mail through their contact us section on wednesday. I got a reply today saying call us to confirm who you are, so got them to phone me. Started by say that I had to pay for the statements, Sent the cheque with the letter, pulled them up on that one, then transferred to another department. They said that we only have 1 year available the rest on micro fiche and will take 3/4 weeks to be sent out in yearly batches. clock stops on Monday should I start to get the letter to the Information Commisioner ready ?
  25. No, each one came in a seperate envelope just like a normal statement.
