Did you do everything on behalf of your son and would/could you have gone to court on his behalf if he were not available? My son would not be able to take the time from work and I'm wondering, if it went that far, could I go on his behalf? Please advise if possible. mum.
  3. Hi Everybody I'm currently waiting for a response from the Nat West having issued the LBA Section 7 – Data Protection Act 1998 on the 1st August. I have one problem, which I would appreciate your views on - I have not had an acknowledgment to either of my letters. I hand delivered both and had a receipt for the letter and £10 fee with the request for information letter - can't find the receipt anywhere. Would I have to have evidence of having written and paid the fee before the court will even look at my complaint? In which case did I ought to bite the bullet, start again and pay another £10? Has anybody else had to serve a Section 7 & Notice? Regards.
  4. Hi everybody I have a claim myself that is posted under Yorkshire Bank but I have also started a claim on behalf of my son against the Nat West. I did not receive any response in relation to my request for information and have today delivered the 'Letter before Action' relating to the Freedom of Information Act. I'll let you know if anything happens and if I need any assistance in sending a notice to the courts. Keep up the good work everybody.

  7. OK Fellow Bankbusters, Do I now complete the application form to the court and if so do I send it to the County Court or the Small Claims Court? Sorry for my ignorance on this subject but I have never had any dealings with any courts and I don't want to look silly by sending it to the wrong place (I want to look like I know what I'm doing!). The bank's letter said that if they didn't receive a response from me within 8 weeks of their letter, my complaint would be considered closed. Am I supposed to be responding them or will the Court contact them within that 8 week period? Should I be advising the bank that I have sent claim to the court? Please advise.

  10. I've received the 'no deal' response from YB and having read it, it sounds like they know what they're talking about and have made me feel like I don't. This is the point when I could easily say I'll just forget it. Everything they say seems to make sense and that basically I am responsible for the running of my account.If I've overdrawn on insufficient funds then I haven't complied with the Bank's standard terms and conditions and charges where applied in accordance with those terms and conditions as a result of my poor management. Should I go ahead with the next step? Was this to be expected?

  13. I have written, on my son's behalf, to his bank. The original 40 days to respond has now expired and I believe that I now have to write to the Information Commissioners's Office. Can anybody send me a copy of a letter that they have used themselves? I can't see from their website, that there is an email address - does anybody know of one? Do I need to write to the bank to tell them that I have written to the ICO? Please advise. Many thanks.
  14. Hi everybody I have been reading people's threads, with interest, for quite a while now and don't feel so alone anymore. I have already received my 6 years worth of statements and have just used the letter from the library asking for repayment of charges. I will be hand delivering it, together with my calculations, to my branch tomorrow. I know that if I don't get a positive response within 14 days I have to send a letter before taking action, giving them another 14 days. Which letter is it in the library - this isn't making sense to me? Please advise. Regards Sandra
  15. Hi Pudsey I'm just about to embark on my second letter quoting the amount I'm claiming, together with a breakdown of how I arrived at the claim figure. I am somewhat apprehensive about this whole thing but I'm going to go through with it, hopefully with support from some of you who have already been down this route. Have you been successful cos I note that your last message was back in March?
