  1. Just had a refund of PPI on a Halifax loan:) They refunded PPI plus interest paid on premiums plus interest at 8%. It was reduced from the outstanding balance of the loan leaving a small amount to pay off which I will be settling at the end of the month:D. I sent first letter in April asking for refund, then after 3 months of them sending letters saying they are looking into it, I received a letter saying they were in the right but as a valued customer they were prepared to put me in a position had I not taken out the PPI.   2. Typical:rolleyes:, I wish they would issue some staff training so they actually knew what they were doing. Well I have had the PPI removed from the balance of the loan and have also managed to arrange a settlement on the remaining balance. They have knocked a further 25% off so that shall be fully paid off at the end of the month when Hubby gets paid. I am sooo pleased to see the back of that:-D

    Sent acceptance letter a couple of weeks ago and I have just checked online and they have removed all the charges plus 8% interest off the balance of the card. So thats another victory over Egg . I have also had PPI removed off my Halifax loan so a very successful week all round I say .
  4. Yeah, they are reducing the overdraft by £50 per month until it is paid off. Not the most ideal situation but at least it is better than being took off in one go. They did remove the £35 pound charge though.

I really hope your mediation appointment goes well with them Bathgatebuyer, keeping everything crossed They are apparently in a receptive mood at the moment cos I've just received my offer off them. It came to less than what I worked out but I didnt have a clue how to work it out so my calculations may have been wrong. They said on the letter: The calculation considers the number of premiums you paid towards the PPI, plus interest that you have paid on these premiums, plus additional interest at 8%. In addition, we will reduce your outstanding balance by the remaining amount of PPI on your loan. The total refund came to just under £3000. That will leave a small amount left on the loan but I am not complaining, it will get paid off a lot quicker now. Thanks for everyones help on this, I am a lot wiser now when it comes to taking out insurance policies.
  6. Thanks Bathgatebuyer, Letter was sent recorded delivery today so lets see if that nudges them on a bit. Thay obviously thought I would shut up and go away, not likely.
  7. Any advice on the above letter cos there has still been no reply and it has been nearly a month now, I really want to get it sent off as soon as possible. Thanks;) Penny.

LOL I am going to send them a quick reminder, how does this sound: Thank you for your letter dated 30th July 2008 in which you stated you would contact me shortly with details of the redress which is due to me. To date, I have not received a further response from you with regards to this matter so I am writing again to request a full refund of the premiums and subsequent interest I have paid on these premiums. If I have not heard from you within 14 days I shall be taking my complaint to the Financial Ombudsman. I dont want to sound too pushy cos they have already said they will give me a refund but it is taking sooo long:evil:

These people are unbelievable:rolleyes: I received a letter dated 15/08/08 which says: We refer to your recent request for a copy of the original credit agreement in respect of the Consumer Credit Act 1974. After liaising with our client in an effort to obtain this document we have been advised that it is no longer available. Under the circumstances, we have closed our files in relation to this account which has now been returned to our client. We can confirm that no further contact will be made by us regarding this account. We trust that the above clarifies matters for you. Now are they sure about this because I received the same identical letter off them in July last year and here we are again. I shall put it in the file and wait and see how long it is before they start the process all over again. Penny
  10. They still havent sent a letter with an offer, its been over 3 weeks now!!! They must have forgotten about me.
  11. Still waiting.... I am very tempted to ring them, although it would be better to send a letter but cant think of what to write. Could I send a letter thanking them for their reply but reminding them the length of time it is taking to resolve this matter. I sent my prelim in April:eek: The main problem is I am struggling to keep up the payments and they owe me more than I owe them.

    Well, they are really starting to dig their heels in. I have had a reply off them saying they will not refund interest at a higher rate than the statutory rate of 8%, and they say if I went to the FOS or the OFT they would recommend 8% as a level of interest to be credited. Also they said they will not offer any further amounts and this is their full and final settlement. As their offer is to be taken off the balance of the card I am considering accepting this, mainly because I have numerous other things going on at the moment. I will have to have a think about it.
  13. I am still waiting for the halifax to get back to me with an offer. It's been 2 weeks since their last letter, how long does it take to work out what they owe me?? Should I send a letter acknowledging their last reply and trying to nudge them on a bit or just wait? They seem to be stalling things. I am sooo impatient...
  14. I have received a reply to my LBA, but not a good one. They say their offer of £45 is their full and final decision so it looks like I will be filing a court claim.

    Needless to say I rejected their paltry offer of £24 and they sent another offer of the full charges but only 8% interest which brings it to about £150 less than what I am claiming. They also said they will only take it off the balance of the card which I expected them to say anyway. So today I have sent my LBA, also rejecting that offer, in a last attempt to get the full interest out of them, if not then its off to court. penny:)

I am still waiting for their letter with an offer, hopefully it will be for the full amount I worked out but I shall have to wait and see. There is still an amount outstanding on the loan as I got behind in payments, so this should pay it off with hopefully a little bit extra:) Good luck with your court case Bathgatebuyer, I'm keeping my fingers crossed for you.   18. I have finally received a response to my claim from the Halifax. They went on and on about how they are right and they have no reason to believe that I was not provided with the relevant information at the point of sale to enable me to make an informed choice about the policy. Then they go on to say: However, as a valued customer we are prepared to put you back in the position you would have been in had you not taken the insurance. This is done without addmision of liability and in full and final settlement of your complaint about PPI on your loan. I will contact you again shortly to confirm the exact details of the redress which is due to you. That letter was dated 30/7/08 and I havent had a letter since but it sounds like they will send me an offer, hopefully it will be for the full amount plus interest but I will just have to wait and see. I will reply with any news when I get the next letter. Penny
  19. I've received another letter dated 28/7/08. They say: Following your recent request to be provided with a copy of the original credit agreement in respect of the Consumer Credit Act I can confirm our client has yet to furnish us with your agreement (what a surprise:rolleyes:). I can confirm however Creation Financial Services Limited are still in the process of retrieving the required paperwork and once this has been forwarded onto us a copy will be posted to you. There will be no further correspondence from us until the agreement has been received at which point we will require payment in full. You currently still have the option to pay £xxx as a full and final settlement in order to bring this matter to a close, after which we reserve the right to proceed to collect the full balance. If you want to take the offer and bring the matter to a close then please call the number below. A couple of points, they say recent request, I requested it over a year ago so I dont call that recent, do you? Also in their last letter they said the reduced settlemant offer only lasted till the 23rd July and now they are saying I can still have it. Me thinks they are not expecting to receive this agreement any time soon.
  20. Hi Charliegirl, Did you send the letter recorded delivery as Lefty advised or was it just normal first class? If it was just sent first class then that would be easier for Brighthouse to deny receiving your letter.
  21. Absolutely spot on ODC, how do you do it??? Today I received a letter saying that their client has requested that my credit aggreement be retrieved from archive, well they'll have to dig pretty deep cos theyve already told me they havent got one. Oh and "In an attempt to resolve this matter in an amicable way" they would like to offer me a settlement. Er nothing to do with the fact that they know there is no aggrement then?? And as you said ODC the settlement is less than half the balance they say is outstanding. The only snag is I have to pay it by the 23rd July and seeing as its now the 24th and I only received the letter today I have missed the deadline, what a shame:rolleyes:
  22. I have only sent the SAR and prelim letter asking for repayment of PPI payments so far, both were sent recorded delivery and signed for. They have replied to my prelim three times and said they were looking in to it, they seem to send a letter every four weeks saying sorry for the delay but they are still investigating my complaint:evil: How long does it take??? Have you any idea what I should put in the letter, I have been trying to write one since yesterday but I am not very good at it:oops: Thanks Penny:)

I am about to compose a letter to send to the Halifax as you suggested giving them a timescale to respond by as they still haven't replied:eek: Do I just adapt an LBA letter or is there a specific letter I could send? I think they are just going to ignore me thinking I will go away. No chance!!!!

    Well, the winning template letter wasnt so lucky for me. I received a reply off them by letter offering me just £24.00, which is the difference between the £16.00 and £20.00 charges, which is a lot less than what my claim is for. Point 2 of their letter says: You allege that these charges are a penalty. You have put forward no evidence to support this allegation and we do not accept it. As explained in our previous letter, the charges set out in the Agreement are a genuine pre-estimate of the loss caused to Egg when a customer breaks the terms of their Agreement. and later on in the letter they say: Should you break the terms of this Agreement again, a charge of £16.00 will be applied to your account. If you consider this to be unfair, you should close your account now. The continued use of your account will be treated as confirmation that you accept that our charges are fair. So, this would be the account that they have already closed earlier this year:confused: Do they not remember that. They really are unbelievable:mad: Should I just continue with the LBA or is there a witty response I could reply with? Oh and they have also sent a part that I have to sign and return saying I accept £24.00 as full and final settlement of my complaint.
