  1. Thank you will have a look. I cannot get over the fact that if you miss a payment it starts of as a one on your credit report then 2 etc but they have mine as 6 misses. Which you would expect it to look like 6 5 4 3 2 1 0 0 0 0 but my credit history is 6 0 0 0 0 0 0 0 0. I have heard and read that they do this on purpose so it effects your credit history and if you are looking for finance you end up going back to them. As this sits on your credit report for 6 years.   3. Hello everyone. Sorry not posted on here for a long time use to post in Welcome Finance Any dealings??? I am still chasing welcome and it is like hitting your head of a brick wall. I never took out PPI with a joint secured loan but welcome said there was a single policy taken out and they have given me a photocopy. The PPI has no agreement no and date. The signature of my husbands look nothing like his but mine looks okay but it is simple enough to copy. Also is looks as if it has been photocopied on with the way the lines are. Anyway the amount I am trying to reclaim is £6,945.09 which includes penalties, PPI, erc plus interest. Who do we sent letters of complaint to is is FSA, FOS or someone else? Has anyone had success in fighting them. Sorry forgot to mention. I get a copy of my credit report every 6 months just out of interest and the last one stated welcome was sitting at a stage 0 as all my payments were up to date (as I settled) I got a copy of my report today and hey presto. Welcome is sitting at a stage 6 misses. They have been sending me letters about taking out another loan but they have been ignored. Is there anything I can do to get rid of this as I need to apply for a loan and this is sticking out like a sore thumb. thanks sandra

  7. Hi falcon185, Re:- settlement of 50% payments. At the end of the day the decision is yours but if your charges and PPI come to more than the settlement I would say accept the 50% reduction as part payment towards the charges and PPI and continue to pursue the difference. Good luck sandra
  8. Hi Has anyone managed to get the full refund from capital one. I cannot get them to budge past the £12 as they say OFT says it is an acceptable fee. I have asked them to prove it with with a breakdown of their costs but they are being stubborn. Husband charges plus interest = £1018.34 only offering £344.00 My account defaulted due to charges which is £2,215.52. Balance at default date was £850.00 = They have offered £36.00 Next step N1 form.
  9. Hi Just had another bog of letter from welcome and they are also threating to take further action for me not returning their £70 cheque as part payment. I spoke to Kieren this afternoon and informed him that I will be requesting a refund of PPI as well. I never signed any documents or requested this. He said Direct had a copy of these forms. Spoke to Direct twice today (different numbers given by welcome) both said they do not hold copies of the signed agreements or schedule of cover and only key in details of who the insurance policy is for. According to welcome they said I only took single cover for a joint loan. I advised him I already had an income protection insurance with my bank so the PPI would not have been requested plus I would not only cover 1 person on a joint loan. He wants a copy of the insurance document I had with my bank before he will investigate the PPI. Do I give them this or tell them to bog of and prove I signed the documents? thanks sandra
  10. Hi everyone. Just catching up with the thread and reading about the name change for welcome. If you check your credit report they do not do the search under welcome finance but under Progressive Financial Services. I queried this with experian a while back and they said it was a valid check on my credit history by a parent company of one of my lenders. I got a new credit report 3 weeks ago and it has the following. Financial Associations checked by Welcome Financial services in 18/4/2002. they then did another check on 11.06.06 as Progressive Financial Services and I still do not know why. ON THE CREDIT ACCOUNT INFORMATION SECTION. Welcome Financial services (mortgage) has been changed to Progressive Financial Services (mortgage) and this account was closed and last updated on 11.06.06 Experian said it was the same company and I cannot see why they can refuse to accept claims.
  11. Hi everyone Sorry I have not posted recently a lot of things going on which has given welcome a bit of breathing space. Been looking for new job as AOL has just pulled out of their contract with their scottish support office and transferred to India. So I am in limbo land as from Sunday 14th which was our last day and all we were offered was crips and juice and your P45 at the end of January. Lets hope the old saying is true as one door closes another opens. I will write to welcome today giving them a final 7 days before proceeding to court. Hope everyone had a good new year.
  12. Hi Carinas Hope you had a good new year. I have read through a lot of sites here and a lot of them state that it is not only banks and credit cards. There is a lot reclaimed for charges on missed mortgage payments charges, charges for finance on cars, loans so there is no reason why Welcome is any different. I did find one on Halifax disputing this as well that it only applied for bank charges but this was disputed by the claimant and they won. I just cannot find it again as there is so many to go through but I will keep looking. I am awaiting Welcome to call me back apparantly Kieran Scothern is in a meeting.
  13. Hi soli2006 It is interesting that once I send my request in the SAR and only got a basic charge list back until I requested a refund. Then my branch manager sat down and wrote what every transaction was for. This is where they went wrong it says there was charges for none collection via debit card (£5) but unknow to him I have every bank statement and a diary of the dates the debit card payment was to come off and did come of so they are basically lying when they said the DD card failed. I have it in black and white that it did not. I am keeping this one to myself until Kieran Scothern comes back to me or when I file my N1 form. I missed the court on Friday. Roll on next wednesday.

Dear Mr Scothern, I am in receipt of your letter dated 21.12.06 and note its contents. As regard to paragraph relying on OT and charges are only directed to credit cards and banks. If you check with your legal department you will find this is not the case. As a gesture of goodwill I have held back the N1 form until the 29.12.06 to give you time to reflect on this. I will also be making a complaint to FLA Finance and Leasing Association. The address is Imperial House, 15-19 Kingsway, London WC2B 6UN. website www.fla.org.uk which you are members off. . Below is a letter which was hand delivered to your Falkirk branch on 21.12.06 and I am awaiting a reply I am in receipt of your letter of 18th December and note the contents. I will accept the sum offered of £70.00 only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. I am of the opinion the law is clear on liquidated damages. Regardless of any agreement that I may have signed, the payment of excessive damages will be interpreted as a penalty and therefore the charges you imposed will be unenforceable and should I be forced to litigate, judgment granted in my favour. The fact that your fees do not differ significantly from those charged by other companies operating within the Financial Services industry is entirely redundant. Charges are not legally enforceable if they are penalties. Penalty clauses in contracts in English (and Scottish) law for breach of contract are not legal if the penalty exceeds the actual cost of the breach of either party. The law relating to penalties has been established through case law. The cases date back to the nineteenth century and the courts have been consistent in the way that they have ruled on penalty clauses I will not correspond further with you on this matter and my next communication, should I not receive full payment, will be with your legal department.   16. Hi everyone Just had a reply from Welcome Finance it has come from Kieran Scothern , Compliance Officer in Nottingham. It goes like I have investigated the issues you have raised and can respond as follows. Fees applied to your account are in line with our standard charges for collecting overdue payments. This is provided for contractually in terms of the agreement signed, and our stanard rate of charges is supplied to customers on taking out their agreement. We do not believe that out charges placed on an overdue debtor are either disproportionate or unreasonable. We note your reliance on Office of Fair Trading (OFT) guidance is in relation to credit card, bank overdraft, store card and mortgage default charges and NOT tjose of a regulated secure loan. The guidance involved the OFT insisting some of the credit card companies reduce their charges to £12. Given that we only charged £5 for each letter and telephone call we are obliged to make, we cannot agree that these charges are disproportionately high. (No mention of why they have charged £20 for a direct debit returned) We do not accept your assertion that out charges could be interpreted as penalties. Mr Richard Middleton has offered to pay you, as a gesture of goodwill, the amount of £70.00 in full and final settlement of this matter. This offer is open and capable of acceptance fro 14 days from the date you receive this letter. If this is not acceptable please return the cheque to me at the above address. I can confirm we will defend any forthcoming claim vigorously, and will seek to recover any potential legal costs. _______________________ I am due to file my N1 form tomorrow do I go ahead and has anyone else had a reply. thanks sandra We do
  17. Hi everyone Just received a letter from Welcome this morning with a cheque for £70.00 so they will be getting the letter thanks but only as part payment letter. On the original paperwork they sent me all the said was fee's with the value next to it. Now I have a more detailed list of all the charges. A letter, refused debit card payment or phone call costs us £5.00 an unpaid direct debit is £20.00. I will keep you updated as N1 form to be filed at court on 27.12.06 if rest is not paid.
  18. Hi Jude6521 , My local branch of welcome had a lot of decent people just doing their job there was only one snotty person who was rather rude. She has now gone but I would have had great satisfaction directing all this at her but we cannot have everything we want. My question if you do not mind is I have only 7 days left before I take court action and was told by new branch manager he would sent a letter explaining he was only willing to refund £70 of the amount being reclaimed but his area manager needed to approve this. This was over 10 days ago. I have also emailed all documentation to www.cad@cattles.co.uk but have had no reply from their either. Do you think they will wait until I action the N1 form at the court before I hear from them. thanks Sandra
  19. On my loan agreement forms there is a mortgage indemity fee for £1100 as well but this is what they charged me on a secure loan of £10K. On the final settlement letter is says disbursal of fees.

Hi I was under the impression that you could only claim charges as you accepted the interest rate on signing the documents but on saying that I have just found my original agreement and it says nothing about PPI and on my settlement report it has PPI 2496.00 which I will be claiming for next when I have finished with them on the charges and early redemption.

Hi just giving an update on Welcome, called them this morning as I have not received my letter after them investigating my complaint and they have agreed to refund £70 charges, what I am looking for is charges, plus redemption which total £2510 plus interested. Guy I spoke to is supposed to be new manager for branch but he has had to esculate the complaint to his area manager and will need to get back to us. Advised he has now 7 days left before court proceedings. getting excited as they asked who was calling and I said my official title Mrs and they replied Sandra (so they know who I am and what I am calling about) they transferred me to office manager without all the usual questions he stuttered all the way through the call. keep you posted.
  22. Sorry Just realised forgot to ask welcome what the collection fees (£535) were for on the cumsumer credit act 1974 settlement statement. I also had to pay their solicitors £75.00 VAT £13.13 Land register £22.00 to discharge procedure? All their extras soon add up
  23. Hello, just a quick update welcome have until Monday befre LBA letter goes in. I have just been reading 2004 No. 1483 CONSUMER CREDIT The Consumer Credit (Early Settlement) Regulations 2004. Any one good at calculations there is a sample in here about calculating early repayments and I would like to know if welcome applied it to my account. I will put my details at the end if you can understand the forumula. (thanks) Example 2 - longer term, high value loan A loan of £10,000 is repayable by 180 monthly instalments of £139.51 starting one month after the relevant date. The monthly repayments include interest and all other charges included in the total charge for credit. Thus total amount repayable = £139.51 x 180 = £25,111.80. The total charge for credit = £25,111.80 - £10,000 = £15,111.80. The creditor receives notice from the borrower requesting early settlement immediately after payment of the 72nd instalment (i.e. after six years). Assuming that no charges are excluded from the calculation of the rebate under regulation 3(2), the APR on the loan required for the calculation of the rebate is 16% per annum. The creditor opts to calculate the rebate using periods of one month, giving a period rate equivalent of the APR = (1.16(1⁄12) - 1) x 100 = 1.2445% per month. The creditor also opts to defer the settlement date for 30 days under regulation 6, so that the settlement date for the purposes of calculating the rebate is the 28th day after the payment date of the 73rd instalment. Hence, for the purposes of the formula in regulation 4(1) - A1 = 10,000 B1 = 139.51 = B2 = . . . . = B180 r = 1.2445/100 = 0.012445 m = 1 n = 73 a1 = 73 (working in periods of 1 month) b1 = 72 b2 = 71 b3 = 70 : b71 = 1 b72 = 0 Then the loan outstanding to be repaid immediately after payment of the 73rd instalment as calculated by the formula in regulation 4(1) is - 10,000 x (1.012445)73 - (139.51 x 1.01244572 + 139.51 x 1.01244571 + . . . . + 139.51 x 1.0124451 + 139.51 x 1.0124450) = 24,363.72 - (339.90 + 335.72 + . . . . + 141.25 + 139.51) = 24,666.93 - 16,441.81 = £8,225.12 The amount outstanding at the settlement date is then - £8,225.12 x 1.012445(28⁄30) = £8,320.62 (assuming that the period between the 72nd and 73rd instalments is 30 days or the creditor has opted for an additional deferment period of 30 days ). The debtor will also have to pay the instalment due between the date of request for early repayment and the settlement date assumed for calculating the rebate (i.e. the 73rd repayment of £139.51). Hence the total amount to be paid at the settlement date (which is 28 days after the date of request for early repayment) is £8,460.13. N.B. If the period between the 72nd and 73rd instalments were not 30 days, the amount outstanding would be slightly different.) For this example, the rebate is £6,606.95; this is calculated by deducting the early settlement figure of £8,320.62 from the total payments outstanding after the date assumed for calculating the rebate which is £14,927.57 (= 107 x £139.51) ****************** Type of agreement - secured loan (10,000) standard settlement, Total amount repayable at start of loan £33518.40 rebate of acceptances fee and credit chages (£450.11) rebate of payment protection insurance premium (£59.93) collection fees £535.00 DEFAULT INTEREST / (INTEREST REVERSAL) (£5117.73) interest to settlement £191.02 Less amount you have paid (£10,978.96) settlement figure to pay £17,637.68 Intotal I have paid them back £28616.65 for a £10,000 in 4 years I think the spreadsheet refers to the default interest / (interest reversal) but I am not sure.   24. Has anyone had finance charges put onto their capital one account but never received letters or statements. I have just received my statements from 2000 (8 for 2000 and then nothing for 01,02,03) then 05 and 06. On statements for 2000 there is 5 months with late payment charges of £20 but ther is also Finance charges from £54 to £277 per month. Asked Capital one what they were for but still awaiting reply. Can I claim these back as well? thanks sandra
  25. Hi everyone. Got a phone call from Welcome this afternoon. New branch manager but for some one in charge he was a bit nervous sounding. Said that he has received my letter with 14 days notice to comply but is struggling as he needs to go through the charges one at a time and analysis these? My total claim is for £1440 penalty for paying loan of early plus £535 for calls and fees? According to his calculation there is only excess fee's on my account which total £70 which he will refund if he gets permission. Told him that on my letter I stated that I wanted all correspondance by mail or email so I have written proof for future court proceedings if they do not pay up in full and he only has 3 days left. (I think he fell of his seat as the phone went silent for ages). I had to ask if he was still there. He said he will put his findings in writing within 2 days so will wait patiently
