  1. Cheers bandonbhoy interesting reply. Before I found this site I felt sure that if I reported the BOS branch to their HO I would get some kind of investigation and settlement as it seemed clear to me that they had mis-managed the account through credit levels and charges. I don't think that as much now but their must be people within the banks that feel that some of the accounts and branches are being mis-managed and they have been using peoples financial problems to inflate their profits.

Smoorach there seems to be different views on this matter of splitting up the claim but I think that most of the advice on this site seems to suggest that this is the best way or at least the most common way to pursue the claim. I have considered raising the stakes and going for the lot in one go but that involves lawyers and highier costs. I haven't closed my mind to the idea but i still find that way a bit scary. What are the views of the CAG members?
  4. Thanks Smoorach I live in Scotland. I have only asked for them to repay the full amount at this stage. When it comes to making a court claim I will break the claim into sections to meet the courts limits. I will post the rejection letter today thanks again.
  5. I have listed this in the general section I thought I better also list it here Firstly I would like to thank everyone who has helped get me to this stage. I have started a new thread as I asked too many dumb questions on the last one. The story so far……….. S.A.R sent 05/09/06 – Reply received 20/10/06 Charges are as follows: 2000 2001 2002 2003 2004 2005 2006 Total £1620 £380 £740 £131 £2064 £639 £1430 £7004 Request for repayment of charges posted 01/11/06 requested full repayment of £7004 in charges – reply received 06/11/06 Standard letter received stating “I am sorry to learn that you are unhappy with charges applied to your account. We’re keen to deal with your concerns as quick as possible. A customer relations manager will investigate the points you have raised and you will receive a reply shortly, but no later than 4 weeks” I then against my better judgement waited. Received a letter 29/11/06 saying that they were sorry that I had not had a full response to my concerns. We are still investigating your complaint, and you will receive a response from us as soon as possible, but certainly no latter than 3rd January 2006. Sent letter before action requesting full repayment of £7004 04/12/06 The day after posting the letter I received a conclusion to the investigation dated 01/12/06. The letter when through the standard bank charges are fair bumf before this paragragh that stated “ as a gesture of good will I would like to offer you £1620 in full and final settlement of your complaint. I must stress that future charges will stand and we reserve the right to close your account if you do not manage it correctly. To accept this offer please sign and return the enclosed acceptance form in the pre-paid envelope. You requested information on how we calculate our cost for dealing for dealing with these transactions. Please note that we are not obliged under the data protection act to supply this information, and as it is commercially sensitive, I regret to inform you that I am unable to comply with your request.” The acceptance form states I confirm that I accept the offer of £1620 from Bank of Scotland in full and final settlement of my complaint regarding bank charges made on my bank of Scotland accounts. The word accounts used at the end worried me as I am also working on charges on a BOS credit card and BOS preference account. This acceptance seems to suggest that if I was of a mind to accept (which I am not)I would then not be able to claim from any other BOS accounts I have no intention of accepting this offer anyway as it falls way short of the total charges. I would like some advise on how to proceed as I have already sent the letter before action prior to receiving this offer.

  7. I'm now at the letter before action stage could you please help me with a few points before I post it. 1. The claim is from dec 99 to oct 06 and totals £7004. 2. As yet I have not added any interest to this claim, is this right as I have read various threads that say I should have stated the interest by now yet the advice I recieved at the start said no interest until court action. 3. The letter before action has a section on default notice but I have not had any information to say that they have place one, should I have had that from the responce to the first claim letter. I would be greatful of your assistance as the more threads I read the more confused I get and I really want to ensure that we have a solid case before we go to court.
  8. I recieved a reply from the BOS on the 6th November. The letter states that they have a customer service manager who will investigate the points that I have raised and that I will recieve a reply within 4 weeks. Should I still follow our schedule of 14 days or wait and find out the outcome of thier investigation before proceeding? Sorry I havent posted this sooner but I have just returned from a family holiday. Thanks..........
  9. Started Claim 30 October 2006 against BOS card sevices for £462 without interest. I will keep you posted on the progress thanks for your assistance.
  10. Started 1st stage 30th Oct by posted refund letter for 2002 total £740 without interest. I will keep you all posted on how the claim goes. I sure that the banks now have a policy in place and deal with these to a set plan so maybe there will be no surprizes in my claim and it will follow the usual routine.

  13. Thanks for the support. Sorry if this is still me being dumb but i'm just trying to make sure i get things right before I start. Do I send my claim for the total 5 year period or do I have to do it in £750 blocks? Is there any way to claim the 6 year period? What is the proceedure to claim outside the small claims court or is this too scary an option?
  14. I've Just recieved my Wife's Account charges from the BOS and they are not good reading. I requested the last 6 years and they are as follows 2000 = £1620, 2001 = £380, 2002 = £740,2003 = £131, 2004 = £2064, 2005 = £639, 2006 = £1430, Total for 6 years is £7,004. This is a scary amount:!:. We live in Scotland and is it the case that we can only claim 5 years under scottish law:confused: If we only claim for the last 5 year then we fall below the £5,000 mark but does this figure matter in scotland and what would be the implications for us to consider before proceeding. We are concerned about cost of court action and which court this claim would come under. I would be greatful of your advice on how best to pursue our claim. I mentioned going on watchdog but she is not kean and still embarrassed about mess her finances are in. Many Thanks

  16. My first action against the banks is about ready for posting. The story so far....... Posted Charges Request against BOS Credit Cards 05/09/06. Recieved statements of charges 20/10/06. Charges period 17/06/02 to 22/08/06 total charges = £462.00. Sorry if any of the following questions are dumb but I want to make sure that I follow the right proceedures. Should I claim this total plus the 8% interest set up on the simple spreadsheet or keep it to the charges only. Is the Request refund doc letter the correct one to use for the first request of a refund or is there one for credit card charges as the only one I found is for the second and final letter before court action. Look fordward to your help.
  17. Thanks, I'll check over the history of the charges to see if they are only charged when the account was overdrawn. Just checked statements and the account was always in overdraft before the Account Maintenance was applied. I will add this to the charges that I am claiming back and see what happens. Thanks for your help.
  18. Hi, Just recieved my list of charges from my Wife's BOS bank account and there are monthly charges of £15 listed as account maintenance charge 2000-04:confused:. Could anyone please let me know what this is and if this is a charge that I can claim back. Sorry if this is a dumb question but I have never came accross this charge before.
