  1. Hi. I currently have a joint mortgage with my ex partner, we split a couple of years ago and she stayed in the house and i paid child support and a third of the mortgage because she could not afford it on her own. She took out an unsecured loan and didnt repay it so she got a CCJ and a charging order was placed on the property which she gets hassled about frequently. She is paying about £10 a month. I now need somewhere permanent to live and cant afford to keep paying what i'm paying so she is going to move out and i will take over the house. I am now paying the whole mortgage and she is looking for somewhere to rent. I have the forms to apply to change the terms of the mortgage and a solicitor will charge me £270 for the legal bit. The house is in negative equity. Will the charging order prevent me from taking on the house in my name only? The mortgage company said they "think" that will be ok but cant say 100% as credit checks need to be done, but the solicitor i spoke to thinks that The debt on the order will have to be cleared first. I am taking on a lot of joint debt already so dont want to have to pay this as well. Has anybody else been in this situation? My ex is unlikely to pay as she says she cant afford to and she was happy to let the house get Repossessed but i dont want that as i will be chased for the outstanding debt anyway. Any help or advice is greatly appreciated. Thanks, Slick
