Help Capital Bank Charges over £100 in one month

Hi Suzzy I have car finance with Captital bank and im agruing the point over unfair charges with them as well. Im no expert on this but im pretty sure that if u are up to date with all your payments (ignoring the charges) they cannot charge u any further. What happend to me was I got behind in payments and got whacked with charges. My missed payment was £247 then with charges took it to over £500 and i also got the threats of defaults / car taken away etc. So what I did was pay the £247 outstanding DD and disputed the charges, this put a stop to any further charges being made as they cannot charge u for charges (I think). It did put a stop to any more charges being added to my account and made me sleep a little easier as it was getting out of hand, the more charges they hit me with the more difficult it became to pay the DD (Dont ya just luv banks) -
Well thats me shattered!! Called my local RBS branch and a very nice lady kindly put in a request for duplicates to be sent out 'free of charge' and they should be with me within 7 to 10 days. I wonder if they will be so nice when they find out what Im using them for!! Here goes.....

Hi folks I sent my DPA letter plus £10 payment to RBS a while back, since then ive left the address they would have been posted to and my LOVELY EX didnt pass on any mail till I got it re-directed. Does anyone know if i have to go thru the whole palava of DPA 40 days etc or are RBS going to be kind enuff to give me a duplicate (Kind and banks!!) hmmmmmmmm Im guessing the answer but Its better to know for sure before I call them. Quick question!! My Ex ran up a big over draft on this account im claiming back the charges for, Im in the middle of arguing thins over between lawyers. My question is, when the bank finally admit they are at fault and refund you your money bank, will they pay it direct into the account and I end up paying her bill or can u get another method of payment from them? Received a letter today from BoS redress assessor Increasing their offer from £185 to £555 (6 months charges) as they state, in an attempt to reach an amicable solution to my complaint. This is of course a full and final settlement to all my accounts regardin BoS. Not bad considering they have taken over £3000. They say they are keen to resolve this matter and to let them know if there is anything they can do to put matters right. Giving me MY other £2500 back might be a start....

Here is my case so far regarding BofS Asked for back dated statements personally at my local branch and recieved them about 3 weeks later. In my 2 accounts the charges are over £3000 so I sent my prelim approach letter asking for the 1st batch of charges(keeping it under £750) back and an offer of £185 as a goodwill gesture was made from them. So I sent out my LBA (recorded delivery)which I made from the Govan Law centre on the 29thJune stating if I do not hear from them in that time I will raise an action in my local court. Called BofS today 7th July just make sure they got the letter and she said It only reached their dept on the 6th July said she THINKS it reached the BofS on the 4th and said they have 4/5 working days to reply and if I wasnt happy I was more than welcome to go ahead and start legal action.... Im just wondering would it be better for me to wait and see what they have to say in regards to the LBA or start legal action as they failed to reply in the time I gave them. many thanks Steven....

Hi WSM36 Yup Its Capital bank car finance, Ive been having a nightmare with my claims I had to move house and my Ex Cleared the house out with all my bank charges info laptop with all my details etc so im having to start from scratch again.......here is the address I was dealing with. Capital Bank accounts dept City house City Road Chester CH88 3AN 0845 60000655 is a phone number I have, not sure which dept tho. Cheers -
Owned by a banking org............Shock!!!! It wasnt so much the Egypt thing, as our lovely Foreign office states Its safe to travel. It was the £240 extra to change everything from a name, date and place etc i was wondering about.........It was a breakdown of £30 per name x 3, £30 per date x 3 and £30 per person per change of country x...........eeerrr 2 they must have let our 10 year old off with that one = £240

BOS acknowledged - what happens next?

I asked for mine personally at my local BOS branch and got asked by a very nervous looking supervior as to WHY I wanted them..........Told her in a nice way it was NOYB, she hummed n hawwd for a while as to how hard it would be etc then after flapping for 20 mins agreed to get them sent out and they were with me within 14 days (Two Accounts over £3500..........Not sure if ive made a mistake in not sending the DPA letter with manul intervention questioned , but the statements were quite quick in arriving.... -
LOL Tink glad i could be of help........ They are saying i will lose all of the £400 deposit if i cancel all together because the foreign office say its 'safe' to travel to Egypt and its £260 to change, either way im gonna lose!!!

We had booked a trip to Egypt this summer but because of the recent bombings my other half doesnt want to risk taking our wee one. I called Thomas cook to say what happens to our £400 deposit. Well u have till this Friday to cancel and u lose the deposit any time after and you get a % added...........fair enuff. Then I asked about changing the booking she said..........Its £30 to change the date going out £30 to change the date returning £30 to change the duration £30 to change country etc etc etc etc So a week In Tenerife was costing me an extra £240 just to change the booking. Is Thomas Cook now a BANK?? Surely this is a wee bit extreme and Im wondering if these charges are similar to Bank charges, any ideas????

Sent my prelimenary letter to Capital bank regarding the £400 in charges and today got a very serious message on my mobile telling me its VERY urgent I return the call!!! The urgency was they have recieved my letter and it was too tell me i was very silly and the charges were all legal, they wouldnt be getting returned and they would not be contacting me by letter regarding this issue. Then she went on to ask me to explain WHY the charges are illegal. I said its all in the letter............well I dont have it in front of me she said so can U explain. I said well im not a lawyer and I dont have the info in front of me but can u give me a breakdown of how it costs you £30 to send a letter saying a DD was returned??? NO she said I dont have to!!! Then she 'Strongly' advised me to take my T's&C's into a lawyer so he can point out to me what a fool I am and how they are right etc etc That will be that then lol, im guessing this is where I send my Letter before action???

I asked for mine in the branch personally with an equally nice wee teller who was more than happy to order them, untill she asked her supervisor a question who nearly had kittens!!!!! She sent the poor girl over to ask why I wanted them, then over came big Helga with an attitude..........Im thinking my branch of BofS has wind of whats happening!!!! Best of luck.... -

Got my statements thru today and they add up to just under £500 over the two years of the loan. They include Admir arrears charges, Unpaid DD costs, FBS letter charge??? and FBs telephone costs??????? Also £15.78 additional intrerest (Is this what the 8% we can claim is)? Can anyone let me know If its just the normal letter before action one I send or is there another one for loans? (I know there is a different one for CC's) Heres Hoping Steven...... -

I called the collections Dept today (spoke to a manager)to let them know I was disputing the charges as they were unlawfull and wanted my default taken off etc and guess what!!! He told me he's had loads of phone calls like this but the charges ARE legal because they are charges for late payment of a loan and the OFT ruling was only in regards to credit cards. I pointed out to him his colleague had admitted they were a penalty and as such, they were unlawful only to be quoted Terms & conditions and that does not apply to loans blah blah. Still nothing altho I did advise him by law i was recording the conversation so this time when i offerd to pay the outstanding amount of my monthly direct debit he was happy to accept but refused to budge on the charges. Can anyone let me know for sure if he's right in saying about the OFT ruling only applying to CC's and should i go ahead with further action even tho this is a late payment of a Direct debit for a Loan the charges are for? many thanks -

Just saw this on the Capital One section. 'state that the account is in dispute and won't be paid until Capital One have removed the excess charges' Regarding my Capital bank (Bofs) car loan I was thinking of paying the £247 monthly payment and then disputing the charges (Not that they let me pay any more than the £200 ive already given them) Does anyone know if legally they can charge me for outstanding CHARGES if the monthly direct debit is paid? Hope that makes sense lol Steven...
