    hi waynedear has egg also got to submit a court bundle by the 18th and if so what has the judge directed them to submit thanks countrybake
  2. if you put it on anyway with your charges they will pay all up before they are in court anyway

  4. update on my case i sent a copy of the AQ to egg and asked if they could acknowledge safe receipt and forward a copy of theirs 2 weeks ago now and they have sent nothing back the ignorant people. anyway just to let you all know i will not stop proceedings until i have every penny off them and also the default their is no tempting offers they could give me as i have already received over 8k from 6 differant banks, so if the legal section at egg happen to read this then stop waisting time and pay up i will get it eventualy tick tock tick tock. everyone please stick with your full ammounts you will get it eventualy some banks paid me in just 1 month others are a longer wait like LTSB and RBS easy ones are HSBC and A & L and Smile. thanks countrybake

  8. hi jonni thanks for looking into my case here are the answers to your questions. yes but with extra bits added as i am going for default removal aswell as ppi money back too. here are my particulars of claim. 1. The Claimant has an account xxxxxxxxxxxxx ("the Account") with the Defendant which was opened on or around xxxxxxxxxxxx 2. During the period in which the Account has been operating the Defendant debited numerous charges to the Account in respect of purported breaches of contract on the part of the Claimant and also charged interest on the charges and overdraft insurance once applied, also a Default notice was swerved upon the Claimant. The Claimant understands that the Defendant contends that the charges were debited in accordance with the terms of the contract between itself and the Claimant. 3. A list of the charges applied is attached to these particulars of claim at page x. 4. The Claimant contends that: a) The charges debited to the Account are punitive in nature; are not a genuine pre-estimate of cost incurred by the Defendant; exceed any alleged actual loss to the Defendant in respect of any breaches of contract on the part of the Claimant; and are not intended to represent or related to any alleged actual loss, but instead unduly enrich the Defendant which exercises the contractual term in respect of such charges with a view to profit. b) The contractual provision that permits the Defendant to levy such charges is unenforceable by virtue of the Unfair Contract Terms in Consumer Contracts Regulations (1999), the Unfair Contract Terms Act 1977 and the common law. 5. Accordingly the Claimant claims: a) The return of the amounts debited in respect of charges in the sum of £xxxx and any interest charged thereon; b) Court costs; c) Removal of Default. d) Interest pursuant to section 69 County Courts Act as set out on the attached list of charges of £xxxx or at such rate and for such periods as the court deems just and also interest at the same rate up to the date of judgement or earlier payment at a daily rate of £xx. yes. all help is very much apreciated thankyou

Hi jonni just a quick question about the court bundle and the provisional findings report - NI personal banking. do you add all 200 pages of this document or just part of it, any advice would be much apreciated as i have to send in the court bundle to the judge on the 6/12/06 for the case set for 16/1/07 thanks

Hi all just a bit of advice upon the copy of the rbos (corbetts) AQ in the G other information it says "the claimant has not shown that he has reasonable grounds for bringing the claim and despite the defendant requesting that the claimant remedy the lack of particularity pleaded in the particulars of claim, the claimant has failed to do so. Case management directions cannot be proposed until the claimant fully particularises his claim. In light of this the defendant may amend its defence or apply to strike out." is this the normal that they write or do i need to fully particularise my claim as stated whatever this means, any help would be appreciated thankyou.
  12. hi AC i have placed a claim with egg with the PPI, Charges and Default removal, I personaly think doing them all together helps especialy with the charges part as they tend to pay up everything as what happened with me with HSBC CC i had £60 worth of charges and £550 worth of PPI i was claiming back of which they paid up.

  14. caro yes they have paid straight into the account thanks della yes i got an acknowledgement of service first and they paid up at the end of that period not long left now. but if it was ltsb they go a lot further to near the court date
  15. jay this is an unusual first post you usualy start introducing yourself but you go straight in there i have also been refused a cca so i have now canceled DD they will have to fight for it now
  16. they have now settled full and unconditional just have to wait to see the money then i can write to the court to cancel proccedings

  19. told court to cancel procedings as cheque has cleared now it is after my CCA. LBA went on the 3rd giving them until 13/11/06 for reply
  20. called off court action now as cheque has cleared. now it is time to go for claim 2 as they have taken £330 in 2 months prelim sent 3/11/06 lba to go 19/11/06
  21. notice of issue received today deemed served on 2/11/06 they have until 16/11/06 to reply by tick tock!!!!!
  22. no it is from when they receive payment. sorry, but yes do send the CCA no harm in trying i did to all of mine 6 in total 4 sent it 2 have failed to do so.
  23. they have sent a letter saying they will refund £70 on the redemption charge fee i said no way now they say £180 on the redemption charge fee no mention of the £800 in charges or the redemption fee just the stupid redemption charge fee graaaaaaaaaa!!!!!!!!
  24. hi caro the first payment was for £330ish that was £275 for charges plus court interest and this one was for the charges of £275. I think that doing the two simultaniosly court procceedings with the charges and threatening to have them put into jail for not sending me my credit agreement they have got confused.
