  1. hi guys long time with no activity, until a couple of weeks ago when I received a "discontinuance" letter. I've spotted a few other threads on here with the same activity. I'll read before deciding what to do.
  2. ok thanks for that. Just wondering whether HFO have done anything similar with other (post "stay") cases ?
  3. indeed, but is there anything stopping them going for a new claim for the whole amount? They are up to something otherwise why bother in trying to meet the CPR ?
  4. Case was stayed on 20 June. have issues with scanner - will try again later tonight.
  5. thanks Last payment was feb 2007 - I had made a few payments to Mercers before the account was passed to HFO. yes there are T&C - will try to scan them later tonight.
  6. been quiet since 17th may when I got acknowledgement of defence from court. Heard nothing within timescale so assumed it was stayed. Got letter from HFO yesterday entitled "response to request of documents" and that my account will be referred back to Business Support group. who will contact me to discuss outstanding balance. they have enclosed:- 1. a copy of the original application form 2. copy of default notice issued by Mercers on 13 May 2005. 3. letter from Barclaycard dated 24 June 2011 (addressed to me but not sent to me). they quote section 78 of CCA and state they have met the CPR . they enclose a statement of account, and a copy of the agreement (albeit a bit blurry). I assume HFO have modified their tactics and are likely to go to court again ? any info/advice appreciated. thanks
  7. just an update today I posted reminder to TR and defence to the court.
  8. ok just checking I have this right. HFO should have received cpr on 9th May. on 16th I send reminder. date for defence is 18th may - which means I should send it no later than 16th. I'm assuming the defence listed on the thread linked in post 39 is the one I should use ?

  10. just an update. MCOL confirmed defence required by 18th May debt sold to "hfo Services" cpr letter sent -should have been delivered yesterday
  11. yes was 15 april sorry don't know which branch of hfo -will spk to them again. will send cpr asap. thanks
  12. ok barclaycard have now confirmed that debt sold to hfo in june 2007. also said they would write to confirm. what should I be doing now? I have acknowledged that I intend to defend . Should I be sending the cpr request to hfp/turnbulls ? also although I understand each bit of advice given individually, I'm none to clear as to how all this fits into a defence ? grateful if someone could give me a basic run through.
  13. ok I've been in touch with Barclaycard and it makes interesting reading according to them the account has not been sold. It was originally passed to Credit Security (don't recognise them) to deal with and then passed to HFO Services. They confirmed that HFO manage/handle the account but do not own it! HFO took over the management of debt on 27/6/2007 last payment was on feb 2007. if true then :- 1. surely they are not entitled to claim, and 2. I could still settle with barclaycard ?
  14. yes everything is as stated. the claimant is Capital, the POC is services, the NOA is capital, and subsequent letters are services!!!
