  4. Hi Don't know if there is anything I can do about this but basically I attempted to pay the Penalty Charge after I got issued with a PCN recently. I was surprised to receive a NtO from the LA as I thought I had paid it. When I checked back through my computer's history I could see that I had visited the LA website and gone to the payment portal and tried to process the payment but it must have failed. I realise that I should have checked to see if the payment went through but I was hoping that if I could demonstrate that there was a genuine error on my part, someone might be minded to allow me to pay at the discounted rate instead of having to pay the full amount now due since the NtO has been issued. I tried emailing the LA parking appeals department, with a screenshot of my history page but I haven't received a reply...am I barking up the wrong tree, or should I just hold my hands up and pay the full amount? Any ideas? Thanks in advance H
  5. Thanks for the reply Would you not agree that because the signage was not compliant there may be a problem with the TRO and this would make the PCN invalid? I know the other things I mentioned are not, in themselves particularly compelling, but the cumulative effect of everything might be enough to carry the day. I'm going to give it a shot anyway and will let you know how I get on, Cheers H
  6. Hello all I am planning to appeal a PCN that was issued in Lombard Street in the City after my vehicle was spotted on camera stopping on a double yellow line with kerb flashes. I have sent a letter detailing mitigating cicumstances, i.e that I had stopped there to get my bearings having turned in to this street to get out of the main flow of traffic to avoid causing a hazard to other road users. I pointed out that there were other vehicles parked in the road at the time I stopped (which are visible on the footage I have seen of the alleged contravention). The presence of these parked vehicles led me to believe that a restriction was not in force at the time I stopped, and crucially, as there were no signs visible giving specific information regarding the parking restriction (eg. times that it was in force) I had no information on which to base my judgement on whether it was legal to park or not. These representations have been rejected. I have looked on Google Maps street view, and it is possible to see such signs, but they have been fixed to walls and other objects at apparently quite long distances apart. I know that there are strict rules regarding the placing of these signs and I think that these are not compliant. I am going to use this as the main plank of my appeal, so I would be grateful if anyone could suggest a way of wording the appeal to reflect this information, along with the mitigating circumstances that I described. I will be grateful for any advice H

Hi I recently got issued with a PCN by a particularly aggressive CEO who, although he saw me standing next to my van and could have easily asked me to move it, went straight for the jugular and issued me with a PCN on the spot. I have been looking at this and I think it is all correct (contravention code, road markings etc) but I am posting up images just in case. I'm sure there are more knowledgeable folk on this forum who can enlighten me and I would be very grateful for your input. Images of the PCN and the road signage/markings (courtesy of Google Maps) below: One other potential line of appeal is that I was attempting to deliver large and bulky items (sheets of plasterboard). I have read that "many local authorities issue dispensations which temporarily override waiting and in certain instances loading bans too. These could be issued to permit heavy loading and unloading that can’t be practically done elsewhere". Could anyone explain how this works? Is it necessary to obtain such a dispensation before attempting a delivery? Thanks in advance for any help/advice you can offer. All the best H
  8. Hi again There was no ppi on the accounts and I think I sorted out most of the penalty charges and got them refunded a while back. The cards we taken out around 2006/7 I think - just to reiterate, the one card that has been defaulted is the one for which, so far, they haven't been able to provide a copy of the original agreement. I am anticipating a second default notice for the other card at any time and would like to head this off if possible but it appears from what has been said so far that this is something of an inevitability, unless I agree to 'cough up' of course....
  9. Ah okay - well it was worth a try I suppose. Thanks for the info. Just for the record I don't habitually shirk my responsibilities when it comes to debt, but the way these companies operate makes them fair game in my view.
  10. Hi All Sorry if this information is already available on the site but I have looked in countless threads and can't seem to find anything that relates directly to my situation, which is... I had two credit cards from Capital One which I had been making regular minimum payments on for some time. I had a little patch of financial difficulty and decided to see if I could avoid making payments by making a formal request for copies of the agreements under CCA. Incidentally I am completely outraged about the blatant [edit] and [edit] carried out every day by the financial[edit]and banksters in the City and on Wall Street. On those grounds, I feel it my right, almost my moral duty to evade payment if I can. That aside, I sent the requests back n the beginning of February and they replied with a letter stating that they would not provide anything to me without a signed request. I pointed out that this was not a requirement under the Act in the meantime the 12+2 days came and went so I sent them a follow up letter stating that they were in default of my request. Of course, true to form, they ignored this and so I had lots of Philipino call centre staff on the phone to me at all hours trying to get me to make payment (which obviously I declined to do). Finally they sent me a barely legible photocopy of an agreement for one of the cards (copy attached) on 3 May. This does appear to be signed by me and them, but the Ts and Cs are in a miniscule font which is impossible to read properly. I have attached a scan of this as it is possible to blow them up in a .pdf reader and just about make the text out. They also said that they had already sent these documents on 12 March, but I didn't receive them, and even if I had, this would have been outside of the statutory time limit and would have placed them in default of my request. I am still waiting for a copy of the second agreement but they have now sent me a notice of default on the first card and (oddly) a statement of default on the second card (the one that they couldn't supply an agreement for) and now have referred the latter alleged debt to a DCA. I contacted the DCA and explained the situation and they have graciously agreed to suspend 'action' on the account for 15 days on the condition that I contact Crapital One again and request the copy of the agreement (again). Could anyone suggest how best to deal with this? Also if this debt is unenforceable without a court order are they entitled to place it in default, and if not, can I have the default notice removed from my credit file? Thanks in advance for any advice and apologies if I have missed this information elsewhere on the site – if I have, a pointer in the right direction would be greatly appreciated.

  12. Okay Ive had a look at the bay and I think it is not compliant with the parking order. I have attached some pics and the text of my appeal - would appreciate your comments and or any amendments that you feel might be necessary... Appeal text: I am appealing the pcn on the following grounds: The roadmarkings delineating the bay do not conform with the Traffic Signs Regulations and General Directions (TSRGD) 2002. The double white line at the end of the bay is not a permitted variant of diagram 1028.4. These should only be used where single bays are marked out, as in diagram 1032. Attached is a photo of the bay as evidence of this point (IMAG 0620). Furthermore, all parking bays must be accompanied by a sign (except in certain circumstances in a controlled zone). Where a bay is long, it must contain repeater signs at regular intervals. According to the guidance in Chapter 3 of the Traffic Signs Manual (page 69), signs should be placed a maximum of 30m apart. I have attached a photo of the South end of the bay (IMAG0620) and you will see that there is no sign here at all. If you look at the image from Google Maps and compare this to IMAG 0620 you will see that there was a sign there before but it is now missing. The nearest sign to that end of the bay is at least 30m away (as evidenced by IMAG 0621) therefore the bay does not conform to the guidance(s) quoted above. Given that the bay is not compliant I trust the PCN will be cancelled. Images below: IMAG 0620 IMAG 0621 Google Street View: Just to explain - the sign in the Google street view image can clearly be seen outside the 'D&A' opticians shop, but in the later photo of the same spot taken by yours truly (IMAG 0620) this shop has now become 'Boots Opticians' and hey presto the sign has vanished! The NatWest around mid-shot in IMAG 0620 is just visible in IMAG0621 in the left of the shot, which hopefully gives some idea of the distance between the end of the bay and the first sign, which can be seen attached to the lamp post outside 'Superdrug'. It's a good distance away from the end of the bay but not sure if it's over 30m as I haven't measured it!!! Thanks in advance for any advice All the best H
