I have loaned out a substantial sum to an individual and the loan is secured on his property. He has defaulted on the repayments and now needs to sell the property to pay back the loan, but he is continuously delaying the process - it has been several months and still he hasn't even managed to get the property listed. I have threatened to take it to court, but it costs many thousands to make a claim and I am reluctant to do that... do I have any other options? I have first charge on the property, but am not the owner, can i just try to list in myself?
