  1. No they didn't. I have several lines with Orange and I don't think I've ever been sent anything when I've changed my tariff.
  2. Half of my Recorded delivery items never show up when I use the Track and Trace feature. Usually it has been delievery but it is annoying for me to chase up on whether the recipient has received their item when I've already paid Royal Mail to tell me that!
  3. My sister has an Orange contract and she was on one of their Premier 600 monthly contracts. This tariff gives you 600 minutes a month anytime/any network. After 6 months she asked to be downgraded and she asked details about their Orange Value Promise T-Mobile EQ Freetime 750 tariff. She was told that this tariff gives you 750 off-peak minutes. What they failed to tell her was that these minutes only applied when calling other Orange numbers. She got her bill today and it is asking her to pay almost £500! She phoned Orange and they said they will get back to her on the issue. What can my sister do to sort this situation out?
  4. I sent Halifax a preliminary letter giving them a 14 day deadline to refund a £39 charge. The 14 days passed and I got a standard reply saying my complaint will be dealt with soon. I sent off a Letter Before Action yesterday but today I got another letter from them saying that they've refunded the charge. On a side note, Capital One have refunded £40 out of £60 they've taken after I sent a preliminary letter. A letter before action has been sent to them for the remaining £20. Barclaycard have refused a refund and I've also send them an LBA. Merged threads, please keep to the same one.
  5. Hey it was just a thought! I will obviously be more than happy to close the matter if I get all my charges back. What I really want to see is someone take one of those non-existant entities that work for Halifax to court? I've sent my letter before action asking for the £20 plus any interest I've been charged. On a side note, Halifax just back back a £39 charge after my preliminary letter to them. Almost seems a bit too easy. Merged threads, please keep to the same one.
  6. Well sending letters costs money and I made that clear in my preliminary approach. Also, I'm not talking about the 8%APR. I'm talking about the credit card interest as a result of the charges (ie. charges meant I had to pay more in interest!).
  7. Okay just got a reply from Capital One to my preliminary approach on the day of the deadline. They have confirmed that they will refund £40 and checking online shows that this was done on April 26! However, I have been charged £60 in fees and I also asked for interest and costs (ie. postage fees!). I assume I now have to right back with a letter before action asking for the remaning £20, interest and costs. The only thing I really expect out of them is the remaining £20. I will then be ready to pursue the interest and costs in court. It'll be hilarious taking them to court for just a few pounds! I was refunded an overlimit fee and a late payment fee but not a cheque return fee (from the same day as the late payment fee).

  9. I sent a preliminary letter to ask for the refunding of my charges and have now got a response. Here's the letter I sent: It had a 14 day deadline to respond and was delivered on 19 April. Just got a reply dated from 21 April (received 25 April) and it is just a standard reply to a complaint. Here is a summary of each paragraph: 1. Talks about the Terms and Conditions 2. Then mentions the OFT recommendation to review their levels of charges 3. Talks about commitment to supporting customers in financial difficulty (yeah right!) 4. States that confimation of charges is on the reverse of the statement and these are non-refundable 5. Use Barclaycard website to view transactions 6. Customer satisfaction important blah blah please respond if you need any help etc. I believe the deadline I gave them ends on 4 May. I guess I'm right to wait until this date before I send out a letter before action.
  10. I have taken the draft of the preliminary letter and have edited it. I have been a bit cheeky to request that the cost of posting the letter be included in any settlement! Do you think the letter is fine? I plan on using this letter for my action against Barclaycard and Halifax too. My changes to the letter are in bold. [my address] Legal Compliance Specialist Capital One Bank (Europe) plc Trent House Station street Nottingham NG2 3HX Request for repayment of charges Dear Sir/Madam, ACCOUNT NUMBER: xxxxxxxxxxxxxx My request I am writing to ask you to refund to me the charges which you have levied from my account over the past year. I now understand that the regime of fees which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. Your responsibilities I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. What I require I calculate that you have taken £xxx plus interest. I require full payment of this sum including any interest that I was charged as a result of these illegal charges. I also request that you compensate me for any costs that I have incurred as a result of your illegal charges. To date the only cost I have incurred is the cost of posting this letter to you and this is specified by the Royal Mail postage stamps on the envelope that contained this letter. My targets to resolve this matter I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets. I will give you 14 days to reply to me accepting unconditionally my request in principle and letting me know a date by which I will receive payment. If you do not respond or you do not respond positively within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.   11. Last August I sent a cheque to Capital One to pay off my credit card bill. Unfortunately there wasn't enough money in my Halifax account because a Direct Debit had gone through the day before. On my Capital One statement the receipt of this payment is acknowledged (August 8th). However, 8 days later it mentions a payment reversal together with a return cheque fee of £20 and a late payment fee of £20 (as well as the mention of this late payment on my credit record). Halifax charged me £39 (I was a sent a letter dated on the 9th to confirm this). On my Halifax statement there is no mention of me going into an overdraft (as in a payment being sent to Capital Once) and the £39 charge was taken on August 16th. From Halifax's side it seems as though they never sent any money to Capital One and simply applied a £39 charge on my balance on the 16th. However, on my Capital One statement it says I paid in £138.20 on August 8th but then the payment reversal and charges are applied on the 16th. Is there something fishy going on here? I am planning to claim my charges back but can I get the late payment removed from my credit record? Also, if I want to claim back interest on the charges Capital One made do I simply mention the 8% figure from the spreadsheet? I was under the impression that this was only for use if the case went to a County Court.

  14. Damn this is dragging on. I didn't ask for anything else. Just got the implication that I was told "We've given you the advice now bugger off". Sorry IF I misinterpreted the comments.

  16. LOL It's the fact that I'm claiming a smallish charge from 3 different institutions meaning £30 in DPA letters. £30 is a lot for a student!
  17. I understand that nothing is guaranteed. Just wondering about the chances of getting my money if I put it in a claim. I guess I could add it in a a small claim but what if the bank decides to pay up instead of going to court. Would they also be willing to add the extra £10? Maybe I should just try giving them a call and see if they can give me the manual intervention information for free. Do people think that the manual intervention information is really necessary at this stage? Although it would help I'm assuming I could always produce the argument later should we end up in court (ie. ask them to justify their costs though whether they reveal the information is another matter).

I already know the exact charges I want refunded but I want to use the DPA letter to ask about the manual intervention in applying these charges. However, in spending the extra £10 I want the reassurance that I'd be able to claim it back later!

I also see that the credit card LBA makes a mentions the following line: I calculate that you have taken £XXXXX plus £XXX which you have charged me in interest for the sums which you have taken. Total £XXXXX I know the spreadsheet allows you to work out 8% interest rate claim for my compensation but how do I work out the exact interest I was charged as a result of a particular fee I had to pay?
  20. Just wondering should I go straight for the letter before action or should I send them the DPA letter asking them for details about their manual intervention when applying my charges. I already know the amounts and reasons for the charges but should I ask for manual intervention info to further help any future legal action? Will I be able to reclaim the £10 I spend getting this information?
  21. I've worked out a total of £139 I'm owed and that is alot for a poor undergraduate like myself! £60 from Capital One, £40 from Barclaycard and £39 from Halifax.
  22. Thanks for the response. I forgot to mention a couple of Barclaycard and Capital One overlimit fees I've had. Am I right that the FAQ says that I can claim for these as they are excessive charges?
