  1. thanks. my claim is £1753.20 before interest.
  2. phoned FOS and advised me that abbey have 8 weeks (from date of 1st complaint) to send a final letter, they will contact abbey to tell them that this letter is still due and once i receive it or the date has passed i can fill in FOS form and they will take it from there!

  4. can some kind helpful person please give me some advice? my claim is for £2081.20 total (including judicial 8%) and i am claiming in scotland. as far as i can tell the only way to go about this is by making a claim for £1500 or as near to without going over in the summary court then claiming the rest after that has been cleared in the small claims court. is this the correct procedure? dont want to start doing this and find out i have it completely wrong. ps i posted this in the abbey section also, just hoping it will lead to some response

    ok. so filled out my charges and added 8% judicial interest, and the online claiming is for england and wales only! gonna have a look to see if there is a scottish equivalent.

    ok. so abbey has completely ignored my LBA. gave them just over 2 weeks to reply, so now i guess i move on to a court order. had hoped to get this cleared up long before now, but there is no point in giving up now!

    thanks knellk, cleared that up a little. sent off my LBA yesterday, the bank so far at least has acknowledged my letters, if not been very forth coming. fingers crossed for this stage.

    abbey sent me a standard letter full of apologies that i am unhappy, but gonna take them forever and a day to 'investigate' my claim! so on to the next stage.

    hi all just sent off my prelim letter to abbey yesterday, asking for refund of my charges back to jan 01 (re the back dated statements they eventually sent me) claiming £1753.50. will keep this thread updated from now with how my case is going. i have an o/d limit of £1250 (which is maxed) on an interest free student account. also i am in scotland so i know the procedures are slightly different than in england and wont be able to go to small claims court if it gets to that stage. any advice from anyone along the way is greatly appreciated, and if anyone wants to know how things are going, please ask away! ps. when, in the step-by-step, you are suggested to wait x days before taking some action, does this mean working days (not w/e or bank holidays)?
  11. i have read through them already. i understand now, i have a interest free overdraft account and thats where i wasnt seeing what to do. which is not add any interest as i wasnt charged any
  12. thanks. thats great. just one more question. i know to take out the judicial 8% interest but what should i use as the regular interest rate charge?
  13. this is to be included in the prelim letter, but what exactly is it? sorry if its a dumb question but dont wanna mess up and delay or negate my claim!
  14. it arrived today. so i am now just about to work out exactly how much they owe me. i see with my prelim letter i am supposed to include a 'schedule of charges', what is this is exactly? and also how do i work out the interest that gets added to this? as the interest calculator in the library is for a stage a little further on
