  2. Sorry it's been so long since I've posted but my PC has been on the blink! Typical! All my bank letters etc were stored on my PC so had no access to them for court action (who's the dafty that didn't print them or save them to disk?!) Got an offer of 298 in November which I accepted as part payment only and advised I was still seeking the full amount. Got a letter back basically advising I was getting nothing then! My next stage is court action, but have I left it too late since my LBA? Should I send another LBA or is it still OK to proceed to court stage? Thanks for your help,
  3. Phone call from Halifax Customer Services today, despite stating in prelim letter that I did not want to be contacted by phone, only letter! He phoned to advise me that the OFT ruling only applied to credit cards & not bank accounts yet, but I was not being drawn into a debate with him! He also said that I would be made an offer but not the full amount. I advised that I would be pursuing my claim for the full amount so he took the hint and said that there was no point in discussing it then! That's right! He said an offer would be made to me by letter, I didn't even bother asking how much it was for. Still not posted LBA (very busy with baby), will do so this afternoon. Keep you all posted, ;-)
  4. Received most info from Halifax yesterday, rest today. Total charges for 1st a/c: £284 Total charges for 2nd a/c: £476 Total: £760 (just typical, £10 over limit!) Dropped first charge from 2nd a/c so total charges now £740. Not as much as I'd hoped! I thought I'd been much more badly behaved!! Anyway, it's all going to help clear my £900 O/D so hopefully with interest & court costs it should. Prelim letter going to be prepared today, will send recorded delivery on Monday. Will keep you posted,
  5. :idea: My claims are for 2 different Halifax a/cs. Do I claim both sets of charges back at the same time or is it better to do one after the other? Cheers,
  6. Just off the phone to a very friendly guy in the Data Protection Team who is going to get statements issued. He said I should receive them tomorrow, Monday at the very latest and if not I've to phone back & speak to him. He said there were system probs with the statements requested in July/Aug & only some were getting sent out. Let's see what happens between now & Mon - will keep you posted! PS Thanks again TD

Just on my way to the Post Office with this letter: Data Protection Team Halifax plc Trinity Road HALIFAX HX1 2RG 11th October 2006 LETTER BEFORE ACTION Section 7 – Data Protection Act 1998 Dear Sir/Madam Accounts: xxxxx & xxxxx You have failed to comply with my Data Protection Act Subject Access Request dated 29th August 2006. I was advised in a letter from N J Inett dated 29th September that copies of statements had ‘been ordered and would be sent under separate cover’. I phoned the Call Centre on 9th October (40 days after my initial Subject Access Request) only to be advised that there were no notes on either of the above accounts so it did not appear that any copy statements had been ordered. I was told that it would be another 15 days before I was in receipt of these if he placed the order. This is unacceptable. If you do not comply within the next 7 days I will have no choice but to seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice. Yours faithfully Me Will post recorded delivery & they should receive it tomorrow. Let's see how long I have to wait then! Getting impatient now...........!
  9. Yeah, you're right Weej. Will write to them, why should I give them any longer, they are hardly as fair are they? Notice that you've got your statements - lucky you! Hope you had a nice surprise when you added up all the charges!

I know what you mean about other people receiving their statements quickly without any bother, but this is supposed to be the hardest part so here's hoping! Tweenies2, thanks for the info about the website, will check that out. Of course I probably won't have to because Halifax are going to offer a full settlement as soon as the receive my request!.........well I can dream can't I?! Update on bank statements..... 40 days up and they've not arrived. Why is that not surprising? Phoned call centre who advised that contrary to what I was told last night the branch do not deal with sending them out. As there were no notes on my account the (very helpful) man I spoke to ordered them while I was on the line and assured me that I would receive them in no later than 10 days. I did point out that the maximum 40 day period had actually expired so I should have received them by now. Maybe I'm just a big sap but I'll wait and see what happens after 10 days. Or should I write to the person who wrote to me (N.J. Inett, Data Protection Consultant) advising that the statements would be sent to me & complain that I've not received them? Or should I just be patient & wait the 10 days? I know it's our timetable & not theirs but is there any other way to hurry them up? Will keep you up-to-date, thanks for all the help & advice,
  11. Well 40 day S.A.R. period ends tomorrow & surprise, surprise, still no statements! Received a reply to my S.A.R. reminder letter dated 29/9 advising that statements had been requested. Phoned Halifax phone banking tonight, spoke to a friendly enough guy who unfortunately did not have a clue about my request for bank statements - no notes on account! He advised to phone back tomorrow when my branch is open so that the branch can be chased up for the statements. Let's see what happens then, not holding my breath! When I advised that under the Data Protection Act they only have a maximum of 40 days to supply the statements he then asked what I wanted the statements for! (what do you think!!) We'll see what happens tomorrow. Will keep you posted!
  12. Thanks for your reply John - good luck with your claim! I'm still waiting to hear about my charges too, for the first time in my life I'm looking forward to getting letters from the bank!! Mortonch, I still don't know which court I would go with yet. Like everyone else I'm hoping the Halifax will offer a full settlement after my first request letter.........aye right!! Will keep you posted when I find out which court would be best (I'm only right at the start of my claim but you can't be too organised!) Good luck to both of you & thanks for your replies! Regards,

  15. Hiya, Can someone please help? I'm getting a wee bit mixed up reading all these threads! Have just read somewhere that when our claim goes to court stage we can only claim 8% interest from the date the claim was filed rather from when the charges were incurred as this only applies in England - is this correct or have I completely misunderstood?! Also, I'm in North Ayrshire so am about the same distance from Glasgow & Kilmarnock, & a bit closer to Greenock. Can anyone tell me how helpful any of these courts are and which one they would recommend? Thanks for all your help!
