  1. In the same situation as you, I contacted Rachel Hinchcliffe's office. I did not have an actual court date, but did have notifcation from the Halifax that they would defend the claim. Next I spoke to the legal services office and they said someone would be dealing with the case. After that, I received a letter from the Halifax, telling me they had refunded the money. Rachel's contact details are elsewhere on this site.
  2. Have you sent the Halifax a letter before action? Send them a letter stating you want a full refund plus interest within a certain time or you will file a court claim. If that does not produce the required result, then process a MoneyClaim. Have a look in the Bank Templates Library for the most suitable template.
  3. Hi. Sorry I didn't post over the weekend. Adpee, there is an excel spreadsheet available here, which will calculate your interest from your last 6 years for you. It is in the bank templates library. You are entitled to every penny.
  4. If you sent the Letter Before Action, it's time to file a MoneyClaim court suit. The letter you received is a standard letter. It's tough at the moment but be strong. The bank is just trying to bully you. If you are going to court, make sure the total you include in your claim is the up to date calcualtion of charges including interest.
  5. Hi frankiefrankie I don't mind at all. In August, I phoned and requested the last six years of bank statements for which I paid a fiver. I identified the charges and sent the simple request later on September 6th. Halifax responded with a partial offer within two weeks which I refused. I went on the phone to them and they were adamant that that was the final offer. Next I sent the letter before action on October 6th. They acknowleged it within a couple of weeks but still said that the partial refund would be all I was getting. I filed my Moneyclaim on the 27th October and Halifax acknowleged it on the 4th November. Today they sent the letter with the full refund. I checked my bank account and the money was there. Normally it takes around about a couple of months. Just follow the steps as outlined in the templates here and dictate the timetable to the bank.
  6. £896 (bank charges)+£160.77(interest)+ £120 (court charges). I followed the step by step guide and eventually filed a Moneyclaim suit. They threatened to take me on in court but within a couple of weeks, my missus phoned me to say that they have settled in full. Checked my bank account and she was right. Thanks again to the CAG who will receive a donation from me. To every one else, like most people who have had success, don't give up and don't settle for second best. You will get every penny of your money. The bank will try to put you off, but stay firm and get what you are entitled to.
  7. I received this letter today. "Dear Mr Rainford, Thank you for your recent telephone call. As a gesture of goodwill I offered to refund six months worth of charges to your account, which you do not wish to accept. I confirm that we will not refund all the charges you have incurred on your account over the last six years. I know that this won't be the response you were hoping for, to comply with legislation, I would like to let you know that if you remain unhappy you can refer your concerns to the Financial Ombudsman Service. They can be contacted by telephone or by post. If you wish to refer the matter to the Ombudsman you must do so within 6 months of the date of this letter. Yours sincerely Redress Advisor Should I contact the ombudsman or go ahead with the court action? Any advice at this stage would be useful.
