  1. Received Abbeys defence on Friday damn it! In it, it says they have applied for a stay. I filed my claim through MCOL and live in Portsmouth but it says the court is Northampton? Is this normal? Is there anything I can do now or am I completely screwed? I was thinking of writing to Abbey and their solicitors and asking if they would like to reach an agreement. I am claiming around £2300 and was going to ask if they would be interested in settling for £1300, seeing as they could lose the test case Reckon I have a chance or no chance at all? Cheers Elky
  2. Yeah, I wasnt sure if that was only new claims or claims that have been issued a court date? I havent been issued a court date yet because Abbey havent defended so I'm hoping as of this time next week, they wont have defended and I can file for a judgement. Is that just wishful thinking?
  3. Hi Abbey acknowledged my claim on 27th July and have until Monday 20th August to file a defence. When I log in to MCOL, it still just says 'acknowledged'. Am I right in thinking that if they havent submitted a defence by Monday, I can apply for a judgement?
  4. I did my claim through MCOL on 19th July, deemed server on 21st July. They acknowledged on 27th July and I've heard nothing since. Will this automatically be stayed now or only if they file a defence? If they do file a defence, will this be stayed automatically? Cheers for the advice
  5. I dont have a court date yet and dont know what court it will be. Abbey were sent my claim (through MCOL) on 20th July and they acknowledged it on 27th July. I have now been sent the same letter as the rest of you. Seeing as I dont yet have a court date, will this mean I dont get one and have to wait now?
  6. Can I ask if you were still paying your wages in to this account when they stopped the overdraft? I have an agreed overdraft of £2200 which I am within. I have just filed my court claim online for a total amount of £2385 but I'm still paying my wages in to this account. I also have direct debits and standing orders coming from this account. Basically, its used as my primary bank account and I havent had any charges inthe last 3 months Abbey havent mentioned anything about taking away my overdraft but looking at a few threads I fear that they might. I'm hoping that because I have a good salary going in to the account each month, they will let me keep my account open and possibly let me keep my overdraft Anyone got any ideas as to whether they will or do you think that once they pay out (if they do), they will then be spiteful and either close my account, take away my overdraft or both? Any help is appreciated

  8. Do I send it to the Triton Square address for Abey? Also, when I send a copy to the court, am I sending it to the Northampton address that appears on the claim form? Thanks for you help Elky
  9. Sorry, only just seen your replies. What should I sent to Abbey and the court now? A schedule of my charges? I sent this to Abbey already when asking for money back? Do I need to send it again together with a copy of my claim?
  10. Hi Yesterday I paid the £120 and did the claim online. What do I need to do now? Just wait for Abbey to acknowledge and submit a defence or do I need to send anything to them? Cheers
  11. Hi all I sent them an LBA, stating that I want £1799 back from them. This didnt include any interest. I spoke to the bank this morning and they said they have sent something in the post to me and that they hope to have this resolved once I receive the letter. For some reason, they wouldnt tell me what the letter was. I havent received anything yet but I'd imagine it might be a GOGW offer? Anyway, shall I now send them another letter stating that I want the £1799 and also add interest on to this or do I just go straight to the court now and start my claim with them? Cheers Elky
  12. So just the charges themselves with the dates and what the charge was for? No interest at this stage then I take it? I've done the letter and the schedule, its ready to go our recorded delivery. Will keep you posted!
  13. Received them all finally. Worked out that they have taken £1799 from me over the last 6 years in charges - can't believe its that much! Do I now send them a request for the money back together with a schedule of the charges? Do I add interest on it just yet? Cheers
  14. I emailed them to say I am about to start legal proceedings. Jackie Scott emailed back saying the latest info was sent out in the post to me on 21st May. I haven't received it yet but I'll give it until the weekend and if nothing arrives, I'll start the court proceedings

  18. Hi Abbeys time is up and all I have is a list of charges going back to March 2004, nothing before. I sent them a letter 10 days ago reminding them their time was almost up to supply this data but I've heard nothing. Where do I go from here? Cheers
  19. Whats the chances of them settling the other £156 because its such a small amount or will they contest it and go all the way anyway? Anyone claimed for similar?
  20. Sent them a rejection letter on 4th May and I've heard nothing since. Do I now send them an LBA asking for the rest back? (they haven't taken the £144 back off of my account yet) Cheers
  21. I am still waiting for previous statements but I noticed today that they have refunded £80 worth of charges to my account. I haven't even started a claim against them yet though so just thought this was weird. Anyone else had this?
  22. They have 8 days now to send me the rest of my statements. Is there a letter to remind them of this? **Sorry, found it!!**
  23. Cheers guys. Will keep you posted. Received the last years worth of statements Friday and charges totalled about £400. Looking forward to receiving the previous 5 years so I can see how much they really owe me!
