  1. Hi, Thanks for the reply. I have had a read through that but where does it categorically state that a lender cannot add fees, charges etc to the arrears balance and only to the outstanding balance? The reason I ask this is that I see a lot of posts regarding those of us in arrears and having problems with there lenders and when asked if the charges have been added to the arrears balance or shortfall, with the view in my opinion to inflate the true arrears figure an answer comes that they are not allowed to add these charges to the arrears figure only the outstanding balance? I went to court yesterday to suspend my eviction where the company have said my alleged arrears are £9400!! £4100 of this are charges. I mentioned the fact about they can only add them to the outstanding balance and was told that they can add them to the arrears if it it stated in the deeds or tariff of charges? Thats why I needed to know where this general answer comes from? Cheers BTW.. I got the eviction suspended....
  2. Hi, Is there an official ruling on lenders adding charges to the arrears figure? and that they can only be added to the outstanding mortgage balance? If so does anyone have the link etc to this. Thanks

  5. BTW, he did mention the case and said although he is aware of it, it has'nt been fully implemented on normal mortgages but he accepted it's bearing...and as such was happy to allow the arrears to be paid over the remaining term...

  7. Hi Ell, your a star...from another grateful cagger... The judge went in my favour, was impressed with defence statement and has suspended the eviction on my terms. The **** were not going to accept 30 towards the arrears but after the judge looked at my budget sheet again he said nope, 30 is fine.... Now the next battle...lets get those charges back....may need your help on that one also.. Do I need to SAR them now? Thnx so much...

  9. Yes, thats what I thought. It's like the spelling of my address on the same form...it's wrong, but again the only purpose would be to postpone for a short time. All I can do now is wait and see what happens...
