  1. Anyone got a link to a sample letter to court to stop the claim on the basis of a settlement offer? I've searched the template libraries and can't find one :S
  2. Phoned up yesterday - told that there's a settlement letter in the post to me.
  3. Ok got the letter last week (tuesday 16th) so i phoned up the number given in welshman's thread to speak to the Barclays legal guys. He took my name, claim number, contact number and said he'd call back. Before i got off the phone I made sure to tell him that I had a court date of 2nd feb. Haven't heard anything back yet (that was a week ago I phoned him) I'm very conscious that hassling them isn't a good idea - every minute spent on the phone to me is one minute less settling someone else's claim. But on the other hand if it looks like we're going to the allocation hearing I want to book the time off work. So should I call back? It was Anthony Lombardy I spoke to.
  4. Right I have a date... For an Allocation Hearing - Friday 2nd Feb. The letter went to my home (not work) so just had it read to me down the phone. Basically it says that the allocation hearing will be to see if the claim is stayed pending a Test Case (If woolwich can provide details of a test case in progress) or failing that it will proceed as a test case against Woolwich. Anyone else had this happen before? I don't have the full text of the letter yet - any advice?
  5. Paddy - aye I wasn't expecting anyway to guess the court date - just wondering if anyone knew how soon is normal to get notified of what the court date will be. Read about phoning up barclays legal - Welshman put up a step by step that was easy enough for even me to follow
  6. OK the AQ has gone off (it had to be in for 1st Jan) Cheque for the fee cashed 4th Jan. So just waiting for a court date (at Ipswich County Court) anyone know roughly how long it takes to get a court date?
  7. I shall be looking forward to the AQ in the post. The total has just ticked round past £3900 so far - at this rate it will be £4k before they pay. And they could so easily have just settled when it was £3k...
  8. And the latest update! They entered a defence today, on the same day as I entered my request for Judgement by Default. Oh well, guess it's court allocation questionnaire time!
  9. Cheers Allyxia - ironically I served them at their Watling Street address, then wrote a letter to the same address to let them know of the court action. They replied to my letter saying that all correspondence should be through Barclays Head Office Customer care....
  10. Exactly what has happened! They acknowledged on the 28th, which is exactly the same day i was putting in for my Judgement by Default. Oh well. so it's another 14 days to go, guess the money will be a new year sales present not a christmas present!
  11. i'd much rather if they didn't bother with entering a defence - but that's just because my boss will kill me if i get a court date! (I won't have a problem getting time off to go to court - but he won't be pleased)
  12. just to update - the court claim is now filed - it states it as being served on the 14th, so I have to wait until the 28th to do anything. I'm *really* hoping that woolwich/barclays are far too busy to get round to responding to it...
  13. MCOL filed - really was surprisingly easy well it was once i started paying attention - i started the claim off by filing a claim against myself. which is slightly embarassing...
  14. Cheers Michael right - no reply to my rejection letter so today I shall mostly be filing my MCOL!
