  1. sorry natweststaffmember i'm prob just being thick but how can i reword the prelim letter to let them know that i've claimed once and it's more cost effective for them to settle straight away rather than have me claim through court again? thanks for your help !!!
  2. yes, i've got a court date for march but i know the cheque is on its way!! i spoke to cobbetts last week. i don't know what to put in the letter for my second claim because obviously i want to let them know that i've started proceedings against them once and i'm quite prepared to do it again!! cheers
  3. has anyone got a link or ideas for a letter to natwest asking for charges added to account after i had started my 1st claim? since september they have added another £550 of the blighters. any advice would be helpful, has anyone else claimed again? cheers claire xx
  4. well, no cheque yet! i spoke to lynsey burgoynes assistant last week to check they had recieved my rejection letter which they had on the 23rd november, she said they had so i asked what was going on as loads of people had recieved their full payments on a similar time scale to me. she said they had requested my cheque at the end of november and they are just waiting for it. has any one else spoken to cobbetts at all? i'm a bit worried as everyone else seems to be being paid!!! merry christmas everyone claire xx

  8. hello, i've recieved a 50% offer from cobbetts this morning, which of course i'm not going to accept:rolleyes: . does anyone know roughly how much longer it'll be before they send me the full amount? (sorry, panic setting in about christmas!) cheers claire xx

  10. hiya, I've recieved cobbetts AQ in the post this morning and in section G they've put "Case management directions cannot be proposed until the claimant serves a reply to the request for further information which was due on 10 november 2006. In light of this, the defendant may amend its Defence or apply to strike out." is this normal? I sent them the normal part 18 refusal letter along with a schedule of charges which they signed for on 10th november, I had also faxed it to them 2 days earlier. I sent a copy of it with a covering letter to the courts on the same day with my AQ. Do you think there is any chance of this being settled before crimbo? I know i don't post on here very often but the advice i have been given and following other peoples cases has been invaluble to me and i would like to thank you all. If i win most of the money will be clearing debts but i WILL donate as much as i possibly can. cheers claire xx
  11. can anyone advise me please on what i should do? i've just sent back my aq to court for my claim against natwest, but since starting mcol on 25th september the cheeky sods have charged me another couple of hundred quid! shall i write to mr higley again and ask for these back? has anyone got a good letter i could send because i want to say something along the lines of there already being court action started on this account so you shouldn't be charging me or surely you don't want me to cost you more money in solicitors by starting another legal battle with you etc. sorry i'm so rubbish at letter writing!! thank you so much claire xx

This is what i used when i filed on mcol - hope this is right or i'm a goner gooner:D Claimant has account (A/C No) with Defendant from (Date a/c opened)conducted on their standard terms and conditions. Claimant is claiming the return of (£0.00 = amount claimed) taken by Defendant in charges over (X) years. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e. In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from(Date of 1st charge) to (Date of filing claim) of (£0.00 =8% spreadsheet calculation) and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (£0.00p = Amount claimed x 0.00022).
