  1. Hi everyone. I was last on this site in 2006 when I successfully claimed the unfair charges from Virgin/MBNA. Due to the current financial situation, I have looked through my CC accounts, and I am in a position to claim back the unfair charges from Virgin/MBNA again. I haven't even used my CC for well over 12 months, but due to 1 reason or another, I still have the late payment and over limit charges levied against my CC account! I have had a look around the CAG website, but I cant see a step-by-step guide into reclaiming the CC charges. Is it the same method as in 2006, as I have seen a few threads where it mentions obtaining a CCA. Can someone tell me either the step-by-step guide, or where I can find details on the CAG website.   5. Just got a letter from Robert Udy saying that if I dont accept the partial offer of £144 as a full and final settlement of my claim, he is unable to refund the £144 as a partial payment!! I am waiting for my monthly statement to arrive in the next few days, then I send the moneyclaim!! Capital One Bank - CLAIM = £340. 1st letter sent 2nd August.   6. Have received my monthly statement, and there is only 1 O/L charge for £12 on it, so filled out the moneyclaim online and submitted!! MBNA have refunded £370, so I am claiming back £329 plus interest. Total claiming back £371.66. MBNA/Virgin - CLAIM = £675. 1st letter sent 2nd August.   7. Hi. That doesn't suprise me with MBNA!!! Just send a reply to them stating that you will accept the money as a partial payment, but that unless you receive the full amount within 14 days, you will pursue the matter through court action to recover the full amount, plus interest, plus court costs. I have put a template below for you to fill out with your own information! Just copy and paste to your computer or a disc and post it to the idiots!! Dear I am in receipt of your letter of (date) and note its contents. With regard to your offer of £176 I am prepared to accept this amount in partial payment of my claim but take note that I intend to pursue my claim for the remainder. If it becomes necessary to commence legal proceedings then my claim at that time will include interest pursuant to statute and court costs. I look forward to your reply. Yours
  8. Hi. The first letter you need to send is the preliminary approach for repayment letter together with a schedule of the charges made to your account, for the return of your bank charges. If you do/dont receive a reply within 14 days, then you can send the LBA. A further 14 days later you can start your moneyclaim!! Both of these letters are found in the "Bank templates Library". You do not need to send copies of your statements, just make a list of the charges and send it with your 1st letter. Make sure you send the letters Recorded delivery, that way you have a record of when it was sent, and also when it arrived, which means the bank cannot say that it never arrived! Barry.

I would write to them 1st thing Monday telling them that the 40 day deadline is nearly up and if you do not receive the items as requested, you will report them to the information Commissioner, for breach of the data protection act. You can report MBNA to the commissioner at ICO – Information Commissioner's Office Dont forget to sent the letter to MBNA recorded mail on Monday, that way they cant say that they didn't receive it!! I am sending my Moneyclaim for £750 through on Monday for MBNA/Virgin!! Good luck!

I sent a letter to Robert Udy on Tuesday 29th August saying that I will accept his offer as a partial settlement of my claim, then yesterday I received a letter from Robert Udy saying they were looking into my complaint, and that it could take upto 4 weeks to look into my claim!! DERRRRRRRRRRR!!! Well sorry Capital One, on Monday 4th September, I will being filling out and sending a moneyclaim to obtain the full outstanding amount that I have been unlawfully charged!! I have today recieved a letter from Rachel Claridge, Customer Advocate Office Department Manager, offering payment of £370 "As full and final settlement of your claim", but I am going to do my moneyclaim online for the remainder of the outstanding amount. One point I do have is that I have had a new charge this month for O/L FEE and LATE FEE both for £12. Can I still add this to my claim as the OFT guidlines for default charges are "recommended" at £12?? I hope someone can let me know before I send the Moneyclaim on Monday. Thanks Barry.   12. Maybe they are getting wise to the idea that is will cost them less (8% interest, Court costs etc..) to settle up before people start the moneyclaim, then again maybe not!! I am just glad that I got all my charges returned!! Have had a good day 2day!!
  13. UPDATE! UPDATE UPDATE! UPDATE! UPDATE! UPDATE! Just had a letter from First Direct offering the full amount of my claim!! Running low on funds at the moment, so this will come in very handy!! Would have been nice to get the 8% interest, but I guess an early full settlement is better than going through the moneyclaim process!! The letter says they still dont admit liability, and that if the claim proceeded to court, First Direct would successfully resist any legal challenge in relation to their fees, but will pay up anyway!! Will sign the settlement letter over the weekend and include an additional letter telling them that I still believe their fees are way to high, and will send a letter to the financial ombudsman service regarding this matter. Guess I just wait for the money to hit my account now!! Would like to say thanks for everyone at this site, as wouldn't have been able to get a refund without the advise given!   14. Hi. You can claim back for each overlimit fee, and each late payment fee, going back 6 years that you have been unlawfully charged by Capital One. To be honest, trying to work out the interest on the charges is quite complex, so most people dont bother with this unless you can work it out, and it is usually only for a few pounds at the end of the day. Dont forget that if your claim goes to the moneyclaim stage, you are able to add 8% interest to the outstanding amount! Barry.
  15. Hi Skin, If your 14 days was up or nearly up when you sent the "No thanks" letter, there would be no harm in sending the LBA, as they have made you an offer which they are unlikely to increase, before it goes to moneyclaim! Barry.
