  1. Hi guys, just wanted to know if there is anything going on with regards to ERC's. I paid over £7k ERC to Accord Mortgages and I know that the advice is don't claim but is there any official investigation going on on this matter.

  8. I sent my LBA for my second time of claiming on 26/2/07. I received a reply dated 2/3/07 saying they were looking into my complaint and would reply within 28 days. I didn't file my court claim after the 14 days due to lack of funds. I then received a letter from them dated 16/3/07 stating that they were prepared to refund £750.00 as a goodwill gesture but this did not mean that they considered they has a legal obligation to do so.It a the quoted all the usual about keeping within the limits etc. They stated that the £750.00 would be credited to my account within the next few days, there was no mention of final settlement or any condition nor did they want any agreement from me to accept this goodwill gesture. I then checked via the internet on 20/3/07 and there it was in my account but not the account that the claim related to. I then received a phone call on 21/3/07 in response to a message I left them on 20/3/07 apologising for the delay in getting back to me. They asked was I ringing regarding a refund of charges. I replied yes but I had now received thier written response and they goodwill gesture had been paid into my account. He was somrwhat surprised as his records did not show that a letter had been sent or a credit made to my account. Maybe I should have not told him I might have got paid twice. Incidently my claim was for £835.00. I am debating whether or not to continue with a court claim as as couple of other charges have benn added to the figure since my LBA.

  10. Has anyone actually gone to court for ERC over £5k and won if so who & are the details on here. I am seriously thinking of giving it a go with Accord. I am certain I could put a good case in court in front of the Judges I deal with quite frequently in my job.
  11. Thanks for that Paul I will be keeping a close watch on this subject. If I find out any more I will let you know and would appreciate it if you do the same. I spoke to a District Judge on this subject and he is totally supportive of our situation. Maybe I will raise the subject with him again or with some of the other Judges I frequently deal with. Good luck and lets hope we can get justice from Accord soon. Vikki

Can anyone tell me please whether I should try to reclaim from Accord the following: Admin Fee £50.00 Arrangement Fee £695.00 I had my mortgage with Accord Libor Rate and the repayments rose from £888.00 pm to £1399.00 pm within 2 years. I had no otpion in January 2007 than to change to another mortgage product with them because my credit rating wasn't looking great where I had been struggling to make my repayments. I did not miss any payments but change for 4 months to Interest only just to reduce my monthly outgoings. The above fees are what I was charged plus ERC of £7344.00. Are the circumstances different when claiming ERC if you have just switched products with the same company. Surely it is of no real loss to them as they still have your business. I also only had 19 years left on the mortgage I now have 25 years. Help please. Vikki
  13. Hi folks, just hought I would let you know that I spoke with a District Judge today about ERC and guess what it's happened to him to. He said how can they possibly justify these charges. He said the matter seriously needs looking into from a legal point of view. He said if a case is brought before him he would certainly not rule in the favour of the mortgage comapny. He said he is certain other Judges feel the same as he is sure a lot of them like him have or want to pay off thier mortages early. He advised me to read up on this and prepare my case thoroughly, he the the Financial Times have articles relating to this subject on the internet. Incidentally he is looking at getting his daughters Bank charges back. I think they may pay up quickly with letters signed in the name of Judge ---- . I can't mention his name or location for obvious reasons. But hell I think this is good news.
  14. Hi Paul I'm another victim of Accord with an ERC of £7344, Arrangement Fee of £695 and an Admin Fee of £50. Do you think there a chance of getting any of this back?
  15. I've already had a successful claim against Lloyds TSB and have just sent my LBA for the second time around to them. I now want to start with my credit cards. Can anyone tell me do I use the same letter to request details of charges or is there one specifically for credit cards and stroe cards?
  16. I'm about to send my LBA for the second claim, I'm hoping they don't play dirty this time around because I have a large overdraft which of course is not helped by thier penalty charges. Good luck with yours. Vikki;)
  17. My OAP Mum recived a letter offering settlement of £750.00 today against a claim for £1070.00 that of course does not include any interest. I know a few people have experienced this of late. Has anyone refused thier offer and then been apid the full amount without filing a Court claim. My Mum is tempted to accept the offer because she really could do with the money. I think she should hold out for the lot. Incidently did anyone see the programme on ITV last night telling people how to reclaim thier charges. They said to include interest on the first application for refund. I thought you could only claim this once you file the court claim.
  18. I received a phone call tonight from a company wanting to know if I had been a victim of high bank charges. I replied yes I have. She then went on to say that they are a company that will fight your case via the court in order to get your charges refunded. I asked what fee they charged, she said nothing up front. I enquired as to how much they would charge if the claim was successful. To which she replied it would be a small percentage of the claim, I confirmed this to be 10%. I then advised her that I had already reclaimed my charges via the court and had been successful and why would I want to pay them to do something I can do myself for free. She replied it is a very time cunsuming process and involves a high volume of paperwork. I advised her that I did not find that to be the case and would recommend that people deal with thier own claims and use the forum. Most people who are reclaimimg thier charges are not in a position to be giving money away. I did say that some people may have a fear of going to court and would welcome thier help but it really is not necessary as the banks generally pay up before it gets to court.
  19. Has anyone had one claim settled and then gone back again for further changes since the date of claim? If yes any chance of letting me have sight of the letter please.
  20. I am about to start my second claim against Lloyds TSB for charges since my last successful claim. Has anyone else gone back for a second try and what letter did you use if so? Just thought that maybe it could also be put in the templates library as I am sure I am not the only one that will be using it. I don't think the Preliminary request letter is really fitting for the 2nd claim in such a short time. I did ask for the additional charges but despite full settlement of the claim I have never received a reply from SCM.
  21. I sent the preliminary request for a refund of charges on behalf of my mum today. She is an OAP on basic state pension, she got into a bit of a mess and as a result was stung with Lloyds TSB charges. This just made things worse and the charges just got higher and higher each month. Her pension was virtually being swallowed up by charges. She had to seek help from the Credit Consumer Council in the end to sort things out. She now has an arrangement in place to repay all her creditors. Lloyds TSB being one of them. Incidently she is a retired Lloyds Bank employee but gets no concessions from them. She doesn't even get a pesion from them because she only worked part time all be it for 30 years +. Not only do they treat their customers badly but they also do it to their employees and ex-employees.
  22. I actually received settlement in full plus interest to the date of settlement. plus costs on 6/10/06. I have not however had the courtesy of a reply from SCM what a surprise! I requested a refund of the charges incurred since my claim maybe that's why they have not answered. Think I might give them a call.

Dear Sirs, I write with reference to your letter dated 25th September 2006 and have duly noted the contents. You mention that your clients Lloyds TSB, have very kindly offered to settle my claim. We are willing to accept your kind offer of £1873.32 along with the additional interest of £37.81 totalling £1911.03 as a full settlement of this claim. The conditions upon which we accept your offer are 1) that our original court proceedings will continue as previously stated until the full amount has cleared our account. 2) We will accept a review of our bank account if our branch feels this to be necessary. 3) All reasonable effort will be taken by us to keep the account within the agreed overdraft limit. 4) We will also be looking to reclaim the unlawful charges applied to bank account ****** since 8th June 2006, which total £540.00 (this includes £100.00 that is to be debited from the account on 2nd October 2006). We are prepared to commence another claim regarding this amount should your clients not wish to co-operate by refunding this amount along with the amount of the claim as stated above. - My case is based on UK Contract Law and that Lloyds have acted unlawfully by levying penalties charges on my account. If penalty charges are made to my account in the future, then they will also be unlawful and unenforceable. 5)I do not have to accept any such confidentiality clause. My case against Lloyds is a matter of law and I am frankly rather disappointed that your client should seek to introduce this term. We look forward to hearing from you within the next 7 days.
