Hi all,
I have had a claim form through from Lantern Debt Recovery for a loan from 24/7 Moneybox dating back to 05/12/2016.
The claim states:
1. The defendant owes the claimant £147.48 under a regulated loan agreement with Active Securities T/As 24/7 MoneyBox dated 05/12/2016 which was assigned to the claimant on 31/12/2021 and notice of which was given to the defendent on 31/12/2021 (Debt).
2.Despite formal demand for payment, the defendant has failed to pay and the claimant claims £147.48' etc...
Now, I don't have any recollection of this debt and have no knowledge of having been chased to pay it - I did have a number of payday loans so there is a chance that this was one but I genuinely don't have any information on it.
I have filed a request to extend my time limit to 28 days and intend to defend it on the basis that I don't recognise the debt.
Can I ask for proof of the debt owing and how do I go about doing this?
I have not had to do anything like this before.
Is not recognising a debt even a defence?
I don't know where to start
- any help would be massively appreciated
- if the defence fails, I can pay the debt but I don't want to straight away as I don't know what it relates to.
