  3. Hand-delivered BOS a letter today stating I was accepting the payment as partial settlement, and that I would continue with the existing Small Claims unless they settle in full.
  4. I'm wondering if I should stop this claim as they have part paid, and add the £156 into my final claim on this account. It would still not be over £750. I called the bank today (also called 2 days ago) asking what they will do regarding the interest. Bloke said 'you do realise we may close your account?'. YUP . Hope they get it sorted soon so I can submit final claim on this account.
  5. Well, it appears BOS have repaid thew amount for my 2nd claim (3 more to go) but excluding the interest. How should I pursue the interest portion, which amounts to £150?

  7. Put in 2nd claim today, return date 7th Sept, hearing date 14th. Hope it gies the same way as the first!

  9. Success! Got a letter today from BOS which summarises as: BOS have returned Acknowledgement stating they would defend. However, it is not commercially viable so they will re-imburse £445 + £141 interest + £39 fee. Money will be credited to my account in 5 days. So, now that claim 1 of 5 is out of the way do I: 1. submit the next claim now 2. wait for the money to go in and then submit next claim 3. something else? Also, do I inform BOS of my intentions regarding 4 more claims?

  11. BOS also offered me £220, then £750. Refused both
  12. Took my time but put in my first Small Claim via Dumfries Sheriff Court today. Respond date for BOS is 10th August and possible hearing date is 17th August.
  13. Congrats. I'm going to the Sheriffs office tomorrow with my 2 forms. Hopefully as I'm dealing with the same bank I'll get the same result
  14. tks, I'll do that. I forgot to also ask, did you put in the amount of interest owed on the form as part of the total due?
  15. Quick question about form1. Part 4 is: Claim (form of decree or other order sought). My first claim is for £605 (excl interest). Do I say it as follows : 'The Pursuer claims from the defender the sum of £605 with interest on that sum at the rate of 8% annually from the date of service for each charge (together with the expense of bringing action)'? Interest is currently £213. Do I not need to add the £39 fee anywhere i.e. do I automatically get that back? Or should I add it to the £605?
