  2. This is a little different to the typical 'my neighbours trees are hanging over'. Key points; I bought the property in 2021, and the trees were present then. The land is owned by the Nottinghamshire Wildlife Trust, and is whats they call a "Conservation Park" The trees are around 40 feet high, and overhang the garden by about 15 feet (about half of the garden). I have nothing in the deeds or other documentation that mentions anything about the trees or their upkeep. I emailed the trust last year asking if they could trim the trees so they no longer over hang the garden (I dont really mind the height). Their reply was that they review the review the trees once a year and if they deem them to need cutting, they will. Alternately I can pay for someone to cut the trees back. My main concern is damage to people or property. There have been a few large branches fall in the wind, fortunately no damage was done.   3. Thanks. No wonder the highstreet is on the decline! I've just had a quick look at the specs Noise Level :<65db It's way higher than this. My phone says its more like 100db even on the lower setting.
  4. Hi, I recently bought a large fan from homebase. On testing I found it far too powerful and noisy for what I had intended. I have obviously taken it out of the box and plugged it in. I returned to homebase and spoke to customer services. They called the manager and he told me he would test it, but if it wasn't making an actual 'fault' noise they wouldn't accept the return. It's been years since I've returned anything to a retail store and guess I've been spoilt with the ease of return at places like Amazon. I've checked the returns policy and it does state "All returned items must be unused, in their original packaging, with a receipt or order confirmation. Products which have been installed cannot be cancelled or returned unless faulty". Is there any way way I can return this?   5. Sorry for the late reply, I've mainly been receiving advice from the other site (National Consumer Service) which certainly isn't a 'scam' site as FTMDave claims. Its just another forum, like this one with well informed members that have lots of experience with motoring issues. While I still think this is a good site (consumeractiongroup), it has a very broad range of topics, where National Consumer Service specifically targets motoring issues. Anyway, Since following the advice from National Consumer Service I havent heard a peep from either smart parking or the debt collector. I'm not suggesting they have dropped the matter, but maybe have realised its not worth their effort and just put it on a pile for a rainy day. In any case, they aren't bothering me at the moment.

I haven't ignored the LOC I replied and told them they failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act, and cannot, therefore, transfer liability for the alleged charge from the driver at the time to you, the keeper. I'm referring to the earlier posts relating to the PCN and before the LOC was received. The other forum (which I haven't named as I dont know if its allowed here) has tons of posts relating to PCNs being late, appealing them and the parking company withdrawing them. It also has lots of posts about smart parking going to court. That's I why I said the initial advice given here was wrong. I was told to not respond to the PCN and wait for a LOC. (I would insert DX100 posts #19 and #25 here which specifically say dont reply, and dont tell them they missed the 14 days) What I should have done is appeal to the PCN and have the parking company withdraw it - which is very common. Instead its now with a DCA threatening court action, who I'm trying to appeal the same thing to.

  10. thanks DX. It probably helps that the keeper of the car is female, and in the photos you can see the driver was male. Do I really need to wait for the letter of claim and reply pack to send the snotty letter? Is there any harm in sending the letter now?
  11. OK, understood. It just so happens that in this instance the person listed on the V5C that received the PCN wasn't the driver. So just sit tight? What about the DCA? Wont they just pursue and eventually file a default?

  15. thanks, I didn't know that. Although as this is new I wouldn't have known to write to them. I have a response from Smart Parking re. the SAR request. I sent them two letters, one a standard SAR and the second was to notify the change of address. They replied to my old address and the Royal mail redirect picked it up. Is proof of identity normal practise now? Or is this because of the address change? sar response.pdf
  16. Thank you both. I sent Smart Parking Ltd a SAR on Monday, and notified them of my new address. I've also setup a Royal Mail redirect for the next 6 months. I'll update the thread when they respond.
  17. Thanks both. I jumped to a conclusion there. Due to an address change, this letter is the only correspondence I've had. The date was the 14/11/2021. I bought a ticket through the ringgo app, and it overran by about 30 mins (from memory). The carpark was LBS, Newark on Trent.
  18. We recently moved house, and sometime before updating the address on a V5 I received a PCN from Smart parking (or so I believe) for 'insufficient paid time". They would have gone to my old address and I think thrown away by whoever now lives there. I've just picked up some post from the estate agent and there is a letter from debt recovery plus for £170. This is obviously going to count as a default, so I'd really like to do anything I can to remove it. Is it worth contacting smart parking and explaining they sent the reminders to the wrong address, and offering to pay them?
