  1. Hi Jonni2bad. Happy new year to you! Just have an update today. Recieved a letter from 3 customer services. Dear Mr Contract upgrade clarification. Were writing in response to your letter highlighting the facts and concerns abou the upgrade offer. Its regrettable to know that youre unhappy in regards to upgrade offer given to you. Weve tried to call but were unable to reach you. I confirm that you called in to pay your bill and cancel the contract on 19th october 2007. We then offered you an upgrade deal which you accepted. As a part of the upgrade offer we offered you the price plan talk and text 200 with £5.00 loyalty discount for eighteen months term. This price plan comprises of 100 inclusive voice minuets and 100 inclusive texts. The handset offered to you is sony ericsson k800i. In accordance with the offere provided above the monthly line rental for the price plan is £20.00. However after deducting £5.00 discount the monthly commitment is £15.00. I confirm that the line rental of £15.00 is applicable for all the 18 months. The credit back offer provided was £234.00. I'd like to clarify that instead of creditting your account with the above credit £234.00 unfortunatley a debit charge for the same amount was applied. As a result your bill dated 11th december 2007 reflects the balance of £276.18. I apologise for the error caused and assure that weve rectified it and the credit of the above amount has been applied back on your account on 12 december 2007. This will reflect on your next bill. The above alloted credit will be adjusted against your future bills which is as below. The total monthly line rentals will be (£15.00 x 18 months =£270.00). As per calculation your monthly bills will be adjusted against the above credit. Youll then have to pay £36.00 which is the balance after deducting the credit as follows (£270.00-£234.00= £36). This remaining balance of £36.00 will be spread across your last three bills. Please note that we have a 14 day return period for upgrades. Therfore unfortunately were unable to reverse the upgrade. Your contract is due to expire on 9 may 2009. As explained to you by one of my colleagues if you wish to cancel an early termination fee of £324.60 will be applicable. Im sorry but the handset has been sent to you as a part of the upgrade offer therefore were unable to arrange for a pre-paid bag for the mobile. Im sorry if you feel the information provided to you was incorrect. However i assure that we do value your custom and loyalty and dont want to see you go and recommend you to use the services. Yours sincerely 3 customer services. Now what do you think about this? Im tottally unsure what they now mean. Are they now saying the term will only cost me £36. Its the first time i have heard of a credit back offer of £234.00, wheres that come from? Are they now saying I dont pay anything untill the last three months when the £36 will be spread? To be honest its still not what they offered me over the phone as you know. It was £15 to pay at the end of the term (18months) I know its only another £21 but its the principal. And in anycase, ive not used the mobile since the dispute which as been ongoing since November since i recieved the first bill. In a way I have also lost weeks without having a mobile which means loss of contract time. Should i suggest that I should have a extra month due to the loss? Why would i now want to pay a termination fee of £324.60 when they are now saying I only have to pay £36?? Does not make sense, thats if I have read the letter correctly.   2. Hi Jonni2bad, Just wrote two letters and sent them off today saying once again saying I formally dispute the debt and the contract. One letter as suggested was sent to Three company and the other to the debt agency. I will keep the site informed of any update, once again many thanks. Have a happy new year!! Kind regards, Stephen

  4. Hi, Just received a letter this morning from a debt collection services. Saying that my details have been passed onto them by 3 who have asked them to recover the debt of £22.89. They also say I can be charged for the remaining balance of the contract should I not respond to this request. In bold they also say Act now to avoid potential legal action and costs. To call the immediately to discuss a solution with one of their experts. They go on to say failure to do so will result in the account being defaulted, details being shared with credit reference agencies and further costs being added to the account. That Iam liable for the full balance of charges on the account. I have no intention in paying as Ive said in previous posts and want them to take court action so a judge can decide. What again i want to know is, what powers and potential outcome can come from this debt agency? Can they inforce anything without first taking me to court and I get a chance to have my say? If a judge decides in their favour after listening to me then fine, I abide by the law and even if I disagreed with a judges action I would then pay. As long as I get a chance to put my views across. As long as I know the debt agency cant really proceed with anything without legal court action then thats fine. As Jonni2bad as said threatning letters to get people to pay, im expecting this and can take it. Any advice to how to proceed will be much appreciated. I have sent a letter to head company at 3 and told them I have No intention to pay anyting as they have misled me..mistake on there part should not mean I have to pay for it.   5. Just had a letter from 3. Saying my last bill is overdue etc etc. And if I do not pay they will send my account to a debt recovery agency. They have said the agency will recover the debt and addittional charges. Jonni2bad do I need to fear them or are 3 using tactics in order to get what they want. Also for any decision to be made from their point of view, can they retrieve any money without going to court and if thats the case do I have a right to be in court? Many thanks for your advice.   7. Reasurring Jonni2bad, thanks for this. Iam prepared for them to take me to court and if the judge orders im in the wrong then so be it, but I would be disappointed about the legal systom in not supporting whats right having said that. I will not pay them what was not agreed, and everytime i get a bill i will send a letter saying why not and keep a copy. Building up my eveidance that may support me at a later date. I will keep this board updated on the progress and outcome. But once again you guys many thanks. This is going to be one hell of a ride I think. But I will try and not get to stressed. The ball will always be in their court and ill make sure they have to make the next move etc. Take care, stephen
  8. Thanks Jonni2bad, I appreciate the reply, I have written to them and have a copy of the letter. This was sent along with the mobile recorded delivery. I recieved the mobile back a few days later with no reply to the letter that i sent. i rang them and they said I still needed to pay the full amount. After telling them NO! I decided to hold onto the mobile and wrote a second letter saying im keeping it here safe until they send a pre paid envelope (as Im not prepared to send it out a second and 3rd time at my expense). I also told then I will not pay any bills due to being misled. I had the new mobile (upgrade) after paying in full my old contract (october £6 for 12 months, which was £22 due to going over my calls during the 12 months). I recived this new mobile a few days after and was led to beilieve i would only recieve a bill at the end of the term (18months as previous). Until after 3/4 weeks I recieved a bill for the first month. I rang 3 straight away to inform them of their error, but they denied that they do contarcts like what ive described and their must have been a misunderstanding ( I said yes on your part!). Anyway after a long discussion and 3 people later I got no where. Thats when I decided to send the mobile back with a letter. Ive never been behind with my bill and have been a customer for many years, this is what im banking on in the end. Because ive told them to take me to court and will let a judge decide. Now i wait in reply to the second letter i sent them which they would have got on tuesday this week gone, so far no reply. One question Jonni or anyone else please, If i do not pay and ignore the bills can they send a baliff to my house etc. Ive already told them not to send me bills as I dont reconise the contract etc. I will not pay and im wondering what rights do I have and what in the worse senario can i expect. I want them to take me to court so a judge can decide once i put to him/her my case showing all my letters etc etc. What can i expect guys? All your support and encouragment is much appreciated.   9. Jonni2bad, Sounds very similiar, I had no cash back mind and did not pay anything until the last month like you. I then really beilieved I was getting a similiar deal as i told them to cancel my account now that it ended. They gave me this deal to keep me on 18 months for £15 and a upgrade of phone. Im right I know iam and that is why I cant allow them to cheat me. I got the advisor to confirm verbally over the phone and it was confirmed that i would only have to pay at the end of the 18months. I need advice and support to get through this and thats why I came on here. Take care and thanks for your reply, when i questioned the manager during this debate he told me i was wrong (in so many words) because they dont do this kind of deal!!! I told him my last years contract was this type of deal he didnt think his company provided. stephen
  10. Buzby many thanks, what action could happen when i refuse to pay any bills? Ive told them the mobile will stay in its box and is waiting for them to pick up. And that i do not recognise their misleading me. In the end can they enter my home through baliffs? I have also told them they can take me to court, and let a judge sort it out. Take care stephen
  11. I still have my last bill for the period of oct 2006-oct 2007. It was then i rang to pay by visa card. They then offered me a upgrade on my mobile (new handset) and over the phone a new contract of 18 months for £15. I know it sounds strange, compared that with my last contract and you can see why I thought it ok. I even confirmed with them that a one off payment at the end of the term was correct. 2006-2007 12month for £6 2007-2008 18 month for £15. The way i saw it was for and extra 6 month contract its an extra £9. So really the first deal was better 2006-2007 for £6. During the 2006-2007 contract the bills i got each month stated I was in credit and I payed nothing, then each month the credit became less until the last bill up to oct 07 a payment of £26 was issued. friend, will they have my conversation recorded? Because I would want to listen to it as my prove. My upgrade also was at no extra cost, i confirmed over the phone that they were sending me an upgrade and i would not recieve any bills until the last month, 18 months time. Take care stephen
  12. No nothing..but please remember the previous year contract 2006-2007 they gave me a similiar contarct. 12 month contarct 100 mins 100 txts for £6. The bill to payed at the end of the term (12 months) I paid this in october 2007 in total £22 because during the year i used the phone a bit more. But this was a 12 month contract for only £6. I saw no reason why a 18 month contract for £15 to be any different, its nearly equivalent to the previous deal. Take care and thanks, stephen
  13. Pleae help im so angry about this I know what was said. I would not have said yes to the new contract with the advisor told me i would be charged £15 per month. Guys I do appreciate all the help and advise. Having a bad credit rating will not bother me as long as truth wins in the end. Its the principal that counts. But i fell its their word against mine, and i guess from what your saying i have not got a chance. many thanks, stephen
  14. Buzby thanks for your reply, Im 42 and a nurse! Your right about the language as ive encountered many problems with communication. Anyway the term as far as im concerned was after the 18 months. I asked the advisor before agreeing with the new contract if I would be charge monthly ans the advisor said No I would recieve a bill at the end of the 18months. I did not want a monthly contract as previous year and they came up with this special deal. My last contarct was for 12months and £6. Unbeilevable really but true. I was led to believeing my new contract would be for 18 months and only £15. Would they keep voice recording of that conversation? Thanks stephen
  15. Would this letter be adaquate foe 3 company also? Who have mislead me on the phone about price plan etc. Also do they keep phone recordings so I can have this as prove of conversation? Many thanks stephen
