  1. Yes indeed. Motorhome back in good, no costs incurred by me except a lot of time. I think the main reason I did win was the excellent, very detailed and thorough expert report I had done (it wasn't cheap but Marquis paid for it in the end) by an independent motorhome and caravan consultant that importantly complied with Part 35 of the Civil Procedure Rules. I'd love put a link to him on here but i guess thats not allowed. If anyone wants his details please DM me and i'll gladly pass them on. FL
  2. Just to update but the motorhome dealer (Marquis Leisure) agreed to fix my motorhome floor at no cost to me and pay all my costs just before the case was due to go to court. They even returned it with £100 worth of diesel
  3. So can you not tell its a N172 with that information missing ? Does that mean there will definitely be a hearing ? Both sides have a deadline to get the witness statement to the court, does that deadline also apply to both sides exchanging copies of each others witness statement ? Thanks FL
  4. Its not identical in layout to https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/688465/n172-eng.pdf but the content looks the same
  5. Sorry yes, witness statement. I've been sent a "Notice of Trial Date" in a county court. So does this mean the trial will definitely go ahead ?
  6. i've submitted my witness report but have since been advised of a hearing date. Does that mean there will definitely be a hearing ? Also is the deadline for the other side to get a copy of their witness report to me the same date as to get it to the court ? FL
  7. OK will do. Will the fact that the other party first agreed to but then cancelled mediation work in my favour at all ?
  8. I've received the court order for my claim detailing the actions i must take prior to the hearing. I'm after advise regarding my witness statement. Witness Statements WWW.JUSTICE.GOV.UK How much detail do i go into in the witness statement ? At all stages of the claim i've stated that i've been prepared to go to mediation. When i first issued the claim the other party rejected the claim but suggested that we both use the free mediation service which i agreed to and appointment was made. However a week before the appointment it was "cancelled as the other party does not wish to mediate". Should i put this in my witness statement ? Thanks FL
  9. Hi dx, So tomorrow is day 14 from my new LOC, the dealer has replied saying they will not be entering into any further correspondence. I’ve created to a Money Claims account so just need to create the small claim on Friday after reading up on the links you sent in the previous post ? Regards FL
  10. Exactly the same letter re-dated or could i add that the only ADR the dealer uses (NCC IDRS) said they could not help because "the NCC cannot become involved with warranty matters or complaints related to whether a product is of satisfactory quality" ? FL
