    Ok folks bit of advice for me please. I have worked out how much I claim on the spreadsheet from this site. I have setup a new bank account with a different bank. I have filled in my details on the on prelimenary approach for payment letter and I am ready to send by recorded delivery. Do I have all the bases covered to begin??

    thanks that makes sense. i wasn't going to add the interest the same as you because it's only a couple of pounds here and there, but i read that the bank will know you don't know what you are doing if you don't add it.

    Thanks. So I should just send the spreadsheet without the 8%. But on the prelimenary letter... do i state the total and the interest ( the interest being the 8%?) Sorry if I am being totally stupid.

    I have completed my summary of charges sheet but not included my personal details. Is this what I should send with my premlimenary letter? or should it be this without the 8%. I now understand that the regime of fees which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent consumer regulations. If you say that they are not, then will you please demonstrate this by letting me have a full breakdown of the costs to which you have been put by as a result of my breaches, in order to reassure me that your penalties really do reflect your costs. Additionally, it has now been confirmed that your particularly high level of penalties are considered to be unfair per se by the OFT who reported on the 5th April 2006 and are therefore presumed to be unlawful in the absence of specific proof to the contrary. Your responsibilities I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. I consider that your repeated representations that your charges are fair and reasonable are deceptive and that they have deceived me into agreeing to pay them. Your concealment of the true nature of your charges has prevented me from asserting my right until now. What I require I calculate that you have taken £2252.50. I enclose a schedule of the charges which I am claiming with this letter My targets to resolve this matter I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets. I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment. If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.   10. I have calculated my charges over the past 6 years, just where it has said total charges on my statement, I am amazed it came to £2252.50. Do i need to calculate anything else? I am not sure what I need to read up on and what I have to send. I am keen to claim this back but do not want to mess it up.
  11. Can you claim unfair bank charges when the bank charges occurred because you went past your overdraft limit?

    Thanks Phoenix and kazzy77 you have answered my first question. Now as I have no idea of the total amount of charges i have paid over the last 6 years, but i am sure it must be well over £1000. I believe I need to ask them for a total of my charges. Is there anything I should be aware of before doing so?

    Firstly brilliant site. I heard about this on another forum from a girl who Won. I must have lots and lots of overdraft charges, only 2 days ago I received on for £50. I am seriously considering going through the motions but as i have only just found this site, I have a lot of homework to do. My first question for anyone who can help is this. I have a loan with HSBC and I am concerned about what would happen if they wanted to close my account. Any help appreciated. Cheers Rick
