  1. Hi There, I started my claim against LTSB and sent my LBA letter in April 07 but since then have not filed my claim at my local court (Bury, Lancs) due to the OFT Test case. I am now thinking of filing my claim but am not sure how far back I can claim. Is it six years from when I started my claim (April 2007) or six years from when I actually submit the claim which will now be April 2008? Thanks for your support.

  3. Hi elsinore, Thanks for your reply. Sorry to have to admit it but I have just sat on this, and not made time until yesterday to see what I should do about it. Both letters specifically refered to only one account, which was the last four digits of the plat card. Any advice?
  4. Could anyone help please. I started my claim against LloydsTSB for charges against two bank accounts and one credit card I have with them, and got to the point where I had sent them my LBA which was for a little over £2K in total. Then the OFT test case was announced before I filed which has basically put me in limbo. I have since received two letters from Lloyds CSRC re the platinum card, but importantly NOT for either of the two current accounts which account for the vast majority of the charges, presumably because they know that the credit card is not covered by the OFT case. Anyway, the first letter (Final Response) dated 26th July 2007 is as follows: "Although we haven't changed our opinion about our charging policy, I'm willing to reduce all of the disputed charges from Aug 03 to Jan 05 to £12.00. This will result in a refund of £80.00 to your account. I am also prepared to refund 8% interest on this total of £11.03, making a total refund of £51.03. We're also going to pay you 14 days' net interest at a yearly gross rate of 5.00% to make sure that you don't lose any interest while you are considering our offer. So, the total amount we'll pay you is £51.11. I hope you are happy with my offer and if you would like to accept it please sign the enclosed copy of my letter and return it to me in the reply-paid envelope. Once I receive it, I will arrange to credit your account. I will hold my offer open for one month from today." It then requires a signature to the following: I, the undersigned, accept the above offer in full and final settlement of this and any associated issue. No, way! Can they really do this? Is it me or is there maths screwy? The second letter dated 8th October goes as follows: "Although we haven't changed our opinion about our charging policy, as a gesture of goodwill I'm willing to refund the charges in full, plus interest at current Bank of England base rate. We're also going to pay you a further 14 days' net interest at the same rate to make sure that you don't lose any interest while you are considering our offer. I hope you are happy with my offer and if you would like to accept it please sign the enclosed copy of my letter and return it to me in the reply-paid envelope. I will hold my offer open for one month from today. It then requires a signature to the following: I accept the above offer in full and final settlement of my complaint against the Bank and understand that my account will be credited with this sum as soon as you receive my signed acceptance back. What should I do? If I sign this will it jeoperdise any action re my current accounts? PS My local court is Bury, does anyone now if they are still taking cases, or are all cases being stayed?   5. Hi All, What a fantastic site! I have just started, having sent SAR requests to Lloyds & Amex and could do with a little advice. Amex have replied very quickly with the following: "I have been passed your letter by our Correspondence Department and understand you wish to exercise your right of Subject Access under Section 7 of the 1998 Data Protection Act. I have ordered copy statements showing all charges to be reprinted for you and am able to provide those free of charge as a goodwill gesture and will forward those in due course. However, should you require a full disclosure we require you to complete the enclosed form and return it to the address above, together with the fee of £10.00" Do I need the full disclosure that they are talking about or are the copy statements sufficient?
  6. Hi All, I am finally going to bite the bullet today, and send off SAR to Lloyds but could do with a little advice before I stick the letter in the post. I have a couple of curent accounts, a credit card and loan accounts with Lloyds plus a loan account with Black Horse. Can I ask for statements/details of charges on all of these accounts with just one SAR? P.S. I think I may have some old loan accounts that are now closed or have been wrapped up into new loans, but don't have the account details. Is there a way of requesting details of all charges across all accounts/loans over the past six years without having to provide account details?
  7. Hi All I've just signed up and am amazed at the success everyone has had. I've got a couple of old credit card accounts; Amex, and LloydsTSB Visa that are now closed so will need to send off DPA requests. I note that the best way to get these is include the £10 fee, but what is the best way to do this? If a Cheque who should I make it payable to, or is it best to use a postal order?
