  1. right, got a letter back from natwest saying blah blah blah but you can have £780 back. - to be honest i am quite happy to take that as it will clear the remaining balance but it didn't specify whether they'd remove the default notice. after 4 phone calls and 1 chat with the horrid and "man" at natwest - Stuart Higley he refused to remove the default notice. (i have to say that i asked if he'd prefer that i took him to court to get all £1400 with interest and the default notice back and he said "YES" !!!!) :o please advise as to what i do next, 14 have already expired..
  2. i'm finding it the same sort of buzz as selling on eBay, must be the thought of the ££££'s rolling in!! also, am getting excited that i should be able to remove all my defaults and get everything paid off, i'll even be £200 a month better off - plus i just got a new job with more money so it's going to my head!! smileynhappy

  4. right, have tinkered with letter, not sure if its perfect to send tomorrow, please read and let me know, advising where to make amendments where required. thanks smileynhappy NatWest 52 West Street Fareham Hampshire PO16 0JX September 18th 2006 Response to settlement offer and LETTER BEFORE ACTION Dear Sarah Green Thank you for your letter dated 12/09/06 I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £1292.99 I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I am again, enclosing a copy of the schedule of the charges which I am claiming. I have already sent you a copy of this in my original letter of the 31/08/06. Additionally you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you or was the result of impecuniosity’s caused directly by the taking by you of penalty charges which you had applied unlawfully to my account. In addition to full payment of the sum mentioned above I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable. I require repayment in full of this money and removal of the default notice. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus a claim under ss.7 and 13 of the Data Protection Act 1998 plus my costs and without further notice. Hi There! sent my letter to Natwest asking for my statements, got them just before the deadline - sent off the next letter saying nicely that i would like my £1200 in charges back plus the default notice removed. - Received a letter 1 day before 14 day deadline saying sorry you're not happy blah blah blah.... but then saying they'll refund £325 as a "gesture of goodwill" i'm now confused - do i send 1) LBA 2) Rejection of settlement offer 3) Both letters attached 4) Combination of both letters please help, i want my money those stole from me and screwed my credit rating at the same time thanks
  8. Hi there! hoping you can help. Finally sat down and started the ball rolling for all my credit cards / bank account that has spiralled out of control due to unfair charges Looking around the forums about barclaycard they seem to be complete B*****D's to give statements. I know they owe me a fortune as it was put into default about 16 months ago and i've been paying them atleast £20 a month yet it's STILL over its limit Looking at the threads, they try not to give statements saying that they want more money as they've filed them on microfilche; my 1st question is: "Do i send them the first letter with the £10 and explain that this should cover the costs, including looking up previous statements on microfilche?" please help, all my cards went into default due to the charges that were unfairly put on which i REALLY want to clear by March 07 as i get married and want to start married life almost debt free (car doesn't count ) thanks holly
