  2. James, I've just had all my charges refunded from Capital One as a 'matter of goodwill'. Not as much as you're claiming but not the point. I had one brush off letter from them but re-stated my case that their charges were simply unlawful and I'd see them in court. I'd just raise an action, or at least stop talking to them except to tell them you're doing just that and see what happens. As to their 'goodwill gesture' I'd ignore it, nothing to do with your claim in law. What they decide to punt your way, 'without prejudice', as they say is neither here nor there.   4. Er, Bankfodder, I'm not hijacking anyone's thread, I'm replying to a post and adding my own experience to support Mondeo in his actions, show what I've been doing. I've posted this story already as my own thread, and this is an update to that. Thought, not unreasonably, that folks viewing this thread and interested in FD information might find my experiences helpful. You can 'atone' by apologising for your misapprehension and accusing me of doing something I had no intention of doing. Neal
  5. Hi there, I sent FD the standard letter on the 17th, asking for charges and interest on both my own and a joint account to be refunded. Got a yada-yada letter back, that I'd be happy to post if anyone is interested, offering me 95 of the 260 (plus 8% interest) I'm claiming was unlawfully removed from my account. Sent them back a letter thanking them for their time, pointing out a few inconsistencies in their arguments but basically saying the bottom line is I want my money back. Haven't heard back though the 95 quid has appeared in my account, so I'm going to raise an action tomorrow in the Edinburgh Sheriff Court. Will keep you posted. Their game plan appears to be offer a wee something, stall, then just ignore. So be it. Can't ignore a court action. Would recommend contact in any case. Neal

Dave, confidentiality?? Tell us all... You're amongst friends. Want to let you know, as I have to tell someone, that my mate has just applied for over £7000 worth of charges from various banks going back over 8 years. (+ 8%, he's a cheeky bugger) I don't see why he shouldn't get them and then we'll go out to dinner! He will of course post his corresponence on the forum just to reassure folks of the guaranteed nature of these actions. Me, I'll just come back and let you know that FD paid up, and encourage others to follow suit. Take care, Neal

Want to let you know, as I have to tell someone, that my mate has just applied for over £7000 worth of charges from various banks going back over 8 years. (+ 8%, he's a cheeky bugger) I don't see why he shouldn't get them and then we'll go out to dinner! He will of course post his corresponence on the forum just to reassure folks of the guaranteed nature of these actions.   12. Hi all, I sent my proforma letter to First Direct on Friday 17 claiming £260 plus £14.35 in interest. Got letter back with usual yadda-yadda, offering me £95. Interestingly their customer service manager who responded said that if I was unhappy with the arrangements perhaps I'd be better seeing 'alternative banking arrangements'. Is that their definition of customer service, drive them off to the competitors?? Just sent a letter back saying thanks but please send the rest or I'll see you in court. How I love this. Anyone else had response from First Direct? Suspect their letter may be turning into a form one. Keep your spirts up folks and don't let them grind you down. Neal
