  1. Milly, you stay strong, give all your love to that beautiful little girl, you can't put a price on that. I'm in all sorts of trouble, endless loans (secured and unsecured), juggling so many balls I've lost count, but we have to keep going, I have a grown-up daughter and a grandson, they are my heartbeat and need our love more than any money in the world. Thinking of you and sending strength
  2. I have a secured loan with Welcome Finance, wrote the first letter from templates on here to say I feel I was missold the PPI, they replied that this was not their concern, it was with 21st Century Finance who arranged the loan, so I wrote the same letter to 21st CF. I have had this reply: "The policy was sold on a non-advised basis and you were given information only in order to decide whether you would like to proceed with the policy. You were informed verbally that the insurance was optional and this is shown on the credit agreement and also on the quotation. We provided you with a policy summary and document which clearly states the benefits and exclusions and this is confirmed on the credit agreement which you signed. I have enclosed copies of the credit agreement, demands and needs and quotation for your records. If you are dissatisfied with my response you have the right to refer the matter to the Financial Ombudsman Service ..........." Most of this is untrue as a representative called at my house with papers, said "sign there" to the documents and was gone in 10 minutes, but how can I prove this? Thanks for any advice.
  3. Can anyone help, please? Daughter has had £99.99 deducted from bank account, transaction was to DLC Limited last week, transaction on statement gave a telephone number which, on calling, reveals recorded message 'this voicemail is full, no further messages can be taken'. It's a Swansea number, I've searched on internet, DLC Ltd is listed as being in Swansea but no info on what their company does, daughter has very little money and certainly hasn't paid that amount to anyone. I've seen on here that there is a DCA called DLC, however based in Northants. If I'm unable to reach anyone on their telephone number, how can we prove this is a fraudulent transaction, guess we just have to hope fraud department of bank believe us and refund her the money? Any advice would be welcome. Wish I could visit these people, have traced their address on web, but we are based in south east England, so no hope of that.
  4. Congratulations! Can I ask how you managed to convince them to pay out as all claims (including mine!) seem to be on hold due pending the test case ruling next year. Well done, you!
  5. Has anyone else read the article today concerning 'hardship' cases? Marc Gander from this Group is quoted. I'm hoping to pursue this. Thanks to Halifax slapping over £1000k on me in charges over past 6 months, I am unable to pay my mortgage this month, have hit a complete brick wall, Halifax won't allow me an overdraft and my claim is on hold pending result of test case, similar to many others on here no doubt. Opinions on hardship cases, or any experiences, please? Sending positive wishes to you all Serajen
  6. Hello folks, any advice please? I need to leave Halifax immediately, they've slapped £900+ charges on me in past 6 months and I'm crippled. Want to open an account with someone else tomorrow. Asked at HSBC today, to see what documents they need to open an account. They say they want bank statements from Halifax; once they see all the charges will they deny me an account, do you think? Thanks for any advice on this.
  7. Thank you so much for this advice. I am going to trawl the banks tomorrow to try and open a new account. Halifax have slapped £900+ charges on me in past 6 months and I'm crippled. Visited HSBC today to ask what documents are needed to open an account with them, they want statements from my current bank, once they see all the charges will they refuse me an account, do you think?
  8. Hi there In light of the OFT case, do you think that the banks are now just storing up charge reclaim requests until the outcome? I sent my initial request for £701 to Halifax 2 weeks ago, have heard nothing. Should I follow up or is it just falling on deaf ears at the moment, pending outcome of OFT? Thanks for any advice
  9. Sent my LBA to Littlewoods Personal Finance (a credit card) on 3rd August and received following reply: "The charges added to your account due to its non payment were applied in accordance with the conditions of use that you agreed to be bound by when you signed the agreement for your Littlewoods card account. We trust this clarifies the position". I'm not sure how to reply, can't get my head around the correct response and would be really grateful if anyone could help. Thanks so much Jenny
  10. Sent my preliminary letter to Capital One and they've replied "it's going to take a little while to look into your situation, we'll do everything we can to get an answer to you within four weeks of this letter". Do I stick to my timetable and do Letter Before Action, or do I give them their four weeks, please? Thanks for any advice. Jenny
  11. Thanks everyone, I won't give up, am just feeling vulnerable as there are more charges being applied daily at £39 a throw and I thought funds would be in account by now. I guess I have to start claim number 2. Why do they make our lives so difficult? But WE WILL OVERCOME. By the way, it's a Littlewoods credit card that I'm claiming against, as well as Citi Cards and Capital One. Here's looking forward to popping some champagne in the virtual pub when I have some money and a donation to this site is a must. Everyone and everything on here has given me the strength and impetus to take these guys on, they mustn't get away it, so let's stick together.
  12. Thanks so much for your reply. These financial institutions (I'm fighting Citi Cards, Capital One and Littlewoods too) push you so far down that sometimes you wonder if you have the strength to get back up. I hope there's an official ruling against all these charges soon and justice is ours. Thanks again for your support.
  13. Hello gang Am claiming £760 from Halifax, had all my statements at home, sent LBA and had an unexpected phone call from them on 2nd August to say they would settle in full. I was over the moon. They sent an acceptance form, which I duly signed and returned, recorded delivery, on 7th August, fully expecting this would be with them on 8th and money in account anytime now. Am tracking recorded delivery number and damn form hasn't been delivered to them, have now faxed a copy of my acceptance form. In the meantime, however, I've incurred £145 new charges this week from Halifax, had started writing cheques at weekend for essentials, expecting money would be there by now. Has form gone missing in post? Can I make a second claim? Was so ecstatic last week and now fading fast
  14. Am feeling the need for a rant. LBA sent 13 days ago so I'll need to start claim tomorrow, if I've had nothing in the post today when I get home. I HATE them!!!
  15. Thanks Emma. Have you used the paragraph containing the word 'fiduciary'? Just not sure whether that only applies to banks. Good luck, let me know how things are going. Cheers Jenny
  16. ... but would the preliminary letter to a credit card company (I'm "doing" Capital One and Citi Cards) be the same wording as the template for a bank? Thanks for any advice.
  17. I sent a Letter Before Action to Halifax yesterday, should I be filing a court claim at the same time? I tried accessing Moneyclaim.co.uk, but it didn't work. Can anyone help me find the court claim letter, please? Thanks so much
  18. Hello everyone, I'm new here but definitely a kindred spirit In March this year I asked Halifax for a one month increase to my overdraft (current limit £450) as I knew I was going to run into a period of difficulty, they refused, the outcome of which has been £760 charges in 3 months. My initial letter was met with usual brush-off, I escalated the claim to Head Office, they made a 'goodwill gesture' offer of £397. I refused this yesterday in my Letter Before Action (am now thinking should have taken that money and still pursued claim, so could have made a mistake there). Anyhow, we'll see how it goes. It does feel like David & Goliath, but why should these b******* get away with it? I've been with the Halifax for 28 years and they've never helped me with anything. If £760 comes my way, I'll definitely be making a donation to this site, it's given me the strength to rise up and fight. Good luck to all warriors taking on the Halifax !!
  19. Hello everyone Have just joined this forum. Am also a Halifax 'we charge you xtra' victim. In March 2006 I asked for a £200 overdraft for one month only as I knew I was going to run into trouble temporarily, this was refused, the consequence of which has been £760 charges in 3 months. They've offered me £397 as a 'goodwill gesture'. Having gained some strength from reading this site, I've refused and written the Letter Before Action letter. Feels a bit like David & Goliath, wish me luck everyone, will keep you posted.
