  2. Thanks London. I actually got the draft directons from the library but there isnt anything I could find about the following. My 14 dates are up by Thursday so getting a bit concerned. c) A statement of evidence of all matters relied upon as tending to show that the charges are unfair

  4. I have now received a letter from their solicitors Blair, Oliver, Scott. Should I just write to them and continue to pay the 1% as agreed over the phone? Will they continue to add interest?

Hi could anyone please advise what I need to send to as stated in my draft directions (see below) to the court and defendant (Halifax) For straightforward bank charges claims where you are the claimant: c) A statement of evidence of all matters relied upon as tending to show that the charges are unfair
  6. I have sent my AQ and draft order for directions. I am not sure what I need to send to the court and halifax. I am okay with a) b) but not c) It says a 'statement of evidence' on the directions. Can anyone please help me with that.

    apparently not. He applied for a card (by post) was turned down and then this card just turned up. So I am a bit suspicous but I dont see how you can prove it if they have sent what is enforceable. All they need do though is type in your name and tick the box. Very crafty.

    Thanks Vint. I had a look at an agreement the same as this one and it said it was enforceable. I think because it was online (although I think it has been hashed together as he never applied on line) it is all okay. The prescribed terms are not on the same page as the signature (x in this case as it is online). I dont suppose there is anymore that can be done is there?

  10. Thanks for that. I thought they had to supply a signature up to a certain date but couldnt remember where I had read it and what the date was. The agreemnent in question is June 2006. Does anyone know what date it was up to from the 2004 on line digital signature that they had to supply an agreement as well for you to sign.
  11. I know the date for an online agreement is 2004 and that the cca can have a tick for a signature but I thought I had read on CAG that they also had to send you an agreement to sign. I think this was up to a certain date but cannot remember the date. The agreement I have (my son's) is June 2006. Any one help please. Thanks.
  12. What is stopping some of the credit card/dca's sending online credit agreements when you ask for a cca? All this seems to consist of is a tick in a box instead of your signature. Do the other applied terms have to be on the agreement, credit limit, payments etc, None of these are on the two agreements but on the first one it has a box which is ticked for a signature but no other terms? I dont think this card, which is my son's was applied for online - he actually sent for a card they turned him down and this one, compeletly different card turned up in the post.
  13. My son applied for the MBNA cca. He has recieved the attached. On one of the pages it has a tick in the box for his signature? He says he didnt apply on line so not sure what this is all about. Would be very grateful if someone would have a look at it. There is another agreement but this says to keep as my copy nothing on it though, signature, amount, etc.
  14. Thanks everyone for the replies. I dont think the cca would be of any use in this case as I applied on line after 2007 so it would be digital signature? I didnt get a notice of assignment though so I will follow that one up. I suppose they will just send me one and then I will have a fight to get them to agree to the 1% for the year plus no interest. If they take it to court they wouldnt get anymore so I cannot see why they are insisting on the I&E.

  16. I rang the above to agree to a 1% payment of the balance of my credit card as one of my other cards had agreed to this for a year. They will withold the interest for this time. They agreed on the telephone and never mentioned sending in a Income and Exenditure form. I sent one originally with my first letter but didnt go into detail about mortgage payements etc. Although they accepted the 1% on the phone a dca has now written/telephoned me saying they wont instigate the agreement until I have sent a I&E from a recognised debt counsellor. I cannot see the point of this other than they will then know what mortgage payment I am paying and that I have a house. Does anyone else think this is what they are after. Problem is I dont want them to keep adding on interest so a bit concerned as the debt will go over £5000 shortly with all of the interest they are adding.
  17. Halifax have sent me a DN and TN and the DN didnt give enough time to remedy. I am at the AQ stage for charges of £900 and their default is requesting £108 which again is recent charges as I can no longer use the terminated account. I have received a letter from a dca today. Should I send them a letter any suggestions which one? Or should I just wait for it all to come to court but I am a bit sick of the dca contacting me by phone and letter. Any suggestions folks?
  18. Need to send of the AQ and draft directions tomorrow but not sure if I should leave out the information bit see above thread 88 above. Anxious used this one in her draft directions that Creditcardmug kindly provided but not sure if it would be relevant to mine. Any help would be really appreciated.
