  2. PJDudley - would you do me an enormous favour & tell me how you managed to get them to agree to send you the details.!? I've been battling for over a month (my own stupid fault for not sending in the fee with my 1st letter - lesson learned!) and all I'm getting is the same line: We'll provide you with details up until July 05 for the £10 fee, all details after that are subject to a charge of £5 a month.

On a slightly lighter note: My conversation with the woman at Customer Relations (0141 242 4137) raised a smile, after quoting stuff to her from the IC website, she went to speak to her line manager & called me back. Gave me the same spiel about £10 covers up to July 05, then it's £5 a month etc etc... So I asked to speak to this line manager that had been giving her this information. Needless to say he wasn't available, so I said I'd hold until he came off the call he must be on. "No no, he's in a meeting" so I asked her when he was due to come out of this meeting "I don't know he's been there all day.." "So, how exactly was it that you managed to speak to him then, what with him being in a meeting all day..?" "....... silence......"
  4. AAARRRGGGH!!! My head's pounding now! Spoke to the branch this morning to claify (again!) that I am not requesting statements, I am requesting Transations. Ended up going round in circles with both the branch & customer relations centre. Their stance is that they will provide details of my transactions back dated until July 2005 under the DPA & for the fee of £10 that I've sent in. All transactions after that they are only prepared to send Copy Statements with a charge of £5 per statement. I called the above number at Network Support (spoke to a different Fiona) and they are taking the exact same stance as the branch. Can anyone help me please.? I really don't want it to un the the 40 day deadline & end up being delayed even further.!!

  6. Contact details would be great - yes please.! I'm getting nowhere fast with the Branch Manager (who's getting a letter of complaint sent in about her today as it happens) so any other angles to try will be gladly received.
  7. Quick question: I failed to send in the payent of £10 along with my 1st letter to them (8th March), will I now have to wait for 40 days from the day they received this £10 or can I have a go at them & push for the original deadline.? Thanks James

I have asked my Customer Relations team to deal with the complaint, and they will contact you soon to advise how we intend to deal with your complaint. In the meantime, you can ontact them on 0845 850 1368 or myself on the above number. You will find enclosed a copy of our leaflet which tells you how we will handle your complaint. Your concerns will be dealt with as quickly as possible, but if you need to speak to me in the meantime, please telephone me on 01387 227051.   9. Letter 2 sent from the Library on Monday, registered 1st class delivery, to claim back the £895 in charges. If they dispute this my plan is to go to court for the initial £750, then go back for the remaining £145 later. Thanks again for everyone's help
  10. Very similar thing has actually happened to me, but with the Clydesdale. I'll have a stab at... £38 for returning the Direct Debit £28 for THAT £38 putting you into an Unauthorised Overdraft £28 for BEING Overdrawn during that calender month (disguised as an 'Account Maintenance Charge' Grand total of: £94.00 for being 0.01p short in your account.?

There appears to have been some confusion on your part as to my original request. I refer you to my original letter to your branch, on the 8th March, which clearly states: "Please supply me with a complete list of transactions and charges relating to my bank account since the opening date of my Current Account, which I estimate to be around September 2001. Alternatively a complete set of bank statements for that period will be acceptable. “ May I please remind you that under the terms of Section 7(1) of the Data Protection Act 1998 (the ‘1998 Act’), you are obliged to furnish me with this information, within 40 days. To help speed this matter along, please find enclosed the fee of £10.00 with respect to the maximum statuary fee for processing this request. If you continue to delay in providing me with this information, I will have little alternative than to lodge a complaint with the Information Commissioner, as already after 2 letters (one of which a form that you sent to me) and 8 phone calls to your branch I am still waiting for a satisfactory response." --- --- --- --- --- --- --- --- --- --- --- --- --- --- --- --- --- --- --- --- Diddled - I know exactly what you mean, they're easily the worst organisation I've ever had the mispleasure of dealing with. Really can't wait to finally be able to get one back on this barrel of rats!
  12. The Maintenance Charges were applied at the end of any month that I was charged for exceeding my overdraft limit, they were £15 a time. I only ever got them whenever I exceeded my overdraft, in addition to the £20 charge per transaction that exceeded my limit.

Ok - my only question in that case is whether I can: Intially request them to refund the full amount of £895, and then proceed with Court action for a £750 claim and a £145 claim later if they refuse, OR Will I have to request they refund the 1st £750, take this as far as necessary (eg Courts etc), before doing the same for the remaining £145.?   14. My Apologies - I've just re-read the FAQ's section - I AM officially a dufus! "If you have to issue a court claim, the spreadsheet will also calculate interest at 8% as allowed by s.64 the County Courts Act (1984) and which you will add to your claim at that point. NOTE: you do not claim the 8% unless you put in a court claim."
  15. I've got 2 accounts with the Bank of Scotland, 1 x Current & 1 x EasyCash. To avoid confusion, I'll create a thread for each account, so that I can keep tabs on how things progress. CURRENT ACCOUNT: 8th March - DPA Letter Sent 7th March - Batch of copy statements arrive, totalled up all Excess Overdraft & Account Maintenance Charges - total of £895. Entered all details into Interest Calculater & the total was £1208.22 Preparing 1st Claim letter but (sorry to be a dufus but I couldn't see this in the FAQ's) do I put in my claim for the Interest now or do I have to wait until it gets to Court 1st.? Also, with the amount being over the £750 limit set in Scotland, do I still claim the full amount (be it £895 / £1208.22 initially) when I write to them, or just the £750.? ** Thank you ** Thank you ** Thank you ** for all / any help you can and already have given me - getting one back on the banks means so much to me & I can't tell you how much I appreciate your help!

After discussion she adv that I need to complete a DPA Request Form, that contains 'absolutely everything we hold about you, but way more than you're lookinf for'... If you wish to contact the branch on any of the above points please call directly on 0131 456 4501" Called branch at 4pm to argue this, "Manager busy, will get her to call you back" No call recieved, so rang again at 4:30, "Manager still unavailable, will call you back in next 5 - 10 mins..."   17. Couple of direct numbers into the Festival Square branch, in Edinburgh: 0131 456 4501 / 0131 456 4529 Both of these by-pass the normal Contact Centre that intercepts all calls that try to go straight to the branch. Hope this is of use to someone.
  18. Thanks - My previous experience with this company had already prepared me for how useless/obstructive they can be. I'm going to send off another letter tonight, highlighting your points above that I didn't request statements, I reqested transactions - although statements would be accepted as an alternative. I cannot stress how badly I want to get my cash back off this bunch - I feel nothing but contempt towards them! Thanks again for the pointers - I can't help but feel a bit out of my league with all this, but I'm damned if I'm being put off this easily!
  19. Hi Folks, I'm currently in battle with the Clydesdale and they're really not playing ball in providing me with all my previous 6 years Transactions. I sent off the Library Letter to request my transactions, was then told that there would be a £5 per statement charge for this. I advised them that I wasn't paying this, and under the terms of DPA it should only carry a maximum £10 admin charge. I was then told what I needed to to was fill in a DPA Request Form, which I've done & sent off, but this morning I've received ANOTHER letter from them telling me: ---------------------------------------------------------------------------- "As per the Data Protection Request Act, and in reference to your original request, if it is purely copy statements that you require then this is not covered under the act, as these are documents that have been issued to you previously. If you do require copy statements we can arrange this for you at a cost of £5.00/statement. If you wish to contact the branch on any of the above points please call directly on 0313 456 4501." ---------------------------------------------------------------------------- I'm just going round in circles now, a good 3 weeks since I sent in the 1st letter. Can anyone give me a nudge in the right direction please.? Many many thanks James
