I have looked in the FAQ and letter templates and on a few threads but I couldnt find a letter template to send to a DCA to tell them an account is in dispute with the origial creditor, and am not too sure how to word it myself etc. Can anyone give me some pointers in what to write and what to quote in a letter please? Sorry if this is a stupid question but i dont want the DCA to continue chasing me while an account is in dispute. Thanks! Ral

The extra £50 charges were added on the 26th September, oh well...knew it was too good to be true Received my second fob off letter today so went to Moneyclaim online and filed my claim, total claim £219.93...pretty scary but I am determined to go all the way. Donation will be forthcoming once I receive charges back, thanks for all the help on this site!

Logged onto my A & L account online today and noticed the section where it said the £50 charges were going to be added to my account on 24 August has gone, and they havent been added to the account either. Looks like A&L may have cancelled them...wonder if its because they have received the LBA letter I sent out...hmm.

Only £134 in charges to claim back, but every little helps so the saying goes Sending my LBA letter off today by first class recorded delivery, am expecting the standard fob off letter so in 14 days will be ready to file my claim...will let the forum know how it goes. Got my statement through the post for A&L and they are going to charge me 2 x £50 on the 24th August because I went over my overdraft limit. Not too bothered at the moment as I have moved all my payments/SO/DD to NatWest so I dont use A&L anymore (plus I know they will close the account eventually). Just wondering if I should write to A&L about the £50 they are going to charge me and what to say...or wait until they close the account and do a second claim...anyone been in this situation, what did you do eventually? Ral xx

  7. Could you not argue that you felt bullied into paying etc? just a thought and something i read on this forum elsewhere. Can anyone else confirm?
  8. Hi Alison Thanks for your reply, no its the same account as everything else on my credit file makes sense but Aktiv Kapital are only dealing with 1 account. I guess ill write to them and ask what they are thinking of

Elsinore suggested I post this here instead of on the Debt/Bailiff forum so sorry its been posted twice I have sent my CCA letter to Aktiv Kapital on 7/9/06 and am awaiting their reply for that, and in the mean time I received my credit report from Equifax today (still waiting for reports from the other 2 CRA's) Anyway, one of my debts I defaulted on was with Abbey National Visa Card (taken over by MBNA) which was subsequently "assigned" to Aktiv Kapital. On my credit report there are two defaults both in Aktiv Kapital's name: AKTIV KAPITAL Bank Default Current Balance: £5935 Default Balance: £5789 Start: 01/06/1996 Default: 02/2006 End: 27/02/2006 Last Updated: 14/08/2006 Status: D and AKTIV KAPITAL Credit Card Current Balance: £5788 Default Balance: £5788 Start: 01/06/1996 Default: 02/2006 End: 27/02/2006 Last Updated: 16/03/2006 Status: D54321000000 Now I assume the second default above was in the name of Abbey National before Aktiv Kapital bought the debt, then changed it into their own name etc. If they did that though why put on a second default? I know I can get one of these removed as its for the same account, but which one? Also who should I write to, Abbey National, Aktiv Kapital or the CRA? What should I state in my letter etc that will get them to remove it immediately or do I not need to quote any law? Any advice appreciated
