  1. Just wanted to check how you were getting on with your claim.
  2. Wel Ladies and Gents, looks like round two was a much shorter battle as the bank sent me a letter saying that they are going to pay me my £165 bank and also waiver my charges in April. Of course they have said this is all just a matter of good will and they are under no obligation to do it but they are doing it non the less. I feel a little deflated that it was such a short battle this time, and a bit let down that they didn't put up much of a fight. Oh well I'm going to be sending my Data Information Letters to Capital One, Lloyds Master Card and Mint in the next week or so and then I'll be asking them for my money back in Charges. Big Thank to everyone on this site and I think you have created a monster, because heaven help any financial organisation that hits me with an unfair charge again!

  5. Well Lloyds TSB didn't even bother to reply to my Prelim letter and the gets have applied another £65 worth of charges this month! I'm sending my LBA today adding in the further charges. I have a feeling they may also ignore that letter too. I have a friend that works in the LTSB IT department and apparently they have had to create a dedicated department to deal with all the requests for refunds of bank charges now...so looks like we are having an effect on them. In other news I will be on Northwest tonight this evening, been interviewed about my recent sucessful claim. Wish me Luck. Tracey x

  7. I did indeed send that letter and I'm sure that was the kick in the bum that SCM needed to orgainse the settlement. I've actually been apporached by BBC NorthWest tonight to go on and talk about my experiance, so hopefully I'll be able to create some publisity about the Site and the campaign. Thanks for everything and I've just sent my premlim letter for round two!

  9. Well hot on the heels of my recent sucess i'm going to start a new claim against Lloyds, so I'm about to send off my first request for payment for the bank charges that lloyds have recently charged me yet again...you would think that they would learn and stop charging me. Wish me luck again.

  11. I've had so many doubts as i've been going through this and I nearly gave up on more then one occasion. But thanks to the people on this site I stuck with it and won. If I can win this that anyone can, it's really important that you read, read and read the step by step guide and other info on this site. If you follow that though you really can't go wrong. I'm a little in dis-beliefe at the moment as for the cost of 3 first clast stamps i've won £2500+ back from my bank. Just stick with it, don't let the banks delaying tactics get to you and if you need any help or advice come back to this forum. Tracey x
  12. One final question on this Thread, i'm about to start a new one for the round two. Does anyone have a thank you letter template I can send to my Babnk, thanking them for my settlement? Also should I make refeance to my settled claim when I start my next letter ping pong with them? Thanks
  13. Hi Michael The first thing I did after telling my partner and parents i'd won was make a donation to the site and i've just completed the survey. I couldn't have done it without everyone on this site. For the cost of 3 x first class stamps i've got all my money back. Just faxed my letter off to the court to advise of settlement. I'm still a little in dis-belief at the moment.

I was about to call the court to check on the progress of my claim as it had gone for judgement to the District Judge on Thursday, and thought i'd just check my ban k account before I made the call....AND ALL MY MONEY IS BACK IN MY ACCOUNT. I'VE WON, I'VE BEATEN THE BANK AND I'M £2553.77 BETTER OFF, THEY EVEN GAVE ME MORE INTEREST TO INCLUDE UPTO AND INCLUDING TODAY. I could not have done it without all the help and support I've recevied from this website and there is a donation on it's way. THANKS to everyine but especially Gary H.
  15. Simple Quesiton: When I start my new battle to get more bank charges back (from 01/09/06) do I make referance to my sucessful claim? Or do I do it as if i've never done this before? I thought if I made referance to a previously sucessful claim it may speed the whole process up and let the bank know that I am serious and will take it all the way. What have others done in the past. Maybe I should hole off doing anything until I've actually got the money back in my hands, just I feel I'm so close now and want to start perparing my next case.

I've just requested judgement to be entered on my claim for £2500+ and since the claim went in they have charged me £400 in additional costs so as soon as i've got my money back from my first claim i'm going to start a new one. You really would think that lloyds would cotton on that if they keep charging us we will keep sueing them!
  17. OK I couldn't wait so I've sort of drafted my own letter, if i've made any huge mistakes please can you let me know. In my excitement I did forget to include that I requested payment forthwith, so I only hope that they pay up quickly. Tracey xx
  18. Right i've just spoken to a REALLY helpful lady at Stockport Court and she confirmed that SCM have not submitted any documents and the deadline was 4pm on 9th Feb. She said I can now request judgement so does anyone have a letter I can use for this? She also said I should also request all my costs as the defence will be struck out in accordance with the 2nd court order. So if anyone has a letter I can use for this, i'd be eternally grateful, she also told me to fax it to court to speed it all up and said in passing that SCM normally settle before it getting this far!!!!! So i can really see the light at the end of the tunnel now and today i've started preparing my next case against LTSB and also Mint .....i'm getting a bit of a taste for this now.
  19. Parts of this are exactly the same as the defence they submitted for me, even down to the typos, someone really should point out so SCM that ' and ? are different! I also got that my claim was vague and should be resubmitted, I dealt with that the way this site advises. Anyway Good Luck, hope they pull their fingers out and are a bit quciker with you then they have been with me.
  20. Hi As requested here is the wording of the court order "Before Distrect (EDIT) sitting at Stockport County Court, Heron House, Wellington Street, Stockport, SK1 3DJ. Upon neither party attending Of the Courts own initive. It is ordered that. Unless the Defendent complies with paragraphy 2 of the Order of 12th December 2006 by 4.00pm on the 9th February 2007 the defence will be and is hereby struck out and the Court will have permission to enter judgement." Paragraph two of the original order reads "2. The Parties shall exchange and lodge in Court Office the following not later then 4.00pm on 10th January 2007. a) The written statements of evidence of all persons giving evidence including the parties whose evidence is relied on in support of or in defcne of the claim. b) Copies of any documents which a party proposes to ely on. This must include copies of documents sent to the Court but not to the other Party." I checked with the Court mid afternoon and nothing had come in then, and i've not recevied anything. Hope that helps someone.
  21. Hi Muppet congratulations, I'm two weeks away from my court date and SCM haven't submitted any documents to the court either in my case. I only hope it follows the same path as yours and they settle with me soon. Tracey xx

Right people the latest update is that I sent off my letter to the court requesting that the claim be struck out as SCM hadn't sent me or the court their documents and the court have sent a 2nd order to SMC giving them until 4pm tomorrow (9th feb) to comply with the original court order. I've just got home on 8th Feb and there is nothing here waiting for me, so I'm presuming that their documents will arrive in the morning post. If they do not however the Judge is going to strike out LLoyds TSB'd defence and enter a judgement. Just hope it goes my way if they do enter the judgement. I was really hoping that I may have recevied a settlement offer by now, but as my court date is the 23rd Feb I dont have much longer to wait until I find out if I win or not, even if it does go to the court date. Anyway, I'll keep you all informed and any one else in this position let me know how your claim is going. Thanks Tracey xxx
  23. What a bloody suprise, still nothing from SC&M so i've sent off the letter to the court asking for the defence to be struck out. My hearing date is only 3 weeks away now and I need SC&M to settle asap as I need the money and it's been going on for months now. Wish me luck and I'll keep you all informed on what happens.
