  1. Hi there, I have had the same experience as you. I applied for a loan on Monday and then read some reviews about the company on the web. I rang them back the same day and told them I wanted to cancel, to which they replied it's all been cancelled and no fees would be taken. However one week later, they took £59 out of my account. I got in touch with the Office of Fair Trading who told me to write to them telling them they broke the law for misrepresentation. I stated the facts in my letter along with given them 2 weeks to refund my money otherwise they i'll take them to court. I got a letter today (25 March 2010) telling me I need to send the a utility bill and a recent payslip in order for them to refund my fee which they will issue in due course. PLEASE PLEASE PLEASE DO NOT HAVE ANYTHING TO DO WITH THEM. I think the cheeck of these people goes beyond the **** of the earth. They'll rot in hell for how they prey on poor, vulnerable people. I think we should start some kind of group against them. I would love to meet the owner of this company. I will be speaking to the OFT to see what they suggest, but rather than communicate with Wentworth anymore, I am just going to issue them with a summons for the small claims court. I'll keep you posted, but please avoid these people with no morals like the plaque. Skeeloj.

  3. I have a monument account and because of the interest and late payment fees this has caused my balance to double and go overlimit for which they keep charging me. I have been offered £265 from £530 that I am claiming. I am refusing their offer and taking them to court, I got nohing to lose except the court fees. Will gladly take that chance. Skeeloj.
  4. Hi, I have done all the other stuff against Citicards in that I am now at the stage where they have made me an offer of £208. I am claiming £470 in total including interest (£60 is interest). I am going to send a letter saying I refuse this amount and am proceeding with a court case. Is this the right course of action or should I take the £208. I am more than willing to go to court. Thanks for your advice
  5. Hi there, Have received an offer from Capital one of £112 saying that they have reduced all charges applied on my account to £12 from £20. I was originally claiming £260.00 plus £42.62 in interest, total £302.62. Should I proceed with court action? Any advice would appreciated. Many thanks. Skeeloj.
  6. Latest update... Halifax after telling me my claim was incorrect and was only for £202 or something have admitted that it is £787 and are offering me £209. I have declined their offer by telephone and told them that I would be proceeding with court action. MCOL issued on 4 Nov. They have until 25 Nov to respond. On MCOL it says claim acknowledged.

  9. Hi there, I submitted my MCOL today and had to withdraw it because I had made an error putting in my account number under the particulars of claim bit. I often wonder things happen for a reason. Yesterday 17 Oct, I got a letter from Halifax saying that they didn't receive my LBA letter of the 12 September and only received my second LBA letter (I referred to my letter of 12 Sept. in this letter) and that they are now looking into my complaint. On 18 Oct (today), I got another letter saying that the figure of £602 is incorrect and they make it £292 in charges and I was given wrong information and they also enclosed a list of charges they are referring too. Well the charges they have listed only date back as far as 2004. They are offering my £109 of the £292 total. Which I will of course refuse. As a result of me going through my statements again and double checking against what they say, I have now realised they owe me £702, £100 more than my original request. When they provided me with my statements of 6 year history, they said they were really sorry, but couldn't provide me with statements from Jan 2004 to Oct 2004 because they were not available. As a result of their breakdown of my charges that they supplied, miraculously they managed to identify charges applied to me from the statements they allegelly couldn't provide me with previously. However, I managed to find these statements i've now discovered another £100 in charges. Please can you advise me what I should do. I was going to photocopy the statements where the charges have been applied and send these to the Halifax and reject their offer and give them a few more days to respond or should I just proceed with my court action?   13. Hi all, Have been using the site for a while but putting all my questions and updates in one general thread. Have been advised by the really helpful people on here to start a new thread in the forum that I am claiming back from e.g. Capital One. Current Position: I am currently paying off my balance through a solicitors firm as Capital One took me to court and won. However, if I get my charges back, then it will cut my bill from about £600 to £300. Statements received, sent LBA letter to Capital One who have until 12/10/06 to respond. Am hoping there will be a letter waiting for me when I get home. Does anyone know if I haven't received a reply today, do I go straight to court action or do I send another LBA. Can you believe after contacting them asking for my statements they have since written to me inviting me to apply for a capital one card...NEVA AGAIN.... Many thanks for your advice and help.   14. Hi there, Have been using a different thread, but have now been advised to post a new thread in this forum as I am claiming back charges from Halifax. Current Position: Received statements, am claiming back £602 in charges from Halifax. I have issued 2 LBAs to Halifax which they have until today to respond. If I get home and there is no letter from them, I will be starting my court proceedings tomorrow. Wish me luck and thanks to excellent people on this site who's help so far has been amazing.   15. Hi does anyone know if I can move my thread to the Halifax forum or do I need to start a new thread. Also, Halifax and my other credit cards have until today to respond to my requests. If they don't respond do I start court proceedings online? Halifax been sent 2 LBA letters and I haven't had any response Monument - 1 LBA letter sent, with no response CapitalOne - 1 LBA letter sent, no response Citi Cards - 1 LBA letter sent, said can take 4 to 6 weeks to investigate.   16. Thanks again for your help. Can you believe the cheeck of Capital One. While I am in the process of requesting my fees back, they have sent me an application form inviting me to apply for a Capital one credit card as a result of me making contact with them. The balance of the first card I had with them is still be collected by a Solicitors firm.... Olliebear, no I have had my statements back from Citi Cards following my SAR and they complied within the 40 days. I sent them my LBA letter requesting my funds be credited back to my account giving them 14 days to respond and included a list of charges with the letter. They wrote back saying my statements are in archives and it can take I think 3 to 6 weeks to investigate as this is how long it may take to get my statements. I was querying should I give them 4 to 6 weeks. I wrote the letter on 28 Sept and the response is due back 12/10/06. I have had all my statements back from all 3 credit cards (Citi, Monument, Capital) and Halifax Bank. Should I get my refunds It will cut 2 of my credit card balances in half (£600 to approx £300) (£1200 to about £650) and from £2200 to approx £1600). Halifax owe me £602. I am currently at the following stages: Halifax - Second LBA sent - response due back 12/10/06. If no response received, next step is issuing court proceedings Citi Cards - LBA letter sent requesting charges be refunded - response as above, not sure what to do. Monument - LBA letter sent requesting charges back - response due back 12/10/06 - Next step, I think it's to send another LBA Capital - LBA letter sent requesting charges back - response due back 12/10/06 - Next step, I think it's to send another LBA Thanks again guys for your help.   17. Hi, I have sent LBA to all my credit cards and have sent Halifax a second letter giving them another 14 days and have heard nothing. One of my credit cards Citi Cards, have written to me acknowledging my LBA letter that I sent and said they are investigating, but it could take 3 to 6 weeks as my statements are in archive. They said if they get the info sooner, then they will. Should I do anything or let them wait 4 to 6 six weeks, at which time they will investigate my claim and let me know the outcome.   18. Thanks for your advice once again, I really appreciate it. The Halifax have until today to respond to my initial request I will probably give them until Friday before taking any action. Please can you advise what action I next should they not respond. Regarding Monument, they wrote to me a while ago saying that will provide me with an update on the 21st September. I received a letter on the 22nd September saying that they are still looking into it and they will provide me with a further update by the 18 October. However, the S.A.R - (Subject Access Request) letter I sent gives them up until the 3rd October. Should I write back and say that they have until the 3rd October. If so, please can you also advise what I should do next. I haven't heard from Capitalone or Citi cards, since receiving their acknowledgement letters. I am currently paying CapitalOne and Citi Cards £50 a month via there solicitors, who have obtained county court judgements on these accounts. Can I stop paying them and tell them that the amount that I owe is being disputed with the credit card companies? I'm not sure, but I think the balance that I owe these companies will be reduced considerably if not possibly clearing one of the balances completely, but I am not 100% sure, as I am not even sure what I owe them (except Monument) as the solicitors don't provide me with any statements.   20. Hi there, I requested my statements for last 6 years from Halifax back in August. They charged me £5 for the whole lot, so am a bit confused as to why they have charged you that. Hopefully the Data Protection Letter with the £10 cheque should eliminate you having to pay so much. Good luck and keep trying. Regards. Skeeloj
  21. HI there, I'm not an expert, but if they have refunded one charge, then they obviously are guilty of something. If you look at the forum you will get good advice and guidance from this website. The people who set this website up have done a great job in providing advice and information. I would say that you still request all the charges they owe you. Ask the halifax to provide you with a copy of your bank statements for the last 6 years (as this is as far back as you can claim). Do this in writing or use one of the letters on this site. When writing, put in your letter that you authorise them to take the £5 administration cost from your account. If you don't then this could delay the process. This is what I did and I got all my statements with 4 weeks. At the end of the day, it's your money so why can't you have it back if what they have done is unlawful and the fees are unjustified. I haven't had any money back but have started the process am and glad. I am quietly confident I will be successful and should I win, will certainly be making a contribution to this site as I think it's amazing. Make sure you go for it.   22. Hi, I am claiming back charges from 1 bank (halifax) and 3 credit cards (Monument, Citi & Capital One). I have sent all subject access request (SAR) forms to all 4 of them. Halifax - Current Position Statements received, letter sent requesting they refund money for my charges. They have until 26 September before I take next steps. No response received as yet. Monument - Current Position Acknowledment of request received and they have said they will provide me with statements by 20 September, but nothing received as yet. Will give them until the 3rd October 2006 as this is 40 days from the SAR. Capital One - Current Position Acknowledgement letter received, but no date given as to when I will receive statements. Will wait until 3 October 2006 if nothing received before then before taking next action. Citi Card - Current Position Have acknowledged request again same position as Capital One and Monument I have a question please : I was wondering with Capital and Citi cards, I currently pay them £50 a month through different solicitors as they took me to court and won. When I receive the statements I know for a fact that a large amount will be charges and late payments fees. Do I ask Capital and Citi to take the amount from the of the outstanding balance that is with the solicitor rather than paying me the money, as I haven't actually paid all the charges as yet. Does this make sense? Monument are at they stage where they are about to default my account and pass on to an agency, so I am hoping to get statements before that stage as I know a large amount of my oustanding balance is in charges applied by them.   24. There is some really good information on this site which I have found really useful, so thank you all. I have a question please and would appreciate any advice. I have 2 county court judgements made against me for 2 credits cards and am currently paying these cards off via the credit card companies solicitors. I want to ask these credit cards companies to to credit my account with the overlimit and late payment fees that they have charged me over the years and was wondering who do I send the letter to, is it the solicitors or the credit card companies. I also wanted to know, does anyone know how long a company can chase you for a debt. I have a credit card debt that is over 12 years old and once in a while I will get a letter asking me for the money. Does anyone know if there is there a cut off point. Finally, I have sent my other credit card company the standard letter asking them to credit my account with all the late payment and over limit fees. I have requested a statement from my bank detailing what charges I have incurred over the past 6 years and will be sending them a letter once I receive the statement.
