  1. Yeah that's what I thought but like I said, I got fobbed off by three different people no matter how persistent I was. It was H&M, a massive chain retailer so I didn't think there would be any problems. But apparently they're too lazy to enter the code on the boots and see how much they come up at! (If they did they would see that they were exactly what I paid for them....and is written on the receipt.) Hmmmph!
  2. Thanks for getting back to me. I suppose you are right that they don't have to refund me, but it does say on the back of the receipt that you can exchange for any reason within X amount of days. There isnt a customer service number but I will try to find one (might end up talking to someone in Sweden! I think this is where this brand is based...!) When I bought them they didnt have a label on them so I guess the checkout person typed in a general sale code (unlabeled goods) and typed in the price manually. Little did I know the problems this would cause - I will always make sure I get this done properly in future! I suppose I will just have to battle the Bullring crowds on Saturday, or send my Dad in to do a Mr Angry. (Always works!)
  3. Hi, I need some help! I tried to check the OFT/consumer rights websites but they don't seem to be specific enough for me so I hope you lot can answer me. I bought some boots from a high street clothes shop last Saturday and changed my mind so decided to return them. I went into the Coventry shop today and they refused to refund me as they had been put the wrong item code on the receipt. I spoke to three different people including two managers who proceeded to fob me off saying they would never accept returns of items that had been sold on a general sale code (what they when they cant find a barcode apparently). They said that I had to go back to the Birmingham shop where I bought them so that they could look at their cameras to check that I bought them. It sounds like they don't believe that I bought them and that I'm trying to con money out of them! I cant get to Birmingham again any time soon, and I don't see why I should travel all the way there to take a £50 pair of shoes back. Its not very fair as I wasn't made aware of this code thing at the time of purchase. Is there any way I can get them refunded as I could really do with being £50 up right now? Thanks everyone!   4. Back on this forum again after getting royally shafted by the new daily fees - I cant believe they can get away with this!!! I've gone accidentally overdrawn due to a cheque for £23 and gotten charged £90 odd already. I check my balance daily but this only appeared yesterday, but they say it went through on Thursday. Nice of them to let me know....finally. After building up loads of penalty fees!!! I'm going to send in another letter today to get my fees back. Hopefully it won't take too long for them to process it - although I know on Martin Lewis' website it says that as they are in the process of deciding the outcome in court it may take a while for a decision to be made. Oh well, may as well get it in ready for when they decide the banks are a bunch of daylight robbers! (We know they will!)
  5. Hi Barty, I got to the stage where you fill in an MCOL, I hadn't quite finished it though. Im glad I didn't have to go to court, too much uni work to be done! I went into Lloyds today to query it and she politely told me - I was chuffed! (She also said she wished she could claim hers back, I suppose her job might be at stake.)   6. No worries everyone - I got my cash back. Lloyds sent a letter in response to my request for payment declining to refund my claim, however in a matter of days since receiving this letter I had received £514 as a 'goodwill gesture'. This is the total amount I was trying to claim - minus interest. I don't think I should be greedy in asking for the interest too, but what do you think? Im a student with a student loan debt of nearly £10k after all! Eva
  7. Hi, I just started the online claim, but as I am claiming for two separate accounts (both with Lloyds TSB) do I need to do two separate claims? It makes it really confusing in the particulars of claim. Help! This is what I have so far: 1. The Claimant has two accounts 02020745 and 16813570 with the Defendant, opened on or around 20/01/2000 and 20/09/2004. Since DATE the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £514.00; (b) Interest per S.69 County Courts Act 1984 of 8% - £78.98 continuing at 8% until judgment or settlement at a daily rate of £0.11; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court. (I haven't looked at the date of the first penalty yet. Will do.)

  9. Hi, I received a reply from Lloyds today regarding my request for payment, again rejecting my claim for £514. It says that this is their final response (as they said before.) I assume that now I proceed to posting a claim online to HMCS?? Is it normal to keep getting letters saying "this is our final response"? Are they just trying to make me give up? I was looking forward to getting this cash so I can go and work in New Zealand, I hope it all works out... Eva
  10. Hi again, I received a reply from Lloyds on the 25th November (a while ago I know, xmas arrived!) stating that they would not be refunding me and this was their final response. I am now going to find out what I can do from this point. Im stuck on the letter before action though, how do I know what they have charged me in overdraft interest? The total I will be asking for is £514, is this the 8% worked out by the spreadsheet? Thanks for your help! Evavu
