  3. my car insurance direct debit payment was not collected a while back, and I incurred a £20 'non-payment collection fee'. not happy. thanks to the power invested in CAG I sent my insurance company a letter explaining the delights of sections 5 & 8 of the UTTCR, namely: Unfair Terms 5. - (1) A contractual term which has not been individually negotiated shall be regarded as unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties' rights and obligations arising under the contract, to the detriment of the consumer. (2) A term shall always be regarded as not having been individually negotiated where it has been drafted in advance and the consumer has therefore not been able to influence the substance of the term. (3) Notwithstanding that a specific term or certain aspects of it in a contract has been individually negotiated, these Regulations shall apply to the rest of a contract if an overall assessment of it indicates that it is a pre-formulated standard contract. (4) It shall be for any seller or supplier who claims that a term was individually negotiated to show that it was. (5) Schedule 2 to these Regulations contains an indicative and non-exhaustive list of the terms which may be regarded as unfair. Effect of unfair term 8. - (1) An unfair term in a contract concluded with a consumer by a seller or supplier shall not be binding on the consumer. (2) The contract shall continue to bind the parties if it is capable of continuing in existence without the unfair term. first letter was ignored. LBA sent a week later, threatening court action. then....refunded! fight the good fight people! HARDCORE WILL NEVER DIE!!!
  4. a friend is being taken to county court over an alleged CC debt - claim has been acknowledged online and a defence submitted. in respose to the defence the alleged creditor (DCA) has provided paperwork under CPR and submitted an amended claim HOWEVER this paperwork has proved to be their downfall big time!! my friend has prepared an amended defence which comprehensively explains why the claim should be thrown out but the question is: does my friend submit the new defence now? they want to wait until the court hearing to reveal the new evidence but doesnt the defence have to be submitted BEFORE the hearing i.e. 'make available all paperwork you intend to rely on to all parties'? fight the good fight

  12. casperlady its easy for me to say this but please try not to worry at this time. you had a judge who seems to know nothing about your rights, sounds like a stitch up to me. 'thousands of pounds in fees' and chastising you for not speaking to the solicitor - just unbelieveable its fair to say that in the 100's of threads about going to court, i have never read anything like it something to think about - site mods have been known to attend hearings with caggers, get this set aside and alert a mod to your needs
