Hi Wilmurr, Just to let you know that as we were at the same stage at submitting LBA and going to court that the Halifax have settled mine today, (leppo v halifax) so hopefully yours will not be to far behind!!! Keep going and good luck!!

:DI'VE WON!!!!! Thanks to everyone on this site who has given advice, some without even knowing it just from reading other threads and gaining knowledge! Checked account on line today and every penny including interest and MCOL costs have been credited to my account!!! Quite a shock after getting back of hols and reading letters I had been sent as per yesterdays update. I'm of now to donate to this site and fill in the bank charges survey, hope this brings hope to alot more people like me to claim back what is theirs, GOOD LUCK!!!! Just one last quick question before I go, do I need to do anything else from here such as inform MCOL etc? or do I just go down the pub tonight and celebrate!

Hi all, back of my hols so am just updating everyone as to the latest situation. Claim issued on 17th Octoer and halifax have aknowledged the service of this claim on 20th October stating that they inted to defend in full the claim, so this gives them 28 days to do so (17th November) In the meantime I have two letters back, one thanking me for my letter, the other for my telephone call ( I have never phoned them!?) stating that they offered me full and final settlement of which I would only accept as partial settlement and that they would not be refunding the full ammount and stress future charges will stand and reserve the right to close my account if I do not manage it correctly. ( I reserve the right to open another account elsewhere and close this one when charges have been returned!) Speak soon!

Hi all, Latest update. Still no news back from Halifax other than offer which I wrote back saying I would accept only as partial settlement, and as there time is up I have just completed my claim on MCOL and been able to add a further £181.79 interest to the overall cost;) Waiting to see what comes back from here. just a couple of questions though if any one can help. Within the particulars of claim it states that the defendant is aware, as a list of charges been claimed has been supplied and another copy will be sent. Do i have to write again to the Halifax and if so saying what? I am going away tomorrrow evening for 10 days and am worried that if anything comes back and I have to reply within a certain time scale I will not be around to do so, is this likely?

Hi Willmurr, Sounds like we are about at the same stage, my LBA was posted on the 2nd Oct. Have received the "4 week" letter and just last week received offer. Sent letter back yesterday accepting this as only partial payment but still pursuing the lot! Godd luck with everything!!

Hi all, Letter received from Halifax yesterday with all the usual, sorry..., sould manage your account better...., etc and an offer as a gesture of good will for full and final settlement of £704!:-| Will write back later today saying thanyou very much, will accept this as partial payment only but will still be pursuing full ammount (which has gone up £28 by the way) and time runs out following LBA on 17th October. I'll keep everyone informed as i go!!

Received a letter Saturday saying they are sorry to hear etc etc and will formally reply within 4 weeks. Never mind, 14 days are up and LBA posted earlier today!

Prelim letter sent recorded delivery this morning, lets wait and see what comes back?

Hello everyone, on my way to the post office following my last post my wife rang me with the news that Studio had wrote saying "should have paid in time, currently looking at there charges, etc etc but as a gesture of good will and without predjudice thay enclose payment and settlement in full of all charges claimed!!!! Thankyou to everyone on this site who has helped me with queries and questions I have had, my donation has been sent!!

Latest update, I have been busy at work and home so have not had the time to sort everything out and i have also been waiting for a couple more "charges as notified" to appear on my statements. I have now scheduled out all my charges so letter will be going of today if someone could just answer me one quick question? I have had a letter stating that i am over my overdraft and will be charged £28.00, and this will be taken out of my account on 31st October. can i include this as it has not gone out yet although i know it is going to or not?

Just to update people after no response what so ever LBA has been completed and will be sent recorded delivery later today.

Remaining statements turned up this morning via recorded delivery after my little prompt that the 40 days allowed ended on Monday!! I will work out all the charges over the weekend with an aim of sending of my prelim letter on Monday. Guess this is now the interesting part!!

Just to update, i'm going to leave this account in the background for now and pursue it later once i have Halifax and Studio out of the way. I'll keep every1 posted as to when i return!!

Thanks for the reply jonni, to be honest i think in my own mind i had decided to leave it and just go for the charges and the 8% interest when it come time to file my claim. Thats if i get the remaining statements i'm waiting for!
