  4. How did they lose, do you know? and what happend? Did they follow the process? Did they have a court appearence? are these the only failures we know of? Chris

Hi Guys, This reclaim thing has been going on for a while now (I'm not sure how long, maybe someone could enlighten me?) but has anyone acutally tried to fast track these claims, ie. skip a process or two? Its just seems to me that because it has been going on for so long and people always (correct me if i'm wrong) get their money back, and never (again, correct me if i'm wrong) end up in court, and it is illegal for banks to charge this much, why people havn't said "I want my money! I want it now! I will go to court if I have to, and you will LOSE!" Is this what we are saying already but in a polite manner and over an extended period of time? I hope some has some ideas of what we can do to speed up the process, my last reclaim took from August to February. I will now hand over to you for your thoughts.... Thanks Chris
  6. Thanks thats what I needed to hear! But is it true the NO BANK...NOT ONE has entered the court yet? I understand that it would probably open the flood gates if it hit the papers but i'm not an expert on this, do they really not have a leg to stand on? Is there no chance of a legislation to be put in place? Chris
  7. Hi Guys, I think I'm coming to the end of the line on this but I want to confirm what happens (usually). I have a court date set for the 28th Feb and from what I've gathered from all of you guys' help.... Shortly before the court appearence, Barclays will contact me and settle with the full amount to avoid making the court apearence. Is this the usual or will it go to court? How many of you have been to court? Thanks Chris

  9. Ok, thanks! So where and when do I send all the stuff to the online small claims people? I have submitted the claim using the guides from this forum, but it doesn't show or tell me anything about my docs
  10. I've read the section on 5. Money Claim On-Line (MCOL) Particulars of Claim but is states very clearly at the top: If you have not sent a full schedule of charges and overdraft interest to your bank -- then -- stop! - take no further action until you have remedied this. Does this mean I have to send another copy to the bank WITH interest on, or is the original one I have sent with my prelim sufficient? Thanks

  12. Hi, Today is the day when Barclays were supposed to hand over the money they owe, but theyhaven't. I guess its time to do the small claims court thing. Any advice please? Thanks Chris and Hayley
  13. We've done the normal process upto now, but wern't sure about the 'second chance' type letter. I guess we just wait out the time and then go to small claims

  15. Hi Guys, From what i've read previously, this seems to be a little different to what everyone else has experienced. If it is, could I please have some advice? If not could someone please let me know what to do next? We were made a offer of just under half the amount claiming for, then we sent the refusal letter and this is what came back...
