Been claiming back from Blackhorse. 3 accounts, the first one I tried to cancel after 3 months and they said bogoff, I then sent the a copy of the cancellation request and their bogoff letter (which they kindly included in my SAR) and got a call yesterday saying they will refund everything from the date of my letter (Jan 2000) to settlement in 2004 at Contractual interest rate and then 8% from then on. I have now calculated the refund (and faxed my figures to them), it is for well over £5000 and worked it out using the CI through the loan and then CI through the loan I took with them to settle the first loan and then CI through the loan I took with them to settle the second loan and then CI through the loan I took with them to settle the third loan and then 8% for the remainder (all these CI added £800 to the total. My advice is to do the SAR and check everything very carefully, then just keep at them. I am off to raise the N1 for the other 2 accounts. good Luck I am still going ahead with the other 2 accounts as Mrs DM is self employed and they would never have paid out.
  2. I get the feeling that the law is the same in Scotland, they quote the same road traffic act 1991 section 66,76 and shedule 6 stuff . Can you see the fron tof the ticket now? works ok for me. I look forward to your breakdown of their failings. I plan to appeal nicely first stating that the signage was poor, the warden was over zealous and I never got the ticket at the time. then when/if they reject that I will hit them with the "oh by the way your paper work is flawed". Is that the correct way to go about it? Thanks

To calculate the refund your should be able to claim contractual from the start date until the settlement date then 8% statutory from then on until the date of refund. but if you then took out a futher loan that was used to settle the original and the settlement amount of the original was more than the original PPI amount you can then claim the new loans contractual until that was settled ....and so it goes on. They may try to fight both of these calculations but just let it run all the way to court as the judge will tell them which it is to be.

  5. Interesting call today. (I know never do it over the phone....) I have given her 3 days to get it to me in writing before I post my N1. As you know, I have been chasing Blackhorse and was just giving them 1 last chance to settle before I post the N1. As in post #1 above, I sent them the letter showing they had rejected my request to cancel the PPI after 3 months and got a call today from a Blackhorse PPI person saying for this 1 account they will refund all money taken from the date of my letter to the settlement of the account at the contractual rate then 8% from the settlement date to date of the refund. EXCELLENT.....Tenerife here I come...... I will then have to continue for the other 2 accounts on the mis-selling due to Mrs DM being self employed.

I have detailed some of the curcumstances of the event. since revisiting and surveying the area I now see that they have marked all entrances to this estate (probably around 2 square miles in total) with a permit holders only sign, the entrance I used was sign posted right at the junction from the busy main road, you were then watching for pedestrians and traffic entering/exiting the church and Kwik Fit just at the other side of the signs, so very difficult to see as you watch all this other stuff. I then parked about 0.5 miles into the estate outside another smaller restricted car park at a block of flats. There were no other signs in the road or on any sign posts, exept at the busy junction about 400 yards away (at the post box I walked to to post my letters). On the way to the post box I walk past a further small carpark with another permit holders sign.
  7. I have attached the info below, I went down to the offices today and got a copy of the ticket, so that is enclosed too. I am just going down to take some photos of the signing etc and it is a residential area and only has a small sign when you enter this estate saying it is permit holders only but then in other areas within the estate it also has further permit holder signs, very confusing. ticket front ticket back notice to owner front notice to owner back additional slip
  8. I received a nitoce to owner yesteday saying I was given a ticket on the 12/9/07. What is the best line of attack? 1 - Never got the ticket in the first place but I can confirm from my business recipts that I was in the area they mentioned. 2 - Is there a time limit on when the Notice to Customer MUST be issued? There was an apology with the NTO saying "...The council obtains the owner/keeper details relating to unpaid penalty charge notices from the DVLA. Unfortunately these details have only just been supplied. Please accept my apologies for the delay in issuing this Notice to Owner." Thanks
  9. No, I just for to update it. I got the SAR and did very little with it. I chased each individual company that had searched my Equifax and anyone who had anything registered in it. I then sent tham a lettter saying they did not have my permission to sahre my inofrmation and about half of them removed it immediately. The other half took a liitle more work with 2 companies being taken to court and I am still waiting the outcome. Cabot and Bank of Scotland.
  10. I took out a loan in Sept 1999 and wrote to cancel the PPI in Jan 2000 but was told to boggoff as I was outwith the 30 days they stated in the paperwork. I have read the FOS and FSA stuff on PPI and it looks like they have now revised they advice they give to lenders saying it should be easier to cancel. How does this stand in the scheme of things. I do already have them for mis-selling due to my wife being self employed but they sold ppi with unemployment cover. thanks

I just read the full FSA article and it has answered my question, if you pay monthly then there is no reason why it should not have been cancelled. end of edit.... -------------------- I am currently chasing Blackhorse for 3 PPI refunds. I read the FSA stuff here - http://www.fsa.gov.uk/pages/Library/Communication/PR/2007/043.shtml but that seams to be for single premiums. How can you tell from your agreement if it was a single premium or not? Is is as simple as seeing if you make a monthly payment to the plan in addition to a monthly payment to the loan? Blackhorse list a monthly payment for the loan and a seperate for the PPI. But when I told them to cancel it after 3 months had passed they told me to bog off. Does this mean anything other than I signed and agreed to the 30 day colling off period? thanks
  12. I checked my credit file and found last month BTMK (Tessera) had filed a default against me for this account. Aleged account. I sent them a nasty letter as a prelim to taking them to court for recording this wothout my permission. got a very nice letter back saying they have now stopped collecting this debt and the original creditor has stopped too and the CRA information will be removed immediatley. See, who said a DCA cant be reasonable.
  13. but if they have no enforceable agreement, they have no authority from you to tell the CRAs about it and register a default against you.
  14. Personally I would ingonre the letter. If they continue complain to Trading Standards for them harrassing you without first proving you have any debt owed to them. you have it in black and white that they cannot prove it is you ... As said above don't do their work for them.
  15. Except where either by way of a mistake or through leading the other party someone has tried to hide some important information. I would be using this as I only found out recently that the policy was mis sold and not sold to me after they explained what it would and would not cover. My wife is and has been self employed since 1989 and each of the policies sold would not cover the self employed.

HHNF Don't N1 them for the DPA failure go for the full lot, estimate the figures you think it should ba and explain this in the form to the court, they wil then order the correct figures be supplied. If you just go for the DPA it just delays the full claim. Do you have the following as you can work the figures backwards total loan no of months monthly payment of loan monthly payment of PPI you can then simply keep calculating the apr using the amount of loan and no of months until the monthly figure matches your monthly figure. Send me the figures and I will see what I can get it back to. DM

  18. I will not be mentioning the limitations act unless they state something in their defence about it being limited, I might make a comment to it in my N1 court form but not sure yet. From what you say they are saying the OFT will not look at it, they are not saying it is statute barred. DM

I would go into the branch and kick up a big fuss, ask for all payments back plus interest and a guesture of goodwill as an appology. you could either let them credit it to your account and reduce the OD or just tell them you want it for christmas shopping. Or you could keep it running a few years and let it accrue a ltiile more interest before you claim:)
  20. Thanks HHNF I was hoping that was the case, as they have deceived us....let battle continue. Black horse is currently sitting at £15k and Citi at £12k. That would be nice for Christmas.
  21. if you just want to stop paying it then they will be unlikely to call in your overdraft for that, but if you intend claiming it back since you started paying it as it was mis sold, you never know what they will do.
  22. If your son still has an account with them, any account, keep checking that for a credit, they did that with me and paid cash in the dy of the hearing. I didn't know it was there until after the hearing.
  23. Are mis sold PPIs held to the 6 year limit? Is it 6 years from taking out the loan or six years to the loan being closed? Thanks Blackhorse and CitiFinancial are being chased at the moment.
  24. Was in court with Cabot (or atleast their unpreparCd standin brief). Judge wasn't too happy that the breif wasn't too familiar with the case adn actually challenged that he had the cridentials for this type of case. Anyway, judge agreed that no agreeement or terms and conditions were supplied (on application forms) and said we now need to go to trial to identify the level of damages. Brief tried the usual and have this fast tracked, pressure me into saying "oh hold on while I roll over and let you trample all ver me"....NOT. Judge then asked if I would accept this, I said no and judge then said OK, small calims track it will stay. Said we will go to trial ASAP and I asked that it could be no earlier than 1st Jan as I had run out of holidays, judge said OK not before 31st Dec 07. Set for a full day trial. I now have to be very specific with my damages info. well spent day off.
  25. I had a thought driving in to work today. Assuming the OFT bank charges case concludes and they do something similar to the Credit Card companies (just 1 of the possible options) and the bank are told to refund every charge more than the fixed amount of say £8 (me guessing) so, does this mean that everyone who has already had a payout, that was a gesture of goodwill, without the need for sending a letter of acceptance as full and final, will also be due this payout in additional to the GOGW......the claimant have never actually received a refund of any charges, only a "gift" from the bank with no admission of anything? Just an thought, any comments?
