  4. Hi All, Just as a final and rather satisfying note, Lowell has agreed to remove the default from my credit report. Thank you all for your help and advice on this rather trying matter, the help has been great keep up the good work. Knowledge is power use it. Thanks David
  5. hi all, I have just noticed on a credit report that there is an entry from Lowell Finance Default Date:27/06/2008 if they have accepted that the debt is statute bared can I get this removed from my credit report?

I have contacted the Trading Standards who are passing the information to the OFT, they will make the desision on whether or not to investigate the complaint. the lady I spoke to was a in a bit of a hurry to get me off the line and had no idea how to manage a call (in my opinion) definatly needed training.
  7. Just a question for the Legal minds out there, the comment "Your account is not legally unenforceable" which seems strange to put it as a double negative, is this some sort of legal dodge by Lowell rather than saying your account is legally enforceable.

I have copied the mail word for word this is the 1st letter stating that the debt is not ststute bared. ------------------------------------------------------------------------------------------------------------------------------------------------------------- Dear Mr — Thank you for your letter, concerning the above account. Your account is not legally unenforceable under the Limitation Act 1950 on the basis that a default notice was served on you by Barclaycard on the 27th June 2008. Section 5 of the Act mentioned says that following the date when a cause of action arose for payment of the debt, any creditor such as Lowell Portfolio 1 Ltd has a period of six years to enforce such a right to payment. The date of the default notice is when the debt in this matter became due for payment in full and the period from which Lowell Portfolio l Ltd has to enforce their right to payment in the absence of any payments or written acknowledgements being made by you in between this date. We trust this now resolves your query and look forward to hearing from you to discuss repayment. If we have not had contact in the next 14 days, your account will be transferred to our debt collection agent Lowell Financial who will contact you regarding this account. Yours sincerely Samantha Barnard Customer Services
  10. Hi Bankfodder not sure how to add an image here as I cant upload on or paste to the page. But I have some good news, last letter from Lowell Finance Dear Mr Your Account is now closed We have today reviewed your overdue account. We have discovered that Section (5) of the Limitation Act 1980 now applies to your account (this relates to the amount of time passing between now and the time you incurred the debt) and we will no longer be asking you for payment. We will not send you anymore letters and we have now closed your account with Lowell. Yours sincerely Andrew Bartle Chief Operations Officer Thank you so much for your support everyone these guys are real ,they knew they could not do what they threatened and they still would not admit that the debt was statute bared shame they couldn’t have their licence or whatever removed. If anyone is having the same issue with them not admitting to the debt being statute bared stand your ground they know they are in the wrong, go back at them with threats they know you can enforce.
  11. thanks, its a big relief knowing I have some one on my side, the guys at the CAB were a big help but having support from this form seems more personal and will also help take the pressure of me and my wife, cheers again ill post again when they reply.

I will remove the under secretary of state. one last thing Im not sue if I should include this or if they would try and use it against me, but my wife has just been diagnosed with lung and liver cancer and is in a hell of a bad mental and physical condition, if they do pursue me further I will mention this to Of Fair Trading, The Financial Ombudsman Service, Trading Standards and my local MP. or should I not presume these people have feelings.
