The jusge has put it to a hearing date (should be sometime in July) and bypassed the AQ stage. I have to get the evidence to the court and to HSBC by 7th May. Will HSBC enter evidence by next week and hold on till july or will they more than likely settle by next week? Privatex77

Hi, My case has been moved to a local court to myself. I rang them up and asked about the AQ coming to me as i though it would automatically come with the gumpth they send. Anyway they told me that it has to ben seen by a judge first to decide whether an AQ should be sent out. Is this normal practise? The date order drawn is 27th March. would my 14 days to fill in an aq start from here or when i get sent the AQ? Muchos Gracias Privatex77 -
I would change banks and stop paying. This is what i did and saved myself 1000's although i defaulted on it. I now have a manageable arrangement with dg solicitors which i have kept to. However you have to add it up - default or pay 1000's. is up to you but i'm better off for it. I'm not giving advise just telling you what i did. I hope this is of some help.

Thanks, that is helpful however i need to know as they have acknowledged and since put doewn they will defend, should i ring them to see if they have receieved the schedule of charges. Plus i need a phone number and contact names within DG if anyone can help 8) -

Afternoon All, Just would like to brief you all in what is happening in my case. I have a closed account with HSBC which amounted £804 in charges in the last four years of it being open. I still am paying off a loan with them via DG solicitors and haven't missed a payment with them (only £600 to pay). I sent the normal two letters and gone through to MCOL and processed a claim which they put on the website yesterday that they intend to defend. I know that i will have to fill an AQ form and know there are links for this. I forgot to send DG my claim schedule however did send it to the courts, would they still recieve a copy from the courts, if not would it be worth my while ringing them at DG to check whether they have have the schedule and me to fax it over so hopefully may speed things up. What do you all think? -

I am confused. The Date served is 2nd March, The date acknowledged is 28th Feb (and they intend to defend). What Date do i take the 28 days from? Regards Privatex77 -

My MCOL claim has been filed today and i was wondering about the time period now. I have looked on this site and have anything from 14 to 28 days can someone please break down: How long they have to acknowledge the claim? How long they have to put in a defence? Any other time that i have to put in. -

Surprise, surprise. no response after the prelim letter. They have until till tomorrow until the 14 days is up. LBA ready to go so just a plain waiting game now. Out of Interest do you know how much the MCOL is going to cost for 804 or as close to? -

I also have a managed loan still open and which is being looked after by DG solicitors. I have put my Prelim letter to HSBC last week and specified that i would like the payment made to me in cheque. I have not missed a payment with DG solicitors since first contact and although the amount i would be awarded will finish the loan. HSBC conned me into the loan to cover my OD only - they never mentioned what the conditions of taking the loaAN WERE LIKE. from a 1250 OD i will end up paying them around 2K at least. They are like the mafia with money. Surely this has to be illegal - HAS ANYONE CHECKED ON THIS?

Can i change this thread to read Closed Account ( NOW IS Evans v HSBC) I have 7 days to wait before i send my LBA. Doubt if i will recieve a letter off them. I haven't recieved the contract of the managed loan since i requested it, this has now been nearly four weeks. Can i take any action? -
I recommend that you pay all or majority of the managed loan off. this loan restricts you to a solo card, no od facilities and no chance of a mortgage or loan with the bank. The other way will to open an account with another bank and just pay them monthly. The other bank will not disciminate you for the managed loan as they shouldn't really know about it!!!!!

I had the same problem and the account is being dealt with DG solicitors. I have now no interest to pay and as a result paying off 60 a month reduces the figure sharply each month. I don't recommend this way as you will have defaulted on your credit, however if your credit is as bad as mine then it probably doesn't matter. It's up to you but the interest is ridiculous on the managed loans and they have you properly until it's paid off.

I asked DG solicitors for the Loan Agreement via the phone and have a letter from the 7th August stating they have asked HSBC for a copy of the agreement. I need to know two thinkgs really: (1) How long do they have before they produce the document? (2) If they can't produce the document what happens next? Regards Privatex77 -

Hi all, I closed my account with HSBC about 15 months ago. They charged my account monthly for years, can i still claim those back. Also the Managed loan i was 'persuaded' into is still in the hands of DG solicitors and i regularly pay them and haven't missed a payment since contact. Can i try and get my money back from the previous missed payments from this loan? Any help is appreciated. If i can continue i will keep up to date on the forum. Cheers Gav
