I tried to give them a chance to sort out without sending baliffs but no joy at all. I have now applied for my warrant of execution, they left me no choice I don`t understand why they are letting this go on so long as the outcome in the end is always going to be the same. They are really wasting time and money with all the extra cost and charges on top of what the already owe me!!!! Now I just have to sit and wait

I have been through this whole process from start to end and I am now abit stuck. I went to the county court for the final hearing and suprise suprise abbey didnt turn up. The case was awarded in my favour plus cost, interest etc... and abbey had to pay up by friday 16th feb. I havent heard a thing from them and I know I now need to send in the baliffs. The only thing is I am not sure how to go about this as court hasnt advised, all i got was a copy of the judgement. Can anyone advise me how i send the baliffs in????????? :confused:

thanks for advice, I have gone thru the whole process with abbey, just awaiting a court date from them now. I just wasnt sure on the 6 year part as this account withe halifax was closed by them in 2003, aftering taking me to court and giving me a county court judgement for not paying there charges. Hi, I have just received statements from halifax going back to 1998, account was closed in 2003 by halifax after taking me to court over charges. I have gone all the way through the stages as set out in this website. I have filedmy claim no. 6QZ58335 Total ammont is £5197.74 + costs £250 I have received a 'letter without prejudice' from abbey offering me half plus court costs totalling £2848.87 I'm not sure what nest stage is. I have received letter from courts saying this has been transferred to my local court and received a allocation questionnaire. I am very tempted to accept offer as not sure how to proceed and worried if this goes to court I will not be able to prove my point and end up losing Any help would be great!!!!! I have just emailed his to solicitor, so fingerscrossed, does anyone know if i need to post to the court aswell as they haven`t asked for anything. I presume abbey solicitor is the most important one.

I have received a letter from abbeys solicitor this morning asking for proof of these charges, although I have already sent abbey a list of dates and amounts It shows how much notice they have taken of my letters. They also state I have to send a copy to the courts. Can someone plase advise me the best course to take now?? Thanks sufos :confused:

Just an update, I filed my claim thru moneyclaim and it was issued to abbey on 29th august for the total of £5447. I have heard nothing from them at all!!!!!! is this normal Sufos

Hi, I have been through the whole letter procedure and abbey have advised hat there charges are lawful and they will not refund any charges. I have given them enough time and am now going to complete court claim. I am not sure of what address etc.... i put on there for abbey. Can anyone help????????????? Thanks Sufos:-| :-| :-|

Hi, I am also in the same boat with abbey, My total with iterest adds upto £5600 I have already a started my process and have received a letter from abbey giving me £50(what an insult) the letter also states they believe their charges are FAIR and iline with other banks. The also stated in the letter they would not make anymore refunds to me,, Is this just tactics to try and stop me pursuing???? Where should I go from here?
