  7. Hi there Thanks for the congrats. I suggest you read through all of the information on the website - there is a faq's that you need to read through- it will really help you if you do that first. Incidently, DPA stands for data protection act. Janna

I have already been listed in cases concluded - and as soon as the cheque clears will be making a donation ( have already mentioned this to dave - forum mentor) I received notification that they were going to defend in full - and with about a week I got a phone call to let me know they were going to settle. So anyone who has received the intention to claim should be getting a phonecall/letter/cheque v.soon. Although they did try and pull a fast one - stating that I had to have the cheque paid into my halifax account (?) Obviously I refused - stating that I wanted it paid by cheque ( I know they would have taken their overdraft back and recent fees otherwise). I got the full amount of my claim paid back, including court costs.

I do have another thread - £189 bank charges in 10 days but just had to post a new one so that those of you that don't have the time to read thru all the posts know that it your hard work will pay off - follow the guidance on the site and you will see.   10. got my cheque today - with a letter admitting no liability. They claim it's not worth going to court blah blah blah - because it will cost more for halifax to defend their claim in terms of legal costs involved (mmmmmm) - surely if they were in the right they would defend the claim, even if to prevent other claimants taking the same action. Anyway, I'm happy - and with this additional information I will be starting my new claim with my credit card - I obviously have nothng to lose. Have a great day everyone - I will be janna
  11. Just a quick question if anyone can answer ( please) Now that the Halifax have decided to return my money, what can I do about theasdverse credit that has been placed on my credit file. I have defaulted on my mortgage, and my credit card. and have had this placed on my credit file. Am I able to do anything about this now, or is it too late ? - as it was not detailed on my claim form. I don't want to settle the claim knowing that I could have done something to repair my credit file. Thanks janna
  12. Thanks - The credit card is my next move - now I know what I'm doing it makes things a lot easier. I will be interested to see how they react to me this time - knowing that I am prepared to take it all the way........watch this space
  13. Just a quick note to let you know that the Halifax called today, and have agreeed to settle out of court. They say they admit no liability and that a cheque will be with me for £3.2k next week ( although their cards are still marked until I get it) They have been very difficult and obnoxious to deal with. Trying to wear me down, offering me ridiculous amounts to settle as full and final settlement, imposing conditions on the settlement - and basically calling me incompetent and irresponsible for not managing my account 'properly'. Just remember, it's their job to makes things difficult for us - but in the end they know they can't win. So keep going everyone - it is not easy, and can be a bit disheartening at times, but in the end you do get your money back.
  14. I got the exact letter about 2 weeks offering to settle fo nowhere near to what they owe me. ( they made 2 offers overall) I also refused , and am off to the county court to put in my forms first thing in the morning.....
  15. sorry - don't think I explained it clearly. They sent me a form downloaded from their internal website - I can send you this copy if you are able to make it available to others to download, as I have photcopies it ( I'm not very technical, so not sure if it's possible).
  16. Hi there Not sure if this has been mentioned already - if it has sorry.. But I was thinking -rather then sending in a DPA request, that by using the DPA request form and handing it in to the bank with the £10, it will get the ball rolling straight away. The form states that it can be handed in to any branch - and if you hand them cash - the receipt will be proof of the DPA request? So they can't stall you or hold on to the cheque to delay things! I have a copy of the form which has been simply downloaded from their internal website and posted to me - so if there is a way in which the site can make this available for others to download - let me know and I;ll send it too you.   17. Well I sent an email last week, giving them 7 days to reply, to refund my charges in full and they have not. I specifically asked them to email me back, as due to the nature of my work (NHS) I cannot receive phone calls on my mobile - which seems to be their preferred way of contacting me. I have received no email, letter or phonecall - so I have started my proceedings and hope to have it all filed etc this week. Any ideas what their angle may be? or do you just think they're waiting to see if I'll carry on with the court action?
  18. Hi there Just wanted to add, that ms valentine was one of the most obnoxious people I have had to deal with. You'd think it was her money and not mine. She had already decided that she was not going to negotiate - so I really did n't see the point of any response from her at all. She has n't even responded to an email I sent her over a week ago, and was quite rude when I asked for her email address. I suspect I will receive a similar letter from the Abbey in due course. I too am continuing with proceedings.....

  20. Good Morning I have just received my letter from the abbey credit card (MBNA) , confirming that they will be sending me a cheque for £750 within the next 10 days. It also includes a ton of paper detailing all of my transactions with them - so that I can confirm the figure is correct. ( if forum what a copy of letter, let me know) It is quite a nice letter, obviously not admitting any wrong doing, and stating that they are making the payment as a 'goodwill gesture. I must say, it has been very pleasant dealing with them, as oppose to Abbey who are being pains in the a*#e, for a sum that I believe is less than MBNA have refunded. It's such a pity that all institutions are not as polite and straightforward as these have been, although they'll probably never give me another credit card. Oh well.... Bookworm apologies for posting twice - yes I realise it was unanswered, but the reason why I posted again was not for this reason, but because I did n't know if GE Capital counted as a bank or store card and so was n't sure whether I posted in the correct place! ( as I have mentioned) I have been a member quite a while, so do understand how it works, but with all the changes to the forum, it can get a little confusing. So I hope you too can understand this. The reason why a lot of my posts have some sort of an apology to the moderaters somewhere in them ( for fear of being 'told off'.) is because I try to post carefully, and not ask ask already answered questions. So thanks for 'blasting ' me, - I'll endeavour to ensure that I post approriately in future.
  22. Thanks for the reply. Yes, i sent both letters by recorded delivery, and they were signed for. Do store cards come under the same regulations as banks - as although it's GE capital bank - is it classed as a bank or finance company?
  23. Hi there i have posted this inder other institutions, but have n't received a reply yet. I appreciate that you are really busy, but I really need to know what to do whe you have not had any response fromDorothy Perkins Store card(GE capital/money) and you do not have a figure for the amount owed? I am approaching the 40th day, and have nothing from them. I have sent them two letters, and if I am to stick to my action what can I claim for? how will I go about it now? any advice would be appreciated. I apologise if this information is elsewhere on the forum, but I have n'rt been able to locate it.
