  1. Not experience i can go into on here but my contract law tutor from the CPE many years ago used to work for them.

This is a simple contract dispute, they have not fufilled their contractual duty by delivering the items, saying it was sent is not enough as the contract is not completed untill you recieve the goods. Write to them again stating this, that they are in breach of contract and that they should refund you the cost (plus postage) or you will seek legal advice on what to do next. You could also add in for added effect that they have breached an implied term from the Supply of Goods and Services Act 1982 (s14 or 15 i think) that where no time period for completion (i.e. delivery) is stated that it should be done within a resonable time. As this is statutory there is no way out and if it went to court they would lose on this ground. It should shock them enough to refund you or send out another t-shirt. They may reply with something like 'we have not recieved a returned item etc' but keep at them about it as if you have not recieved it then they are are in breech of contract and should refund your money.   4. Weightmans are a firm of solicitors, is their head office by any chance on Water St in Liverpool? If so then its the solicitors, if not then thats a s far as I can assits atm.
  5. Woops didnt mean LBA i ment the first notice!! Since then I have had a letter back which is very confusing, it doesnt sate whether they will be refunding the charge but it also doesnt say that they won't refund it, anyone else had a similar letter? Shall I just send my LBA off or write again and ask them why they havent answered my question? Thanks
  6. Well yesterday I noticed that they charged me £12 for a late payment again even though I sent the payment 4 days before the due date. LBA being sent off tomorrow!

  8. Hi all, I am cancelling my Vodafone contract as they have done me no favours and I got a better deal elsewhere, my question is this. They want to charge me £12 for early termination of the contract (I have to ask for this in writing), can they get away with this? Anyone had a similar experience or a template to send to them as I reall dont want to give them anymore money. Thanks in advance chaps Adam
  9. 6th October, recieved letter, we eieve we are right etc if this went to court we would win bah blah blah. Oh but they also refunded the charges and don't accept any liabity!! They refunded the charges, a mon avis thats an admisson of liability, I win, money being credited to my account when I retun the signed letter, also no sitpulations and if they charge me again nthing mentioned abut claiming that back too!!! 3-0 to me now!!

  11. Go over the ticket with a fine toothed comb, any mistake and I mean the slightest error will render it invalid, incorrect registration (includes crossings out) name etc anything!! You could get it cancelled on appeal, i did it once, parked in a disabled bay with my partners blue badge showing (and partner in tow so legal) in Denbighshire (loggerheads national park) and was ticketed and got it over turned, I know that is completely different to your case but Denbighshire council cancelled it, some hope that they do (rarely) cancel tickets. Surely they would have noted your arrival time at the bay in order to issue a ticket? (just proves my point that they randomly issue tickets) If not how could they know that you had overstayed?

  13. This is a tough one!! Well you have payments going out to pay back a loan. If they searched your financial history for the time when you had the loan they would only find that loan (unless you had others?), so put 2 and 2 together, those payments were to pay that loan. My legal opinion, get advice, there is a slim chance you could have them on something. Also there will be a copy of your loan agreement out there somewhere, its a question of finding it. The action could casue the bank to 'magically find it' or it could casue them to panic because they have genuinely lost it (unlikely). This could bring up another issue for the bank, you would be sueing them under a civil case, the outcome of which could then bring about a criminal case against the bank as you were sold a loan when you were under 18 (illegal). Give me a few days to do some research on the matter, see if there have been any similar cases to yours, if i have anymore questions I will let you know. In the meantime seek further legal advice on where you stand, you could be sitting on something major here with the underage loan (i am still struggling to see how they sold a loan to someone who was under 18), sit tight, get more advice and I will look into things for you.   15. Do you not have a copy of the agrement? If you take them to court over it they will probably miraculously find the documentation. My natwest account still shows the loan account I had when I had to take out a loan to pay for my legal training, I paid it off last year early, they tried to charge me an early settlement fee but I sad no, and had it refunded
