  1. Good morning, I am back here as I have my court hearing on the 16/1/24 and wanted to prepare myself. I have started to read through the cases here where people in similar situations have gone to court and the recently added court transcript. I will continue to read about third party rights. Is there anything else you feel would help. Many thanks

  3. Thanks that is very good advice and I have often seen that my clients (and even myself) have been given a certain level of leeway as litigant in person. I will always make it clear in court that I am not legally trained which helps. I will do my best and it helps that the court I am going to is not the one I would normally attend.

  5. Hi Bank Fodder, Thank you very much for your help and apologies again for the short notice. I have added the email to Judy and noted it in the witness statement and added it to the index. I will send it off and keep you updated. Part of my work is to support people to go to court regarding another area of law, so I am familiar with court proceedings, however, consumer law is completely new to me. Many thanks
  6. The last document posted is the same as the one previous to it but as you stated I didnt need to redact but could remove the text this is what I did. Other than that there is no difference. I will have a look and have no problem to convert to PDF considering previous documents I sent you were in this format. Many thanks

  9. Hi, Thank you very much. I have reattached a read only copy with index and have tried as much as possible to condense the evidence. Please let me know what you think when you can. I have sent an email to Judy to ask for a copy of the contract between Evri and Packlink. Do I need to show evidence of this email and any responses in my bundle?   10. Hi, Thank you this is really helpful. I have attached it again with your additions and added emails from Evri where they have looked into my missing package. I have highlighted the part about asking for the contract between Evri and Packlink as I do not remember doing this. I wonder if I need more evidence that the photo provided on proof of delivery is of a resident of a nearby block. Unfortunately, my tracking numbers are no longer working on Evri's site. Otherwise I could show that the tracking number I have and the tracking number kindly provided by the resident shown in the photo have a proof of delivery photo which is identical. I do have a photo of this persons door and of my door but not sure how much proof I need for this or whether the onus is on Evri to prove it is my address. Many thanks Evri Redacted.pdf

  13. I'm afraid I dont understand. I was given the deadline for the witness statement at the end of February but personal circumstances have delayed my doing this. The court date as stated above is the 16/1/24. Thank you
  14. Hi Bank Fodder and all, Apologies for my late reply. I have decided to go to court and have Evri and the court know. I have received a court order to: Send all of the documents that are relevant to your case to the court at the above address, also send them to the other side. Both parties must do this.These documents should be placed in date order and should be numbered in the bottom right hand corner. You should include the following documents if available:  A copy of the contract/agreement  Relevant correspondence, including text messages and emails Send to the court and send to the other party your own witness statement and also witness statements from anyone who can give relevant evidence about your case. Both parties must do this. A witness statement must  have the court case number at the top  start with the witness’ name and address  it must contain numbered paragraphs and should be typed and double spaced. If not typed, it must be written clearly in block capitals or printed.  finish with the words “I believe the facts set out above to be true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth”, the date of the statement and the person’s signature. The original statement must be sent to the court and copies must be sent to the other side. This must be done by 28/3/23. I attach my first draft of my case file. I know it is short notice but if this could be looked at I would be grateful. I have received an email from Evri / Judy Cobbett with an offer to settle. I have ignored this but will respond if I legally have to. They continue to say that my contract is with Packlink and not Evri and that they have limited tracking information. I am unsure why they continue to say this as the tracking number provided is for their website and the proof of delivery was uploaded onto their website. I also am wondering if I need to add further information about their false evidence of delivery. I understand that there are many reasons to take this to court but my priority is to show that Evri is not just a delivery company that sometimes loses items (as most courier companies may do) but are allowing their staff to steal items, damage items and then cover up these crimes with false delivery information.   16. Thank you both for your responses. I have read that the most that I would be charged would be £200 for the other sides fees. Do you feel this is accurate. I am still considering what to do.

  18. Hi All, As expected Evri rejected my claim as "I dont have a contract with them, it is with Packlink". I know this not to be true. I will continue my reading and have said yes to mediation. I just wanted to check on one question I was unsure on: Do you consider that this claim is suitable for determination without a hearing, i.e. by a judge reading and considering the case papers, witness statements and other documents filed by the parties, making a decision, and giving a note of reasons for that decision?   21. Hi, I am ready to finalise my MoneyClaim application and have received the following from Evri support. My name is Victoria and i am here to help with your enquiry today. I am sorry to hear that you have had to make contact with us in regards to your parcel. I can understand how frustrating this is for yourself. I would like to look into this for you and provide you with an update. I have tracked the parcel and i can see that the GPS is not accurate for the delivery and that the courier has delivered the parcel to possibly the wrong address. I would now advise that you contact the sender of the goods directly and they will be able to look into this on your behalf. Your retailer will hold all of your information from when you have ordered the goods and Evri do not get passed any details other than the delivery details on the label to show us where the parcel is been delivered to. This is why you are best speaking to them directly so they can arrange a refund of a replacement for any parcels that have not been received. It would have been great if this had been sent to me three weeks ago while I was in contact with Ebay. I will add this email to my particulars of claim. Many thanks,
