2. Hi guys , should I put that point in my letter citizenB or should I just point out that my wife would not have been able to claim on the policy due to not been in employment . the bit about only benefiting from the the life cover assumes they have given me a choice or should I put it in. dx100uk link loan 5 do you mean everything after point 4. thanks you guys nigel 1804
3. Just to update here filed complaint with the FOS ombudsman detailing all the previous treatments and wrong decisions. regards nigel1804
4. Hi I have attached here my letter that I received from the LTSB. I might add that the letter was of poor quality the paper was cheap and the printing was terrible its not my scanner that has made the marks down the page thats how I received It. I would be greatful for any helpful comments as to how I can adapt the great reply letter that was brought to my attention earlier by dx100uk. has anyone else had a similar letter or even exact copy. Regards nigel1804
5. Thanks dx100uk. would anyone like me to list my letter I think they are squirming around everyone replies. If my wife wasn't in employment at the time there is no way they would have payed her out surely......my family is a very close one and has helped us out on many occasions is that good enough to reply with as evidence as to why and I think I'll mirror the great letter on the above thread .... oh yes there are a lot of familiar things going on right down to the two phone calls talking crap. regards nigel1804
6. Hi CitizenB and ims21. Oh yes we go way back on this site. I've taken the halifax to the ombudsmen already from my other thread with the halifax. how can I get the letter onto the site for you guys to have a look.....I really do believe they are stalling. They make out as if they were actually there at the time.the 2 phone calls were very wierd and even I could hardly understand the caller. They asked my wife rediculous questions and the best part is it was already in the questionaire. Can I attach the letter somehow.? regards nigel1804
7. Hi again everyone normally I'm doing the halifax or HSBC. I recently discovered that my wife had a credit card with the lloyds TSB I searched through the statements that went right back to 2003.( I had these because I tried to get the bank charges back some years ago on it....remember those days boys and girls.?) Sure enough there was the PPi all dressed up as CARD HOLDER PROTECTION PLAN. Now at that time when my wife went to them for the card she was dealing with or helping her mother to sort out her accounts with the LLOYDS TSB. She asked for a card for herself and it was agreed (Remember those days of banks dying to get you into debt so that they could rape and pillage your finances.??) she could have a card. We didn't even realise that this PPi was on the account until I looked at the statements last November.......since then we had a letter saying that they were looking into it ,then a letter saying they required a further 8 weeks to sort it out, then a phone call askinig if she had ever had a savings account with them (what the hell that had to do with it I don't know. Then we had another call asking us to confirm that would someone of helped her with the payments and was she working at the time >>>? well DER look at the questiuonaire you foreign numpty that we could hardly understand. As it was, my wife wasn't working at the time and this would of been clear in the application for the card. Now lloyds have written back sayinyg that they can not see anything in the miss selling of the policy to us that that a booklet with the Ts and Cs was handed over etc..........now surely if it had been made clear by there sales person that due to my wife not being employed at the time and she has always been a housewife that the PPI was not suitable because she wouldn't of been able to claim on it, then I'm sure we would n't of said "oh no please put it on so it costs us more but its worthless." Do we now go back and say at the point of sale this sales person new my wife's circumstances and still proceeded with the sale A) we didn't ask for it and nor did we realise that it was on the card B) Why did they put it on the card know it was worthless to my wife as she wouldn't be able to claim on it due to not being employed.......... its all well and good the sales person ticking boxes at he point of sale then flashing through it to get the signature but iI believe we were genuinely miss sold this on the card my wife isn't fully ofay with figures anyway she doesn't know the difference between 3000 and 30000 so she wouldn't of known anyway. HAS ANYBODY ELSE HAD A PROBLEM LIKE THIS WITH LLOYDS.....THEY'RE SAYING HE'S INVESTIGATED ALL SIDES AND CAN'T SEE ANY FORM OF MISS-SELLING.( ) ANY HELP ANYONE REGARDS NIGEL 1804:-x:-x:-x
8. Oh I have a pretty good idea of the banking schemers . I have been a member of this site for a good number of years including all the bank charging years until the house of friends ... Sorry lords ... Decided to help there colleagues along side them out with the final ruling. The banks have a lot to answer for not only did they get us in the current financial mire but they did it fraudulently . They have kept people in financial hardship without a care in the world and the past few years are starting to show their true scruples and the we're alright jack but you can go to hell attitude. It's people and sites like us that eventually found them out that's why a lot changed there charges policy. Your guilty as hell the lot of them. Don't come the moral high ground stuff with me banking institutions any other organization would have been brought to account and gone bust by now , not been bailed out by the tax man . That sounds surreal to think that the tax man freely gave money to help organizations that stole money out of people's accounts with charges that artificially inflated the interest rates well you couldn't write this script in a film . ... Oh and to cap it all pay out ridiculous bonuses to the heads of such organizations. Now I know the worlds gone mad. Cheers ims21 So do I now send in all the info and what has gone on with them to the ombudsman with there questionnaire .? Regards Nigel1804
9. Thanks ims21. Do you agree that the system in this case just seems to be a little lost......they were not able to send me the correct info back after repeated requests I can't understand why they still feel that this account hasn't been mis sold. regards nigel 1804
10. How many people have gone to the Ombudsman and a decision has been overturned Does anyone else have this experience of the halifax dragging their feet regards nigel1804
11. Hi everyone....well after asking the halifax for copies of my claims that I sent to them. Firstly they didn't do anything then I had several telephone calls with the monkeys at customer services number asking for the copies of the claim . Several weeks later they sent me a copy of my claim form for the account that they had already paid me out for. So after more telephone conversations (with the Monkeys)for my other account they eventually sent me a blank Ombudsman questionnaire........do this bank not know what they are doing So I wrote to them with a fresh claim for the account that they hadn't paid me out for and asked them to explain why they had admitted miss selling two other accounts but not this one when the circumstances were the exact same. I received a letter back "Dear mr >>>>>> I am writing to you following your letter dated 17 th November 2012 On considering the information in the letter ,I do not believe it introduces anything that changes the original decision and I am still unable to agree that the policy was mis-sold. When we issued our original decision we advised you of your right to refer your concerns to the Financial Ombudsman Services(FOS). and that you had six months from the date of that letter in which to do so. You are still within this timescale so you are within your rights to refer the complaint to the FOS. I have enclosed a leaflet which gives details of how you can get in touch with them. If you have any queries ,or would like further information, please contact us on 0845 6014034, or alternatively respond to the above address ensuring you quote or reference number. Now this has been signed by another customer services person yet again someone else not the same as before ( this happens every time) not only that the letter does not address in anyway the answers to the questions I asked for (everytine) and why they give out that number to call I'll never know because you can never speak to the said people who sign the letter and they can never give you a reason or answer to the decision made.......I've a good mind to take them to the Ombudsman for the shear way they have conducted my case never an answer has been given by writing or ringing...........has this happened to anyone else.... regards Nigel1804:evil:
12. HI sorry to jump in here but does anyone have the right address to send PPI claim to Credit card with Lloyds TSB Please......... many thanks nigel1804
13. hi IMS21 thanks for that info............so do I then put that in the apr box on CI sheetv101 and is that the amount I would probably receive or do they still add an 8% from the day of each charge... regards nigel1804
14. Hi again everyone can somebody inform me if "CARD HOLDER PROTECTION PLAN" ON A STATEMENT IS A FORM OF PPI. THIS WOULD BE WITH LLOYDS BANK ......LATER IN THE STATEMENTS IT THEN CHANGES TO "PAYMENT PROTECTION COVER" BINGO ....NO....? Would my apr for the spread sheet be 12 times my monthly interest rate of 1.240... many thanks REGARDS NIGEL1804
15. Hi again everyone...when I did my claim for my two credit cards I put the complaints in to halifax at the same time. Now when I got my credit cards they were staggered in the time that I purchased them but they did overlap each other so basically I had them at the same time for a while. I sent in my complaints and both the Ombudsmens questionaires read the same answers for each card nothing had changed in circumstances. I applied on the 30th of April 2012 and on the 14th June 2012 I had a letter to say that one of my accounts they agreed that it was miss sold and payed me out my money. After several weeks of waiting for my second card and many phone calls to a response as to why I hadn't heard about my second card they eventually told me today 28th August 2012 that they didn't think i qualified for miss sold protection on the other card. Well hello you have just paid me out on my other card for the exact same reasons as this card so why do I have to approach the Ombudsman to take it further............I had the two cards at the same time under the same cicumstances.... Anyone else had this and anyone got any ideas as to what my next step is.... Regards nigel 1804.
16. Hi again, the best address for halifax card would that be their Dunfermline address or best to go through head office in halifax i think trinity house trinity road.? regards niogel1804
17. Morning ims21,,,,,many thanks nigel1804
18. Hi does anyone have the best address for the HSBC. to which I send my claim for PPI. The PPI was on a loan , I have looked around some forums but not sure to which one I send it to. |Regards Nigel 1804
19. This is my staement of what I feel happened. "I APPROACHED THE HSBC FOR A CAR LOAN . ON THE 1ST SEPTEMBER 2003 THEY APPROVED A LOAN FOR £4000 FOR THE CAR. THIS WAS MY FIRST EVER LOAN AND AT THE TIME THE BANK SEEM TO CONCENTRATE ON MY MONTHLY AMOUNT THAT I COULD AFFORD TO PAY. IT WAS AGREED THAT I WOULD PAY £159.89 PER MONTH IN ACCORDANCE WITH THE SCHEDULES SET OUT IN THE CREDIT AGREEMENT. I WASN'T MADE AWARE THAT THIS PAYMENT INCLUDED CREDIT PROTECTION INSURANCE AS I ONLY SIGNED THE ONE AGREEMENT FOR WHAT I THOUGHT WAS THE LOAN. IT HAS ONLY JUST COME TO MY ATTENTION VIA MY FATHER THAT MY LOAN HAD THIS PPI COVER IN IT WHICH I WASN'T AWARE I WAS PAYING FOR .MY MAIN CONCERN AND THE BANKS CONCERN SEEMED TO CONCENTRATE ON MY MONTHLY AMOUNT I COULD AFFORD. I CAN GENUINELY STATE THAT I WASN'T AWARE OF THIS PROTECTION ON MY LOAN". in the bit where you have to say why you are now unhappy with the loan "I FEEL THAT I HAVE BOUGHT SOMETHING I DIDN'T REALISE I HAD. AT A TIME WHEN MY FINANCES WERE TIGHT . I FEEL THAT THE BANK USED AND CONCENTRATED ON MY MONTHLY AMOUNT THAT I COULD AFFORD LIKE A SMOKE SCREEN TO TAKING ADVANTAGE IN SELLING ME A POLICY THAT I DIDN'T REALLY NEED". I don't think its a judgement of the agreement although in the bit where you have to say why you are now unhappy with the loan I've made some slight judgement do you think ....will these be ok dx100k do you think. regards nigel1804
20. Hi again everyone.. In my questionnaire I have stated that I wasn't aware of the extra payments being taken out due to the fact that the person selling me the loan concentrated on my monthly amount that I could afford. in the case of my loan the PPi agreemnt is in a seperate box but is still part of the loan application on the same sheet. I signed to agree to pay £159.80 a month not realising that it was also a PPi cover included. Does anyone agree that this can be an argument for a mis sold policy. In the case of my credit cards nothing was discussed that I can remember about a payment protection. It was just suddenly there on my statements and quite frankly its only now I realize that this is what it was ..... ...can this be put down to mis selling..... regards nigel1804
21. well there's a list of the charges and the date it was taken out on there so that should be fine. should I just do a basic letter or do i need to do the longer letter that's in the CAG templates regards nigel 1804
22. so if my card had a negative balance accept for when i payed it off then there will be little interest on it anyway. I filled it in and the figures match the cards statements so .......just wanted to make sure they don't come back at me with technicalities nigel1804
23. Hi everyone iI have used the fosrunning v 101 spread sheet there doesn't seem to be much interest added to the total PPi being reclaimed is this calculated differently from a PPI that would be on a loanmy sons added up nicely from each day that a payment was taken out straight forward why is there little interest on my credit card PPI.its still payed each month albeit different amounts each month. just checking everythings right before its sent in regards nigel1804
