  6. Halifax rolled over !! Settled in full !! They said they were going to defend, but then sent letter saying it would cost them too much, and although they admit no liability of course, a refund would be in the account within 5 days. It was there today !! I'm so pleased it's over. It was a claim for my daughter's account, so she will be sending a donation asap. Couldn't have done it without all the help and info on this site.   7. I can't believe it is over a year since I started this one. It's up and running now. Initial letters sent and standard "Foxtrot Oscar" letters received. Issued claim in Staines Court about a week ago. Just hoping now that they pay up before it goes much further. I've just completed a bundle for Lloyds - what a waste of paper when we know they are 99% certain to pay up or not turn up!
  8. Hi Drewco, Slow down, Have you read the FQA and surfed around the site a bit? You can't charge the 8% until you go to court. You can add other charges until you file in court. It is entirely your decision if you decide not to claim all the money owed to you All the information you need is here on the site. Do check the FQA and follow the links given to the paraticular stage you are at. Samples of all the forms are here if you take your time and read, read, read. Nothing was happening, we went away on holiday for a week and came back to find that a Notice of Allocation to the Small Claims Court at Guildford (hearing) had been issued for the 14th June at 1030 The judge had decided to ignore my request for the papers to be filed within 14 days I originally filed it in Staines. When I rang to ask them at Staines why it had been transferred, the nice lady told me that there were so many of these claims that they were all going together to Guildford The paper says it will take no longer than 1 hour and everything has to be filed no later that 14 days before the hearing. It's going to be the middle of June before this one is finished! I'd better get started on the Court bundle soon. It really does seem so unfair that we have to do all this preparation work when SCM apparently do nothing at all and just settle without doing any paperwork. That's enough whingeing. Back to work and get that bundle underway. Halifax is waiting in the wings and I might just have to start that one before the end fof TSB,
  10. Congratulations Maundy, well done! Did you have to actually send off yuor court bundle or did they offer settlement before you were able to send it? I'm a bit behind you having just passed the AQ stage and hoping they are likely to settle early
  11. Thank you Yedmans for your input. Although my Endowment is also with Sun Alliance (now AXA), I've no doubt I used a different financial adviser/agent. I appreciate what you are saying that we are outside the legal time window, but there is just a chance that my IFA may just have a moral concience. Anyway, I've got nothing to lose by writing to him with all the facts and, my opinion, and see whether he has anything to say. I have edited my original letter at post No.14, with some amendments offered by Nightmare4banks, rather than enter it again here. The letter is now typed and ready for recorded delivery, so I'll just have to wait now to see what, if anything, comes back. If, as I expect it is a big fat negative, I will try my local MP as you suggest. Again, there is nothing to lose by making a nuisance of ourselves. Chrisi

  13. Quick update. Took AQ into my local court today. The lady behind the counter asked if I had sent a copy to the other side. I said I had faxed it and asked if that was OK. She replied that she could see no reason why not. I asked her if any of these claims against the banks had made it into this court. She knew nothing about all the banks being challenged for their charges, so, of course, I gave her the web address of the CAG site for all the information she needed. I also asked her if she knew when I might expect a court date. She replied "a few months" I hope she's wrong. I thought the new draft directions speeded things up a bit. Just have to wait and see.
  14. Thank you Martin for sticking these two threads together. Well the AQ is now all filled in and ready to go. As SC&M can fax their docs to the Court, I see no reason why I cannot fax docs to them. The fax machine I use spits out a confirmation that all has arrived safely. It is still within plenty of time to ge one in the post as well if they say this is a no-no for some reason. This is the covering letter I attached in front of the five pages I sent i.e. 4 pages of AQ and a copy of the Draft Directoins. I also wrote their reference number at the top of each sheet.   15. Hi Gemma, Well done and belated congrats. I've only just found this thread. You could try phoning the solicitors "just to see if the cheque is in the post as it might have gone astray". But I think it is far more likely that as they kept you waiting till the very last second at the last stage, they are likely to do the same again and leave it until the 13th day before they do anything.
